Drake’s ‘Members Only’ Tour Merch Violated Trademarks of Iconic ’80s Brand, Lawsuit Claims

Drake’s production company is facing a lawsuit from the apparel brand Members Only for allegedly selling tour merch that infringed the company’s trademarks.

The case, filed Tuesday (June 12) in New York federal court, claims that Drake’s company (Away From Home Touring Inc.) has been selling t-shirts, including on his recently-wrapped It’s All a Blur Tour, that are emblazoned with the words “Members Only.”

To be clear, the lawsuit doesn’t claim Drake is selling counterfeit Members Only jackets — the iconic 1980s fad the company made famous. Drake’s shirts feature that phrase (written in large script across the front) simply because it’s the name of a track on his 2023 album For All the Dogs.

But in its complaint filed in federal court, the current owner of the Members Only brand (JR Apparel World LLC) says it doesn’t matter why Drake’s company opted to put their name on a shirt — only that he did so.

“The fact that ‘Members Only’ is a song on Drake’s album ‘For All the Dogs’ does not obviate the likelihood of confusion or give [him] a license to use our client’s ‘Members Only’ marks in such a confusing manner, particularly on or in connection with apparel items,” the company’s lawyers write.

Calling “Members Only” a “famous household name,” the lawsuit claims that Drake’s shirts are going to confuse fans into thinking the real Members Only brand is somehow involved: “Away From Home’s use of ‘Members Only’ … is likely to cause confusion, mistake, and deception among consumers as to the origin of Away From Home’s infringing T-shirts.”

Under U.S. trademark law, the context of how a brand name is used is crucial. Two companies can use the exact same name for different products and peacefully co-exist — think Delta Airlines and Delta Faucet, or Dove soap and Dove chocolate. But when used on the same types of products, a similar name can become trademark infringement.

In Drake’s case, his use of the “Members Only” name as a song title almost certainly would not have infringed JR Apparel World rights — both because they’re different products and because the First Amendment gives added protection to use trademarks in creative works like songs. But by using that same name on apparel, the lawsuit says, the legal calculus has changed.

“Away From Home sold … goods bearing the mark ‘Members Only’ that are identical, overlapping, and/or highly similar to the goods that JR Apparel sells bearing its MEMBERS ONLY Marks,” the company’s attorneys write.

A rep for Drake did not immediately return a request for comment.

Kevin Jonas Reveals He Had a Skin Cancer Spot Removed: ‘Get Those Moles Checked’

Kevin Jonas is currently in recovery after doctors removed a skin cancer spot from his forehead — and he wants to remind fans to stay vigilant, too.

In an Instagram video posted Tuesday (June 11), the Jonas Brothers rocker revealed that he was recently diagnosed with a basal cell carcinoma, which he had to get surgery to remove. “Yes, that is an actual little skin cancer guy that has started to grow,” he says in the clip shortly before his procedure, giving the camera a close-up of a reddish spot near his hairline.

Jonas also filmed a post-surgery shot of his bandages, as well as his drive home from the hospital. “I’m all done,” he says in the car. “Now it’s time to heal. Heading home. Make sure to get those moles checked, people.”

In his caption, the Camp Rock star doubled down on his message. “Friendly reminder to get your moles checked,” he wrote.

According to Mayo Clinic, the type of cancer Jonas was treated for begins in the basal cells, which are responsible for producing new skin cells as old ones die off. Believed to be caused by long-term exposure to the sun’s UV rays, it often appears as a slightly transparent bump on the skin but can take other forms.

The “Sucker” musician’s procedure comes amid a break in the Jonas Brothers’ tour. Kevin and brothers Joe and Nick will resume the trek in August with a string of shows in Mexico before heading overseas for a European leg.

The Dreamville boss revived his Might Delete Later‘s YouTube channel with the release of the grainy “Trae the Truth in Ibiza” visual on Wednesday (June 12).

Packed with nostalgia, the clip kicks off with Cole linking up with Trae the Truth as he recalls getting ahold of the thought-to-be-lost footage from their 2012 overseas trip while touring in Ibiza. The scene immediately shifts to the plane landing, which Cole described as being the first he saw from the vault.

