BMI Wins Rate Court Ruling to Get Songwriters Paid 138% More From Live Events

BMI enjoyed a double win Tuesday (March 28) in a federal rate court decision that will increase the royalties the performance rights organizations’ songwriters earn at live events.

The federally adjudicated decision in BMI’s rate case against Live Nation, AEG and the North American Concert Promoters Association (NACPA) awarded a 138% increase in rate to 0.5% of the event’s revenue. It also expands that revenue base to include the full price of concert hall VIP packages and box suites, tickets sold directly to the secondary market and servicing fees received by the promoters.

Previously, the revenue definition only reflected earnings directly from the face value of primary market ticket sales.

The rate and expanded revenue base applies to the period of mid-2018 through Dec. 31, 2022.

On the flipside, Southern District of New York Judge Louis Stanton, who handed down the rate court decision, rejected BMI’s attempt to ditch the historical 10% discount fee that the trade group and its promoters get for helping to administer the license on behalf of BMI. As well, BMI’s effort to expand the revenue base to also include sponsorship and advertising revenue was also rejected.

“This is a massive victory for BMI and the songwriters, composers and publishers we represent,” BMI president Mike O’Neill said in a statement. “It will have a significant and long-term positive impact on the royalties they receive for the live concert category.  We are gratified the Court agreed with BMI’s position that the music created by songwriters and composers is the backbone of the live concert industry and should be valued accordingly. Today’s decision also underscores BMI’s continued mission to fight on behalf of our affiliates, no matter how long it takes, to ensure they receive fair value for their creative work.”

“We advocated on behalf of artists to keep their costs down, and managed to hold the increase to less than 1/3 of BMI’s proposed increase,” said a Live Nation spokesperson in a statement. “This will cost the performers we work with approximately $15 million a year spread out over thousands of artists, and cost increases for Live Nation directly are not material.”

Prior to this decision, BMI and the live concert industry have been operating under a license negotiated in 1998 that was renewed twice through June 30, 2013. That agreement called for promoters to pay a performance licensing rate of 0.3% of revenue for concert venues with under 10,000 seats, and 0.15% of revenue for venues with over 10,000 seats. That rate, and the revenue definition that only covered primary market ticket sales, also served as the interim rate until this decision came down today.

AEG did not respond to immediate requests for comment. The NACPA could not be reached for comment.

Meek Mill Pitches Ravens QB Lamar Jackson To Patriots Owner

New England Patriots owner Robert Kraft revealed that Meek Mill reached out to encourage him to trade for star Baltimore Ravens quarterback Lamar Jackson.

As the National Football League held its annual meeting in Phoenix, Arizona on Monday (March 27th), Kraft spoke to reporters and revealed that he had a conversation via text with the “Dreams & Nightmares” rapper three days earlier. “Meek Mill texted and said, ‘Lamar Jackson wants to come to the Patriots,’ Kraft said before adding, “I said, ‘That’s Bill Belichick’s decision.’” When asked about the conversation, Belichick responded in his famously terse manner, “I’m not going to talk about players on any other team.”

Jackson, who’s been the quarterback of the Baltimore Ravens since being drafted by them in 2018, announced that he requested a trade from the team on March 2nd. He related the news of his decision via his Twitter account on Monday, asking fans to personally ask him questions.

This comes 20 days after the Ravens applied a non-exclusive franchise tag after failing to come to terms with him on a long-term contract. That tag means that teams can negotiate with Jackson, but if he signs an offer sheet Baltimore has the right to match it or demand two first-round picks in return.

The 26-year-old quarterback is finding no takers for his services, as he is reportedly seeking a fully guaranteed contract similar to the $320 million contract Deshaun Watson signed with the Cleveland Browns. Many have speculated that the Patriots could make a deal with the Ravens despite their often-bitter rivalry with the franchise, but Kraft and Belichick have expressed support for their current QB, Mac Jones.

Meek Mill’s reported involvement sparked a buzz among industry observers, as it is well-known that he and Kraft have a close relationship. Another reason is that Jackson is not represented by an agent, and the NFL has already sent out an internal memo to all 32 teams to remind them not to engage an “unauthorized representative” by the name of Ken Francis in talks concerning a trade for Jackson.

It was soon revealed that Francis is a business partner of Jackson’s in a fitness equipment business. When contacted by ESPN, Francis denied any negotiating efforts, saying: “I don’t speak for Lamar.”

The wife of the late great Leonard “Hub” Hubbard believes The Roots are not men of their word. She is suing Questlove and Black Thought for fraud.

