Lil Durk Sued for ‘Fraud’ by Startup Claiming He Granted Song Rights to Two Different Companies

Lil Durk is facing a lawsuit that claims he signed deals with two different entities for the same song rights — a move that one of the buyers now calls a “manifest fraud.” 

In a complaint filed Wednesday (Dec. 6) in Manhattan federal court, a fintech firm called Exceed Talent Capital says Durk (real name Durk Derrick Banks) agreed to grant the company the recording royalties from his song “Bedtime” even though he had already signed an exclusive deal with Sony’s Alamo Records.

“Despite defendants’ unambiguous contractual representations and warranties regarding their rights in the Banks recording, Exceed has now learned that Banks previously had assigned to a third party the exact same rights,” the company’s lawyers wrote.

The lawsuit claims that the move by Durk — who reached No. 2 on the Hot 100 earlier this year with his “All My Life” — caused Exceed to incur more than $12 million in damages. 

“As defendants have failed and refused to acknowledge any responsibility for their intentional misrepresentations and material contractual breaches, let alone take action to rectify the same, Exceed was compelled to bring the present action to obtain legal redress,” the company wrote. 

According to the complaint, Exceed agreed to pay Durk $600,000 for the recording rights to “Bedtime.” The company says it wanted to package Durk’s track into a fractional investment vehicle, which would allow investors to buy the right to receive ongoing royalties to the song.

“Where I’m from, few own anything,” the rapper said in a press release announcing Exceed’s royalties investment product. “As The Voice of the Trenches and for my label OTF, I’m always looking for ways to expand and give back to my people. Exceed makes it possible for my fans to become part of my team and share in our success together.”

But in May, Exceed received a cease-and-desist from Alamo. The label informed the fintech firm that  Durk was “signed to an exclusive recording agreement with Alamo” and that he did not possess the right to sell his recording royalties to anyone.

“Rather, as Alamo informed Exceed, Alamo possesses those (and a number of further) exclusive rights pursuant to an agreement that Alamo entered into with Banks [in 2021], well over a year before defendants entered into, respectively, the [agreement with Exceed].”

Exceed says it demanded that Durk either fix the situation or refund $450,000 that had already been paid, but that he “utterly ignored” those requests. The lawsuit says the debacle forced Exceed to cancel the sale after it had already “expended significant time, effort and financial resources” in getting it approved by the Securities and Exchange Commission. 

“Exceed was compelled … to return the funds that had been invested by third parties in the Offering, further significantly damaging Exceed’s reputation and relationships with its partners and investors,” the company wrote.

The world of Fortnite and how players can enjoy it continues to grow. Starting today, loyal fans of the game can now boot up LEGO Fortnite, the latest addition to Epic Games’ ridiculously popular video game.

Thursday, December 7, Epic Games launched LEGO Fortnite, a new survival crating game it developed in partnership with the LEGO Group.

Some are describing it as Fortnite and LEGO’s version of Minecraft, another popular title owned by Microsoft. Instead of downloading a separate game, you can access it by selecting it on the Fortnite menu, just like when you choose the battle royale mode.

Epic says the procedural map players can explore is 19x more significant than the battle royale map, and you can either play in a creative mode where you can build whatever you want or a survival mode where skeletons, wolves, and other enemies will generate.



Players will also have to monitor not only their character’s health but also their hunger and extreme heat warnings.

Fortnite is also famous for the skins it introduces into the game, and that continues to be the case in the new mode. Speaking with The Verge, Saxs Persson, Epic’s executive VP, says more than 1,200 Fortnite skins have a LEGO variant players can use.

LEGO Fortnite Isn’t The Only New Mode Coming To Fortnite

LEGO Fortnite is also the first of many in-game experiences coming to Fortnite. Beginning tomorrow, December 8, players can look forward to Rocket Racing (from the creators of Rocket League) and Fortnite Festival on Saturday, December 9 (from the studio behind Rock Band and Guitar Hero).

The latter will allow players to play rhythm-based games similar to Rock Band and Guitar Hero alone or with friends, as well as songs from artists like Eminem, who just recently got his own skin in the game and was a part of the Big Bang event.