Quincy Jones to Receive Honorary Oscar at Annual Governors Awards Event

Quincy Jones is set to receive an honorary Oscar at the Academy of Motion Picture Arts & Sciences’ 15th Governors Awards on Sunday, Nov. 17, at the Ray Dolby Ballroom at Ovation Hollywood. This year’s other honorees, voted on by the Academy’s board of governors, are casting director Juliet Taylor; filmmaker and philanthropist Richard Curtis (the Jean Hersholt Humanitarian Award) and producers Michael G. Wilson and Barbara Broccoli, best known for the James Bond franchise (the Irving G. Thalberg Memorial Award).

“The recipients of this year’s Governors Awards have set the bar incredibly high across their remarkable careers, and the Academy’s board of governors is thrilled to recognize them with Oscars,” Academy president Janet Yang said in a statement. Of Jones, she added, “Quincy Jones’ artistic genius and relentless creativity have made him one of the most influential musical figures of all time.”

This is the second honorary Oscar for Jones, 91, who was voted the Jean Hersholt Humanitarian Award in 1994. Jones accepted that award on the Oscar telecast in 1995 from his longtime friend Oprah Winfrey. He said in part, “This moment, this evening, this spot where I stand tonight was not my destination when I was young and full of vinegar. I did not engineer this journey. To tell you the truth, I don’t think I could even see this far. And now that I’m older and full of wonder, I can see that maybe other forces were at the wheel.”

Jones has received seven Oscar nominations, but has yet to win a competitive Oscar (which is the reason he is not officially an EGOT). Nonetheless, Jones has made Oscar history many times. He was the first Black musician to be hired as music director on the annual Oscar telecast.

In 1967, Jones became the first Black composer to receive an Oscar nomination for best original song for “The Eyes of Love” from Banning. (His collaborator, Bob Russell, was the first Black lyricist to be nominated.) That same year, Jones became only the third Black composer to be nominated in a scoring category, for In Cold Blood. (The first two Black composers to land scoring nods were Duke Ellington, for Paris Blues, and Calvin Jackson, for The Unsinkable Molly Brown).

Jones has received two more nods in scoring categories, for The Wiz (1978) and The Color Purple (1985). He has also received two more nods for best original song, for the title song from For Love of Ivy (which he also co-wrote with Russell) and “Miss Celie’s Blues (Sister)” from The Color Purple. Jones is, to this day, the only Black composer with three nods in scoring categories. He is one of two Black songwriters with three nods for best original song. (The other is Lionel Richie, one of his collaborators on “Miss Celie’s Blues (Sister).”)

Jones received a seventh Oscar nod as a producer of the 1985 film The Color Purple.

He has won all of the other major entertainment awards – 28 Grammys (spanning from 1964 to 2019), a Primetime Emmy (for composing music for the landmark 1977 miniseries Roots) and a Tony (for serving as a producer of the revival of The Color Purple in 2016).

Of the other honorees, Yang said: “The selection of Michael G. Wilson and Barbara Broccoli is a testament to their success as producers of the fan-favorite Bond series and their contribution to the industry’s theatrical landscape. Richard Curtis is a brilliant comedic storyteller whose tremendous charitable efforts embody the meaning of the Jean Hersholt Humanitarian Award. Juliet Taylor has cast iconic and beloved films and paved a new path for the field. Their profound love of cinema and indelible contribution to our art form make these five individuals truly deserving of these honors.”

Curtis’ film credits include Notting Hill, Bridget Jones’s Diary and Love Actually. He received an Oscar nomination for his screenplay for Four Weddings and a Funeral. Curtis is the co-founder of Comic Relief U.K. and USA; his fundraising work over 40 years has helped raise more than $2 billion. In 2005, he co-created Make Poverty History and helped produce the Live 8 concerts. Most recently, he co-founded the group Project Everyone, giving practical support to the UN’s Sustainable Development Goals, and established the ethical investment campaign Make My Money Matter.

Taylor is a prolific casting director who is behind some of the most acclaimed casts in film history. Some notable credits from her 50-year career include Taxi Driver, Annie Hall, Big, Sleepless in Seattle and Schindler’s List. She has worked with directors including James L. Brooks, Nora Ephron, Mike Nichols, Martin Scorsese and Steven Spielberg.

