THE BIG STORY: Miley Can’t Wreck “Flowers” Copyright Case

When Miley Cyrus was sued last year, accused of ripping off her chart-topping “Flowers” from the Bruno Mars song “When I Was Your Man,” it wasn’t Mars or any of the song’s co-writers who filed the case. Instead, it was a financial entity called Tempo Music Investments, which had bought out the rights of co-writer Philip Lawrence.

Does that matter? Miley’s attorneys certainly thought it did, arguing in a motion to dismiss that it represented a “fatal and incurable defect” in the lawsuit. But in a ruling this week, a federal judge rejected that argument, calling it “incorrect” and a “misunderstanding” of legal precedent.

In doing so, the judge warned that restricting entities that buy partial copyrights from enforcing them in court — a major issue in the music industry after a years-long catalog acquisition bonanza — would be a radical shift in the legal landscape with major economic consequences.

“Such a limitation would diminish the value of jointly owned copyrights, because buyers would be less interested in purchasing a copyright that they cannot enforce, thereby disincentivizing co‐authorship and collaboration in works,” the judge wrote. “This would undermine Congress’s intent.”

MORE DRAKE v. UNIVERSAL – UMG asked a judge to halt all discovery in Drake’s defamation lawsuit over Kendrick Lamar’s diss track “Not Like Us,” arguing that he was unfairly demanding “highly commercially sensitive documents” — including Lamar’s record deal. The star’s lawyers fired back just days later, arguing discovery should continue because they would likely win the case, noting that “millions of people” around the world think Kendrick was literally calling Drake a pedophile.

CHRISTMAS CAME EARLY – A federal judge dismissed a copyright lawsuit against Mariah Carey that accused her of stealing key elements of her perennial holiday classic “All I Want for Christmas is You” from a little-known 1989 song of the same name by an artist named Vince Vance. In doing so, the judge endorsed reports by musicologists who said the two tracks were “very different songs” that shared only “commonplace Christmas song clichés” that had been used in many earlier tracks.

LIMP LITIGATION – A federal judge shook up Limp Bizkit’s $200 million lawsuit against UMG, sending much of the contentious legal battle to state court but reviving some of its key accusations. In an earlier ruling, the judge had outright rejected the band’s “rescission” demand seeking to void its contracts with the music giant; in the new decision, the judge left that question open for a future ruling by a state court. The ruling means that the band’s copyright infringement allegations, which carry the potential for a large damages award, are also back in play.

LIVE NATION SETTLEMENT – The concert giant agreed to pay $20 million to settle a lawsuit claiming it failed to warn investors about the kind of anticompetitive behavior that ultimately led to the Justice Department’s sweeping antitrust case. Plaintiffs’ lawyers say the deal provides a “fair, reasonable, and adequate result” from the lawsuit, which claimed Live Nation saddled shareholders with significant losses because it didn’t disclose the “regulatory risks it was currently facing” before news of the big antitrust case was made public.

DIDDY DECISION – A federal judge dismissed racketeering accusations and other claims against Sean “Diddy” Combs in a civil lawsuit filed by former collaborator Rodney “Lil Rod” Jones, ruling that the music producer failed to meet the legal requirements to sue under the Racketeer Influenced and Corrupt Organizations Act. But the judge also allowed other parts of Jones’ sexual abuse lawsuit to move forward, including claims that Combs sexually assaulted him.

BUZBEE WITHDRAWAL – Elsewhere in the world of Diddy, attorney Tony Buzbee withdrew from 15 abuse lawsuits in New York federal court, two days after telling a judge he had “made an error in judgment” by failing to disclose that he was not admitted to practice law in that court. Buzbee, who has filed more than 20 Combs cases and fought an acrimonious battle with Jay-Z, said his admission problems had “become a distraction” from the allegations in his cases.

DERULO TRIAL AHEAD – A federal judge ruled that Jason Derulo must face a jury trial over allegations that he improperly failed to credit or pay a co-writer named Matthew Spatola on the chart-topping hit “Savage Love.” Seeking to dismiss the case, Derulo had argued that Spatola didn’t deserve a stake in the copyright just because he was present for a few studio sessions, but the judge said jurors might see things differently. A trial is tentatively scheduled for May.