Fortnite sounds like it’s the ultimate place to be.

Mariah Carey Sends Brenda Lee Flowers for ‘Rockin’ Around the Christmas Tree’ Topping Hot 100

Mariah Carey has given Brenda Lee an early Christmas gift, from one holiday queen to another.

On Thursday (Dec. 7), the “Rockin’ Around the Christmas Tree” singer revealed that Carey sent her a sweet bouquet of flowers, along with a message congratulating her on her holiday hit scoring the top spot on the Billboard Hot 100 this week.

On her Instagram Stories, Lee posted a photo of the flowers, along with the card sent from Carey that read, “Dearest Ms. Brenda, congratulations on your historic No. 1. Have a Merry Christmas. Love, Mariah.”

Lee, who soundtracked the post with Carey’s seasonal No. 1 hit “All I Want for Christmas Is You,” captioned the post, “Thank you for your sweet note, @mariahcarey! Wishing you the merriest Christmas, too!”

Lee’s No. 1 is, indeed, a historic one. Sixty-five years after the song’s initial release, “Rockin’ Around the Christmas Tree” crowned the Dec. 9-dated Hot 100 this week. The past four Christmases, the song had peaked at the No. 2 spot behind Carey’s “All I Want for Christmas Is You.” The track jumped up seven spots from the week prior, resting firmly within the chart’s top 10 at the No. 8 spot on the all-genre tally. Carey’s Christmas classic sits one spot behind at No. 2.

Lee celebrated the hit’s No. 1 position on the chart via Instagram on Dec. 5. “#RockinAroundtheChristmasTree is officially #1 on the @Billboard #HOT100 charts!” she excitedly shared. “Thank you so much for listening and rockin’ this holiday season! #65YearsLater #Hot100Charts #ARockinChristmas.”

News of the deal comes just after the release of “Houdini” by Dua Lipa, which he co-wrote and co-produced alongside Kevin Parker, Dua Lipa, TK. He is also a trusted collaborator of Caroline Polachek, Charli XCX, Flume, Clairo, Rina Sawayama, PinkPantheress, Lil Uzi Vert, Nile Rogers, Elton John, Shygirl and more, and is up for his first Grammy this year for his contributions to Desire I Want To Turn Into You by Polachek.

Spotify CFO Paul Vogel Is Leaving the Company

Paul Vogel will step down as Spotify’s chief financial officer on March 31, 2024, the company announced Thursday (Dec. 7). As the streaming giant searches for a replacement, Ben Kung, vp of financial planning and analysis, will take on expanded responsibilities to support “the company’s realignment of its financial leadership team,” the announcement stated. 

Vogel was promoted to chief financial officer in 2020 after the departure of Barry McCarthy (he would become CEO of Peloton in 2022). He had previously headed Spotify’s investor relations and led the financial planning and analysis teams. During his tenure, Spotify grew from 124 million to 226 million subscribers and expanded quarterly revenue by 81% from 1.86 billion euros ($2 billion) to 3.36 billion euros ($3.63 billion). 

Despite the constant growth, Spotify has continued to routinely post operating losses and struggled to turn a financial corner within the constraints of a business model dominated by high music licensing costs. In a statement, CEO Daniel Ek noted that Spotify spent two years trying to bring its spending in line with investors’ expectations while putting money into growth opportunities. 

“I’ve talked a lot with Paul about the need to balance these two objectives carefully,” said Ek in a statement. “Over time, we’ve come to the conclusion that Spotify is entering a new phase and needs a CFO with a different mix of experiences. As a result, we’ve decided to part ways, but I am very appreciative of the steady hand Paul has provided in supporting the expansion of our business through a global pandemic and unprecedented economic uncertainty.”

Looking forward, the future CFO will be tasked with helping Spotify reach some of the key goals it laid out at a June 2022 Investor Day presentation — namely 40% gross margin and 20% operating margin. “We are on track to deliver against the goals we outlined at our Investor Day and our recent actions will help us accelerate these efforts,” said Ek. “We look forward to tapping a strong financial leader as our next CFO and I will share more details soon.”

Spotify’s share price declined 2.2% to $191.51 in after-hours trading Thursday following the announcement.