As spotted on The Philly Voice Stephanie Hubbard is alleging that the legendary band is withholding monies that she believes are due to the bassist. On December 16, 2021, Leonard Hubbard passed due to blood cancer. Prior to his death, he had claimed that the group was shortchanging him based on a contract he signed stating he was a co-owner of the band. Years later, it seems Mrs. Hubbard has continued to fight his fight.

On Thursday, March 23 she filed a lawsuit to the US District Court for the Eastern District of Pennsylvania. The documentation states that Ahmir Thompson (Questlove), Tarik Trotter (Black Thought), Shawn Gee (The Roots manager), and Munir Nuriddin (Roots employee) have been violating RICO laws since 2013 with regard to Hub’s earnings.

Specifically, by “forgery, wire fraud, bank fraud, mail fraud, and criminal copyright infringement”. Furthermore, she says all the original members founded Grand Negaz, Inc.; a corporate entity they all started to funnel all their music-related ventures. Additionally, she states Leonard also had a 25% stake in a company that handled The Roots’ publishing and a 33% stake in a company that deals with their touring bookings.

The estate’s lawyer Luke Lucas gave a statement to The Philadelphia Business Journal regarding the lawsuit. “I would hope that these guys would have enough respect and compassion for their former band member… to make sure that he receives compensation for what may have not been given to him in the past, and so that his widow can live a reasonable life,” he said.

The Roots have yet to formally comment on the allegations.

“It was wild,” he said of his first U.S. performances. “If I’m being honest, I haven’t done that many shows in Korea. I honestly didn’t know what to expect from the crowd, if they were going to like it, so it was kind of nerve-racking at first. It was great to get this reassurance that whatever I’m trying to do, does move people to a certain point.”

He also shared the inspiration behind his intense “Folks” music video, in which the singer is shot in the chest. “It comes down to how people are so quick to judge you based on things that are just out there,” he explained. “I wanted the video to portray that even if you’re just trying to be yourself, you’re still going to get attacked and there are all these things that are going to get in your way.”

While LØREN is an incredible solo artist, he’s an equally talented producer and songwriter who has worked with other popular Korean acts like BLACKPINK. “When I was a producer, I didn’t know what to expect. You just write beats or tracks hoping that they’re going to go somewhere,” he shared of the experience working with the girl group. “With BLACKPINK, they needed a certain set of lyrics that are both in tune with how the song was written originally and how it’s going to sound in Korean. I don’t want to flatter myself, but I think what I did fit that role.”

He added, “I’ve been a fan even pre-debut, so it’s been a dream to work with them and interact with them musically, whether it be the Instagram Live with Rosie or being in the studio with them, hearing their stories and whatnot.”

Fresh off his energetic performance of “Just Wanna Rock” on The Tonight Show, Lil Uzi Vert told TMZ that he supports the decision of his City Girls rapper girlfriend, JT to start therapy. He added that everyone should “embrace themselves.”

JT shared on Twitter that she is “eager” to start therapy while encouraging her fans to do the same.

Many of her fans congratulated the 30-year-old City Girl rapper on the social media site adding that her public decision could “inspire” others.

Lil Uzi’s support may come from his own journey into wellness. He announced earlier this month that he is sober and that the songs from his newest release “The Pink Tape,” were all born out of his sobriety.

He told TMZ that being sober allowed him to choose better song topics and encouraged other rappers to do the same, saying, “It’ll change your life.”

The couple has had an on-again-off-again relationship since first being romantically linked in 2021. But, earlier this year, she gushed about her admiration for Uzi telling Angie Martinez that she is “lucky” and “fortunate.”

“I can say Uzi is a great man, no matter how the internet tries to paint Uzi,” the Miami native told Angie with a big smile, according to Madame Noire. She added, “I’m so lucky and fortunate to have somebody like him because he’s so inspiring. When I see him in his bag, I’m like ‘I gotta get in my bag.’”

The long-running Pride festival in Los Angeles, California will have two superstar headliners this year – Megan Thee Stallion and Mariah Carey.

The organizers of Pride In The Park announced on Tuesday (March 28th) that the R&B legend and the Hip-Hop star will be the featured headliners for the flagship event for Southern California’s LGBTQ+ community.

Carey shared the flyer for the festival on her Twitter account with fans, writing: “I’m thrilled and honored to be a part of LA Pride 2023! I am happy to be back in person celebrating with the LGBTQIA+ community here in Southern California and throughout all of the lands!!! Let’s come together to celebrate love, inclusion, and Pride.”