Wilson and Broccoli of EON Productions are producers of the James Bond film series. They have produced some of the most successful 007 films ever, including including Casino Royale, Quantum of Solace, Skyfall, Spectre and No Time to Die. (The last-three named films all yielded Oscar winners for best original song, for Adele‘s “Skyfall,” Sam Smith‘s “Writing’s on the Wall” and Billie Eilish‘s “No Time to Die,” respectively.) Wilson and Broccoli are directors of the Broccoli Foundation, founded by Dana and Albert R. (Cubby) Broccoli to support the arts, medicine and education.  Cubby Broccoli received the Thalberg Award in 1981. Barbara Broccoli is the second woman to receive the Thalberg Award (following filmmaker Kathleen Kennedy in 2018).

The Honorary Award is given “to honor extraordinary distinction in lifetime achievement, exceptional contributions to the state of motion picture arts and sciences of any discipline, or for outstanding service to the Academy.”

The Jean Hersholt Humanitarian Award is given “to an individual in the motion picture arts and sciences whose humanitarian efforts have brought credit to the industry by promoting human welfare and contributing to rectifying inequities.”

The Irving G. Thalberg Memorial Award is presented to creative producers “whose body of work reflects a consistently high quality of motion picture production.”

Sabrina Carpenter, “Please Please Please” & “Espresso” (Island/Republic): Sabrina Carpenter’s set at New York’s Gov Ball music festival on Saturday (June 8) was something of a coronation, as the ascendant pop star played to a headliner’s-worthy crowd in the late afternoon, creating near-hysteria in Flushing Meadows Corona Park with her now-hits-filled set. It helped that she also had a brand-new hit to play live for the first time: the slapping, pleading and unexpectedly twangy “Please Please Please.”  

“Please” was released just the Friday before, along with a buzzy video starring her now-confirmed real-life paramour, Oscar-nominated Saltburn star Barry Keoghan. By the time of her Saturday performance, the song had already gone viral, proving particularly catchy on TikTok for its radio-unfriendly chorus hook “Heartbreak is one thing, my ego’s another/ I beg you don’t embarrass me, motherf—ker.” (Signs held up in the audience read “Please please please play ‘Please Please Please.’”)

While the song was immediately successful on streaming, Carpenter’s Gov Ball set (which also caught a good deal of online interest) just poured gasoline on the fire — helping the song reach the top of the daily and real-time charts for both Spotify and Apple Music, as its video continued to reign on YouTube’s Trending for Music page. It has only continued to grow on DSPs in the days since, netting over 5 million daily U.S. plays on Spotify as of Tuesday. The song has been less immediately dominant in sales and radio airplay, but has also reached the top 10 on iTunes’ real-time chart, and is starting to get some early curiosity spins on the airwaves, led by SiriusXM’s Hits 1 channel.  

But of course, the bigger the song gets, the more traffic it runs into from her current piping-hot smash: “Espresso,” which slips 5-6 on this week’s Hot 100 (dated June 15), but which is also up across the board following the release of “Please” and Carpenter’s Saturday festival set. On Spotify, the song is No. 2 behind “Please” on its Daily Top Songs USA chart, while rating at No. 5 on Apple Music’s real-time chart. It leads “Please” on iTunes, and obviously it’s way ahead of the new song on the airwaves, having moved into the top 10 on Billboard’s Radio Songs chart for the first time this week. (Incredibly, both songs still trail her Emails I Can’t Send deluxe edition cut “Feather” there, which gently falls to No. 8 on that chart after hitting a No. 5 peak in May.)  

Both “Please” and “Espresso” are likely to populate the Hot 100’s top five this week, and may even have a shot at the No. 1 spot. Their chances should depend on how both songs continue to maintain their post-weekend momentum in the final days of the tracking week – or grow even further – with “Please” likely having the inside track between the two songs based on how stratospheric its streaming numbers have already gotten.  