CASE DISMISSED – Showtime won a ruling dismissing a lawsuit by a woman who claimed George & Tammy — a TV series about country music legends George Jones and Tammy Wynette — unfairly turned her late husband George Richey, who was previously married to Wynette, into “the villain.” The show might have been “unflattering” to him, the judge said, but the accuser didn’t meet the legal requirements for her to sue Showtime for unjust enrichment: “Normally, a plaintiff who cries unjust enrichment must have actually enriched somebody,” the judge wrote.

EMINEM LEAK CHARGES – Federal prosecutors charged Joseph Strange, a longtime former employee of Eminem, with criminal copyright infringement over allegations he leaked the rapper’s unreleased music on the internet. In charging documents, the feds said Strange played or distributed over 25 songs online without Eminem’s or his label’s consent: “The significant damage caused by a trusted employee to Eminem’s artistic legacy and creative integrity cannot be overstated,” the rapper’s spokesman said.

“MAFIA-LIKE ORGANIZATION” – Eugene “Big U” Henley Jr., who helped launch the late Nipsey Hussle‘s career, was hit with a federal criminal case that claims he ran the Rollin’ 60s Neighborhood Crips as a “mafia-like” group despite outwardly posing as an anti-gang activist and music executive. Among other allegations, the feds say Henley was responsible for the murder of a 21-year-old aspiring rapper who was signed to his Uneek Music label.

Jeff Goldblum keeps busy. In between a boundless press cycle for Wicked and an anticipated second round ahead of its counterpart, Wicked: For Good, the acclaimed actor found time to record his fourth album — and stop by Billboard News to discuss it.

Titled Still Blooming, the set arrives April 25 on Decca Records (and Verve in the U.S.). Recorded with his longtime band of 30-plus years, The Mildred Snitzer Orchestra, the album collects jazz standards from Broadway’s golden era and the Great American Songbook — and its superstar features match such stellar curation. 

Scarlett Johansson guests on the aptly titled lead single “The Best Is Yet to Come” while his Wicked pals Ariana Grande and Cynthia Erivo each contribute a song of their own. When it came to tapping Johansson, Goldblum says they met thanks to working on two Wes Andreson films together — they both voice acted on Isle of Dogs and appeared in Asteroid City. 

“We were at the premiere of [the latter] and on that occasion I got to talking about my musical life,” says Goldblum. “And she said, ‘Well, I’d like to do something.’ And she suggested that song.”

As for Grande and Erivo, Goldblum says, “I just think the world of them.” 

“We were on set and I could’ve been intimidated, but they were so warm,” he says. “Pretty soon I was singing everything from The American Songbook, all of which they knew and joined in.” 

One day, he recalls, he started singing, “I Don’t Know Why (I Just Do).” Grande immediately recognized it, telling Goldblum her grandfather used to sing it to her all the time. And now, her rendition with Goldblum and his band opens Still Blooming.

As for Erivo, he remembers telling the star he would be equally honored if she wanted to sing on the album as well, and together they landed on “We’ll Meet Again.” She came to The Hobby Shop studio in Los Angeles to record her vocals and, as Goldblum says, there were “chills and tears as usual.” 

Goldblum then shared how it felt to have a front row seat watching Grande and Erivo perform at the Oscars — and on the set of Wicked and elsewhere — saying he could cry just thinking about it.

Elsewhere in the conversation, he looked to the past — speaking of his long-lasting love for jazz, even sharing the weirdest place he’s ever hopped on the keys — and the future, sharing how else he hopes to continue blooming for years to come. 

“I’ve always said I’m a late bloomer,” he shares. “I just had kids for the first time in my life, nine years ago. My acting feels like it’s better than ever and I’m getting opportunities to exercise that — and my music.”

Playboi Carti continues his triumphant week on Billboard’s charts as he becomes the first rapper — and only third artist overall — to score at least 30 simultaneous hits on the Billboard Hot 100 in a single week. The avalanche comes almost entirely from the 27-year-old Atlanta native’s new album, MUSIC, which concurrently storms in at No. 1 on the Billboard 200.
On the chart dated March 29, Playboi Carti claims 31 total hits on the Hot 100 — all 30 of his MUSIC tracks from the project’s streaming edition, and a feature credit on The Weeknd’s “Timeless,” from the pop/R&B superstar’s Hurry Up Tomorrow album. Thanks to the haul, Playboi Carti joins Taylor Swift and Morgan Wallen as the only artists to capture more than 30 spots on the list simultaneously. Wallen owns the record, with 36 placements on the chart dated March 18, 2023, due to his One Thing at a Time drop, while Swift has crossed the 30-song mark twice: 32 on the list dated May 4, 2024, after her The Tortured Poets Department release, and 31 entries the following week.