Demi Lovato Talks Holiday Special, Upcoming ‘Child Star’ Documentary & New Music in 2024

In a way, 2023 was Demi Lovato‘s reset year. Across myriad projects spanning various genres and formats, the Grammy-nominated singer-songwriter spent the year flaunting both their versatility and their distinct star quality — two attributes that make their brand new Roku special, A Very Demi Holiday Special, an effortless winner.

They kicked off the year with “Still Alive,” an original song for the box office-topping Scream VI that earned them a best song nomination at the 2023 MTV Movie & TV Awards. The single soon gave way to the promotional campaign for Revamped, a reclamatory endeavor that found Lovato re-recording their biggest pop hits in the rock-focused style of their recent music. Included on the album were rock-ified versions of Billboard Hot 100 hits such as “Sorry Not Sorry” (No. 6), “Heart Attack” (No. 10) and “Cool for the Summer” (No. 11), all of which were included in Lovato’s MTV VMAs performance, which Billboard ranked as the fourth best of the night.

At that ceremony, Lovato enjoyed a best pop nomination for “Swine,” a blistering protest song they released two days before the anniversary of the fall of Roe v. Wade. The track peaked at No. 12 on Alternative Digital Song Sales.

Ready to wind down for the holidays and bask in her delightful new holiday special, Demi Lovato catches up with Billboard for a light-hearted conversation about family traditions, her upcoming Child Star documentary, a potential Christmas rock album and plans for new music next year.

Why was this the year for you to hop into your holiday bag and put on A Very Demi Holiday? 

That’s a good question and I don’t really have an answer for it! [Laughs.] It just was an opportunity that presented itself and I had to take it because I love the holidays! 

What’s your absolute favorite thing about the holidays? 

I love getting to spend time with my family. I think that’s my favorite part of the holidays. 

What are some family traditions that you guys hold near and dear to your hearts? 

Sometimes we wear onesies on Christmas morning. Other times, we have s’mores on Christmas Eve, but those aren’t traditions we do every year. We do do this tradition where we come down the stairs and look at presents, and we’ve been doing that since I was a kid — just having my mom say, “Okay, it’s time for the presents!” and then all three sisters come down at the same time. It’s cute. 

I remember you recounting those moments in the special. When it comes to getting into the Christmas spirit, what’s your personal favorite Christmas song and which performance in the special would be your top pick? 

I’d say that “Have Yourself a Merry Little Christmas” is probably my favorite Christmas song. My favorite song in the special would probably [also] be “Have Yourself A Merry Little Christmas” because I got to do it with JoJo and we had a really great time performing together. 

You guys have worked together previously. What was it like reuniting for a Christmas cover? 

Oh, it was so great! She’s so sweet and funny and being able to work with her again was such a joy. She’s so talented. She’s such a powerhouse vocally and she’s incredible. 

It’s always a treat to hear two vocalists like yourselves joining forces on a track. In terms of the music in the special, how did you guys decide which of your original non-holiday songs to include, and what was the aim of those arrangements? 

You know, it wouldn’t really fit if I did a rock concert for a holiday special, although it depends on who you who you ask! [Laughs.] I wanted to have a different approach to it, so my band was different than my normal band and they were incredible. We had a really great time. I wanted it to feel more in line with the Christmas spirit, so that’s what I did! 

Do you have plans for this to be a recurring special, or is this one-off thing for you? 

I don’t know, we’ll have to wait and see! Wait until next year. 

Between making ugly sweaters and learning the Nutcracker ballet, what was your favorite thing to really sink your teeth into and show out in front of the cameras? 

I think making the meat cakes for my dog was one for the books. Paris and I had a really great time, and I would do anything for my dogs. So, getting to dress them up and see who liked the cake more was really cute. 

Did you look to any past Christmas specials and concerts for inspiration for your own? 

No, I didn’t. I just. I just kind of winged it! [Laughs]. 

What draws you to the holiday season? Why do you think that it’s such an inspiring time of the year for so many artists? 

The holidays inspire so many people because there’s a lot of downtime, so there’s a lot of opportunity to be able to listen to what inspires you during downtime that you wouldn’t have normally throughout the rest of the year. 