Post Malone feat. Morgan Wallen, “I Had Some Help” (Mercury/Republic/Big Loud): Speaking of Gov Ball: The Friday headliner was none other than Post Malone, who of course got a massive reception across the board – particularly for his encore performance of his and Wallen’s current four-week Hot 100-topper, “I Had Some Help.” (No Wallen guest appearance, sadly for those in attendance.) The performance did not have the galvanizing effect on streaming that Carpenter’s had – maybe he could’ve used a brand new song, too, as “Help” was the only new song from Post’s long-hyped country pivot to appear in his Friday setlist – but the song still holds at No. 3 on the Spotify and Apple Music charts, and No. 5 on iTunes.  

The key for “Help” maintaining separation from the pair of Carpenter hits is, of course, its still-growing radio dominance. The song holds at No. 5 on Radio Songs this week — up 13% in reach, according to Luminate – and jumps 4-3 on Country Airplay and 14-10 on Pop Airplay. If, as trending, its presence continues to expand on those formats this week, while Carpenter’s hits perhaps have a sort of vote-splitting effect on the airwaves, it would certainly help “Help” in its campaign for an uninterrupted fifth week of Hot 100 ruling.  

IN THE MIX

Shaboozey, “A Bar Song (Tipsy)” (American Dogwood/EMPIRE/Magnolia Music): A little further outside of the pop zeitgeist than Posty or Sabrina, Shaboozey’s solo breakthrough smash just continues to get bigger and bigger. While holding in the top five on Billboard’s Streaming Songs and Digital Song Sales charts, it also leaps 22-16 on Radio Songs, with an unusually prolific presence across formats. Billboard’s charts team reports this week that “A Bar Song (Tipsy)” is the first song to be rising in the top 25 simultaneously on the Country Airplay, Pop Airplay, Adult Pop Airplay and Rhythmic Airplay charts — which have coexisted since 1996. The song should continue to contend in the Hot 100’s top five as it keeps rising at radio, meaning it might never be more than a well-timed remix away from making a serious bid for No. 1.  

Billie Eilish, “Birds of a Feather” (Darkroom/Interscope/ICLG): “Birds” (No. 11, a new high) passed “Lunch” (No. 13, after reaching No. 5) last week for the highest-ranking of Hot 100 hits from Billie Eilish’s new Hit Me Hard and Soft album – and next week, “Birds” could hit the top 10 for the first time, as it continues building on streaming (No. 3 on Spotify, No. 8 on Apple Music). It is also beginning to soar on radio, with 1.3 million all-format impressions June 7-10, on the back of airplay from early leaders including SiriusXM’s TikTok Radio and Hits 1, KMVQ San Francisco, WWWQ Atlanta and WIHT Washington, D.C. 

Chappell Roan, “Good Luck, Babe!” (KRA/Amusement/Island/Republic): Of course, discussion of the overall Gov Ball bump would be incomplete without mention of Chappell Roan, whose headline-grabbing Sunday afternoon set – featuring the singer-songwriter in full Statue of Liberty getup, including green skin paint – has also given her overall catalog a major boost. Leading the way there is newest single “Good Luck, Babe!,” which rises 31-26 on the Hot 100 this week, and should be due for another big jump next frame. Whether or not the song can crack the chart’s top tier may depend on if it can secure further radio support, as “Babe” has yet to make the 50-spot Radio Songs listing, but is getting close – including a No. 31-29 move on Pop Airplay this week.

Country’s hottest hitmakers came together at Tin Roof Nashville for Billboard Presents Bud Light Backyard, a two-day event amid CMA Fest.

Country hits, line dancing and ice cold Bud Light. It was a party in Nashville at Billboard Presents Bud Light Backyard, and we have all the highlights.

Countries hottest hitmakers came together at Tin Roof on Broadway for a two-day event during CMA Fest. With DJ Bad Ash and Disko Cowboy providing all the vibes, attendees took to the venue for intimate performances from hit country acts. Day One kicked off with Dalton Dover, Corey Kent and Alana Springsteen. With some onstage support, performers churned out hits, covers and even toasted the crowd.

Meanwhile, Day Two saw the likes of LOCASH, George Birge and Dasha round out the festivities with some familiar tunes. And you already know they brought the energy.

Elsewhere during the event, fans got their hands on free swag, snapped a shot of the swing photo station, and of course, sipped on plenty of ice cold Bud Light.