“I can’t wait to headline LA Pride in the Park and celebrate the phenomenal LGBTQIA+ community,” Megan Thee Stallion said when contacted by the press. “This incredible event advocates for diversity, inclusivity, and equality, so I’m honored to perform and have a blast with all of the Hotties in attendance.”

“Having two women of color headline the event was very intentional,” said Gerald Garth, the board president of L.A. Pride. “Both have been groundbreaking in their own rights by centering women’s empowerment. Mariah’s been a fan favorite among the LGBT community for decades, and she’s been a great friend and supporter, and Megan is the same.” Other performers at the festival have yet to be announced.

The festival will take place in Los Angeles State Historic Park in the Chinatown neighborhood from June 9th to June 11th with Megan Thee Stallion as the headliner for the 9th, and Carey as the headliner on the 10th. The festival precedes the annual Los Angeles Pride Parade that will take place in Hollywood on the 11th, which is a Sunday. 

It returns after a bit of turbulence, with the 50th-anniversary edition of the festival having to be postponed due to the COVID-19 pandemic. Questions about the commitment to racial and gender inclusiveness by the Christopher Street West Association, L.A. Pride’s parent group, also led to two separate festivals being held last year – one in West Hollywood and the other in Chinatown.

The internet was served with yet another reminder to not believe everything they see online. A photo of Pope Francis wearing a puffer coat has been confirmed to be fake.

As reported by The Washington Post, the current head of the Catholic church turned heads last week and it wasn’t because of anything related to religion. On Friday, March 24 an image surfaced on the internet of Pope Francis strutting in a very fashionable chunky full-length white puffer coat. The outerwear piece in question also featured a belt at the midsection, extended cuffs, and a detachable hood.

Naturally, the photo of the holy man big stepping with all the streetwear feels was a sight to be seen and quickly went viral on online. So much so a heavy debate quickly ensued on Twitter on whether the photograph was real or not. Soon after a 31-year-old construction worker finally took claim of doctoring the flick after ingesting mushrooms that produce hallucinations.

Pablo Xavier of Chicago gave a statement to Buzzfeed News on how the viral photograph came to be.

“I’m trying to figure out ways to make something funny because that’s what I usually try to do,” he said. “I try to do funny stuff or trippy art — psychedelic stuff. It just dawned on me: I should do the Pope. Then it was just coming like water: ‘The Pope in Balenciaga puffy coat, Moncler, walking the streets of Rome, Paris,’ stuff like that.”

While the pontiff has yet to address the forgery directly he did speak to the dangers of A.I. during a conference at The Vatican on Monday, March 27.

“I would therefore encourage you, in your deliberations, to make the intrinsic dignity of every man and woman the key criterion in evaluating emerging technologies,” said Francis. “These will prove ethically sound to the extent that they help respect that dignity and increase its expression at every level of human life.”

Boygenius Announces North American Headlining Tour in Support of ‘The Record’: See the Dates

Boygenius are hitting the road. On Tuesday (March 28), the supergroup made up of Lucy Dacus, Julien Baker and Phoebe Bridgers announced their upcoming headlining tour of North America.

The nationwide trek will start with a show on April 12 at the Pomona Theatre in Los Angeles. The concert serves as a precursor to the band’s stop at the Coachella Valley Music and Arts Festival, which they’re slated to play Saturday (April 15 and April 22) before headliners BLACKPINK turn the Indio, Calif.-based fest into BLINKCHELLA for the night.

Following Weekend 2 at the Empire Polo Club, the threesome’s tour will pick back up in the month of June, with intermittent stops in Phoenix, Pittsburgh and Toronto through the summer. Eventually, the 14-date journey will conclude with a show at Red Rocks Amphitheatre in Colorado on Aug. 5.

Carly Rae Jepsen, Broken Social Scene, Bartees Strange, Claud and Illuminati Hotties are all confirmed as opening acts on select dates of the tour. Meanwhile, Boygenius will also be touring in tandem as headliners for the inaugural traveling Re:Set Concert Series during the month of June along with LCD Soundsystem and Steve Lacy.

Each of the shows throughout the summer will be in support of the band’s long-awaited debut album The Record, which is set to be released Friday via Interscope Records — the same day tickets for the tour go on sale to the public. Leading up to the full-length’s drop, the indie rockers have already unveiled the tracks “$20,” “Emily I’m Sorry,” “True Blue” and, most recently, “Not Strong Enough.”