There is a segment in the special where you’re consoling this young lady whose grandmother had recently passed away and it was such a beautiful, sentimental scene. What was it like getting to involve fans in this project in such a special way? 

Getting to involve my fans was really fun. It was great to be able to sing with them too, you know? We sang “Joy to the World,” and they seemed really enthusiastic. Getting to surprise my fans was really fun and gave me nerves. I had butterflies to tell each person, but it was fun! 

At the very end of the special there’s this animated thing that comes across the screen and you do a voiceover where you’re talking about aliens and you’re like, “Bye, b—ches, I’m going to Mars!” Did you freestyle that?

Well, the holiday special was trying to show what it would look like if an alien came to Earth and saw what Christmas was like. It would be showing them how absurd Christmas is. How a jolly old man comes down the chimney to give gifts, and there’s a tree that we decorate, you know? So, that was kind of a through-line through the special and I don’t remember how that last line came about! Maybe I freestyled that, I’m not sure. [Laughs.

So, for the fans that didn’t get to sing with you in the special, what can they expect from you musically come 2024? 

Hopefully, I’ll have an album by then. I would love to put out new music. I’m kind of just always releasing new music, it feels like, because I’m always trying to top myself or do something that feels fulfilling in the moment. So, hopefully, I’ll have new music out or new music to release next year. But I’m also not putting any pressure on it. 

Do you have any plans to officially release any of these holiday covers for fans to stream? 

I don’t have any plans to do that, but maybe next year I’ll come out with a Christmas album or something! 

Okay if we get a Christmas album, can we get some rock Christmas songs on there? 

Yeah, that would be cool! 

Outside of music next year, you’re also continuing to make some moves in the film world. You’re currently prepping your Child Star documentary, what are some updates you can give fans on that project? 

I’m getting some really great people to participate in the film. I’m really excited about it and — nothing that I can share with you right now! — but it’s turning out great. I’m having some deep and meaningful conversations with people that obviously were child stars previously. I can’t wait for everyone to see it.

What is on your Christmas playlist? What’s playing around your house as you countdown to the 25th? 

This isn’t Christmassy at all, but I’ve become a really big fan of Lola Young. I’ve been listening to her album a lot. 

When you look back on the year, what’s your favorite overall moment? What’s one moment that you’ll always remember from the making of A Very Demi Holiday? 

I think my favorite moment this year — I mean professionally — I would say the VMAs performance was really fun for me. Yeah. also filming the “Swine” music video was really fun, getting to release the Revamped album was awesome. I think, personally, anytime I’ve been able to spend with my best friends, my boyfriend and my loved ones.

The passing of television icon Norman Lear at the age of 101 has paved the way for a further examination of the shows that the producer and writer was responsible for bringing to the screen and in the process, impacting comedy and American society greatly with a focus on social and political themes of the time.

His work (which included having an astonishing eleven hit shows on air at one time) included shows airing in the 1970s and 1980s that showcased the Black community in roles that captured their full scope and would have a major impact on the industry for decades afterward. We take an in-depth look at the Black-focused shows of Norman Lear that had major success.

Sanford & Son

'Sanford And Son'

Reworking a popular British sitcom Steptoe & Son, Sanford & Son became a smash hit when it aired on NBC in 1974. Ribald veteran comedian Redd Foxx was tapped to star as Watts-based junkman Fred G. Sanford and Demond Wilson as his son, Lamont. Featuring beloved recurring characters such as Aunt Esther (LaWanda Page), the show was Lear’s first featuring an all-Black cast and was a solid ratings giant all of its six seasons, coming in second only to Lear’s iconic All In The Family on CBS. It would end in 1977 after a contract dispute between Foxx and NBC.



Good Times

A spin-off of the Bea Arthur-fronted Maude (which was itself a spin-off from All In The Family), Good Times focused on Maude’s former housekeeper Florida Evans (Esther Rolle), and her husband James Evans (John Amos) as they raised their three children in the projects in Chicago. Good Times was co-created by Eric Monte (who wrote the cult classic Cooley High) and Mike Evans, who starred as Lionel on All In The Family. The show would become another hit series for CBS, despite some turbulence with Rolle and Amos over concerns of negative stereotypes as the character of J.J. (played by comedian Jimmie Walker) was thrust into the forefront with his “Dyn-O-mite” catchphrase (which Lear actually detested at first). Good Times would go on to be revered by many, with numerous Black stars appearing on the show including Janet Jackson as Penny Gordon.