With 31 simultaneous hits, Playboi Carti rewrites the record for most Hot 100 entries by a rapper in a single week. Drake previously held the mark, with 27 appearances on the July 14, 2018, chart in the wake of the arrival of his blockbuster Scorpion album.

Playboi Carti’s MUSIC campaign begins with “Evil J0rdan,” which debuts at No. 2 on the Hot 100. The entrance matches Playboi Carti’s best Hot 100 showing as a lead act, tying the four-way track “Type Shit,” with Future, Metro Boomin and Travis Scott, which peaked in the runner-up spot in April 2024. Among all his credits, Playboi Carti featured with fellow guest Rich the Kid on Ye (formerly Kanye West) and Ty Dolla $ign’s “Carnival,” which topped the Hot 100 for one week in March 2024.

MUSIC sparks another Hot 100 top 10 in “Rather Lie,” with The Weeknd, which starts at No. 4. The new single, now being promoted to radio, is the pair’s third shared Hot 100 entry, after “Popular,” also with Madonna, reached No. 43 in June 2023, and “Timeless,” which opened at its No. 3 peak last October.

Thanks to all the MUSIC activity, Playboi Carti surges 75-1 for his first week atop the Billboard Artist 100, which measures artist activity across key metrics of music consumption — album and track sales, radio airplay and streaming — to provide a weekly multi-dimensional ranking of the most popular artists. The rapper previously peaked at No. 2 in January 2021, following the arrival of his Whole Lotta Red album.

Outside Lands is returning to Golden Gate Park in San Francisco, Calif., this summer, and the festival released its star-studded lineup on Tuesday (March 25).
Tyler, the Creator, Hozier and Doja Cat lead the three-day event, which takes place from August 8 to 10. John Summit, Anderson .Paak and the Free Nationals, Vampire Weekend, Glass Animals, Gracie Abrams, Jamie XX, Doechii, and Gesaffelstein are also among this year’s highlighted performers.

This time, Bryan’s “Oklahoma Smokeshow,” a No. 72-peaking song on the Billboard Hot 100 from 2022’s American Heartbreak, pops up in the Feb. 23 episode of Tracker (the 10th episode of season two), begetting 18 million official on-demand U.S. streams and 1,000 downloads in February 2025 in the process, according to Luminate.

Bryan leads the latest Top TV Songs ranking over a slew of songs from the third season of Showtime’s Yellowjackets, whose first two episodes premiered on Feb. 16, followed by episode three on Feb. 23.

Candlebox’s “Far Behind” leads the charge, debuting at No. 2 thanks to 7.2 million streams and 1,000 downloads in February after an appearance in the second episode, while Bush’s “Glycerine” follows at No. 3 (5.9 million streams, 1,000 downloads) following its synch in the premiere.

The ’90s flavor doesn’t extend to the rest of Yellowjackets’ charting songs, though. The series also represents the 1980s with Tiffany’s cover of “I Think We’re Alone Now” (No. 8; 2.7 million streams, 1,000 downloads) and the ‘70s with Cat Stevens’ “Morning Has Broken” (No. 10; 1.3 million streams, 1,000 downloads).

Of the group, “I Think We’re Alone Now” was a two-week No. 1 on the Hot 100 in 1987, though all four reached the top 30.

The 2022 Academy Awards served as the ultimate rollercoaster ride of emotions for Will Smith, who won best actor honors for his role in King Richard, but also delivered the infamous slap across host Chris Rock’s face on stage for jokes made about his wife, Jada Pinkett-Smith.
The actor-rapper received a 10-year ban from the Oscars, and had the option to appeal. The Associated Press caught up with Smith on Monday (March 24), during which he reflected on his actions and explained how he’s planning to move forward.

“I am looking to be the best human I can possibly be, and I’m gonna take what I get with that,” the 56-year-old said.

Smith has since resigned from the Academy of Motion Picture Arts and Sciences and has been apologetic to Rock for slapping him onstage following a G.I. Jane joke about Pinkett-Smith.

“I would like to publicly apologize to you, Chris,” Smith wrote in 2022. “I was out of line and I was wrong. I am embarrassed and my actions were not indicative of the man I want to be.”