The Jeffersons

Featuring Sherman Helmsley as the quick-tempered laundry owner George Jefferson and Isabel Sanford as his wife, Louise, The Jeffersons would become another major hit series for Norman Lear with roots in All In The Family. The Jeffersons would represent America’s first look at an upwardly mobile Black family as the couple moved from living next door to the Bunkers to the Upper East Side. With a catchy theme song (you’re humming it right now as you read this no doubt) and a unique perspective thanks to the strong cast, The Jeffersons would run for ten seasons from 1975 to 1985 on CBS.



Diff’rent Strokes

This sitcom by Norman Lear first made its debut on NBC in 1978, with Gary Coleman and Todd Bridges starring as Arnold and Willis Jackson, two recently orphaned Harlem children taken in by wealthy Park Avenue widower Phillip Drummond (Conrad Bain) and their daughter, Kimberly (Dana Plato). The show would run for eight seasons on NBC and ABC highlighted by Coleman’s magnetic charm and the “very special episodes” that tacked issues like racism and drug use.

Lear would be an uncredited executive producer for 227, a show that would become part of NBC’s vaunted Saturday night comedy block in the 1980s. Marla Gibbs, who rose to fame as the wisecracking housekeeper Florence on The Jeffersons, starred as housewife Mary Jenkins as part of a trio of friends and neighbors Rose Holloway (Alaina Rose Hall ) and Sandra Clark (Jackee Harry) in the same Washington D.C. apartment building. 227 was also the debut of Regina King, who played Mary’s daughter Brenda. The show would last for five seasons. 

Tate McRae Talks Choreography, Teases New Album Track & More | Billboard Music Awards 2023

Tate McRae brought her first-ever award show performance of “Greedy” to the 2023 Billboard Music Awards Presented by Marriott Bonvoy, and the pop star explained just why choreography had such an important role in the number. Elsewhere in our sitdown interview, McRae teased a track called “My Hometown” off her new album, Think Later, dropping Dec. 8.

Tate McRae:
It is so exciting to perform “Greedy” today — it’s my first ever award show performance of it. For years I’ve been trying to figure out how to dance and sing at the same time. It’s been like an ongoing battle of, like, my songwriter side and my dancer side. And for the first time, I wrote a song that I can, like, fully dance to dance, influence on music so much just because I’ve been surrounded by it my whole life. My mom was my dance teacher at the age of two. She was just, like, putting so much music in front of me as a dancer — you just hear music different, you feel it. And I think that’s what makes me a pretty, like, soulful writer.

Tate McRae:
Got to go to some very cool places. Honestly, one of the best places to go is Australia. For me, I think one of my craziest crowds are in Australia. I’ve no idea why. But I remember going last year for the first time — it was pretty nuts, just know, like, that far away across the world, people were listening to all my lyrics is surreal.

Tate McRae:
I used to be scared of singing in front of people. And then I got to be able to tour for the first time. I’m just, like, I have the coolest fans who just want to have a good time and screaming lyrics as loud as possible. And that’s why I feel like it’s so special when I bring it — to see them even in a setting like this just to be able to interact with them any way just always makes me very happy.

I have a song on my upcoming album. It’s actually called “My Hometown.” It was actually, like, I remember going home for, like, a break for, like, two weeks and ended up writing the song, like, as I was there after I, like, just gotten home from a night out. And I, like, started the song and then finished it back in L.A., but it’s very personal to me. Fans can expect a totally different side of my personality. I usually always write to talk about, like, my deepest darkest fears and, like, the worst parts of my life, and this time I wanted to explore just having fun in the studio. It’s the coolest thing ever, charting on Billboard. I think you just go your whole life, like, looking at your favorite artists and your idols charting. And so it feels very surreal when you’re seeing the name up there. Yeah, every time it shocks me.