Rock hasn’t been open to speaking with Smith yet, but didn’t rule out returning as host for the Oscars at some point in the future.

“You never know. This is what I would say, the most miserable people on earth are people that can’t forgive,” the comedian said earlier in March. “And not just people, you have to forgive yourself sometimes, too. So, hey, you never know.”

On the music side, Smith is returning with his first album in 20 years, Based On a True Story. The LP arrives on Friday (March 28), and he’ll be hitting the road this summer for a tour across Europe and the U.K.

“A well opened up inside of me, a well of understanding of art and pain … all kinds of things that I didn’t even know were in there,” Smith told Billboard in January of his rejuvenated hunger for music. “Then after the Oscars, that spiritual investigation continued and a whole world woke up inside that I didn’t even know was there.”

Garbage announced the dates for their first U.S. tour in nearly a decade on Tuesday (March 25). The 31-city Happy Endings run is slated to kick off on Sept. 3 at the Hard Rock Cafe in Orlando and hit Atlanta, Nashville, Cleveland, Detroit, Philadelphia, Boston, Brooklyn, Pittsburgh, Toronto, Chicago, Minneapolis, Dallas, Denver, Seattle, Vancouver and San Francisco before winding down on Nov. 2 at the Van Burn in Phoenix.
The fall tour will follow the upcoming release of the band’s eighth studio album, Let All That We Imagine Be the Light, which will drop on May 30. Tickets for the tour will go on sale on April 4 here. Singer Shirley Manson said in a statement last month that the follow-up to 2021’s No Gods No Masters will flip that LP’s rage into a more optimistic outlook.

“Our last album was extremely forthright. Born out of frustration and outrage – it had a kind of scorched earth, pissed off quality to it,” Manson said. “With this new record however, I felt a compulsion to reach for a different kind of energy. A more constructive one. I had this vision of us coming up out of the underground with searchlights as we moved towards the future.”

She added, “Searching for life, searching for love, searching for all the good things in the world that seem so thin on the ground right now. That was the over-riding idea during the making of this record for me – that when things feel dark, it’s best to try to seek out that which is light, that which feels loving and good.”

The band that also features original members producer/drummer Butch Vig and guitarist/keyboardists Duke Erikson and Steve Marker recently wrapped a South American tour and have a pair of dates in Mexico in early April. They were forced to cancel the rest of their 2024 dates in August after Manson required “surgery and rehabilitation” for an undisclosed injury she suffered on tour in Europe earlier in the year.

Fuerza Regida is on a mission to reconnect with its ancestral heritage — and they’re doing it the best way they know how, via Mexican music. The group’s upcoming album, 111XPANTIA, which Billboard Español is announcing exclusively on Tuesday (March 25), will be an exploration of the band’s roots, according to frontman Jesús “JOP” Ortiz Paz. The album is set for release on May 2.
The title — pronounced “ixpantia” — comes from the Náhuatl language, a dialect of the Aztecs, symbolizing “manifest,” JOP explains to Billboard Español. “Before I even knew what the word ‘manifest’ meant, I always believed in it,” he adds. “I’d tell myself, ‘I’m going to do this in the future.’ Even as a little kid, I was sure I was going to be something in life. Maybe not an artist, but something. It’s the law of attraction, a testament.”

With 111XPANTIA, Fuerza Regida is on a quest to continue applying this philosophy and turn “every song” into future “bangers.” The San Bernardino, Calif., hitmakers have consistently achieved with their 13 hits on the all-genre  Billboard Hot 100 and 63 on Hot Latin Songs to date. The group’s most recent single, “Por Esos Ojos,” released in February, peaked at No. 5 on the Hot Latin Songs chart.

The artist adds that while they created around 40 songs in the process of making this album, they narrowed down to 12, assuring that every song is a “focus track.”

111XPANTIA will be released via Rancho Humilde/Street Mob Records/Sony Music Latin. It also will be available in physical format, both CD and vinyl.

“This album represents my whole life,” JOP says. “Since I was a 5-year-old kid, I’d see Corvettes in the hood — there were no Lambos — and tell my mom, ‘I’m going to buy that car,’ or I’d look at a big house and say, ‘Mama, I’m going to buy you that house when I get older,’” adding that the meaning of this upcoming release is “to prove something beyond doubt through the power of the mind.”

And those dreams have undeniably materialized. For the June 2023 Billboard Español cover story, the group pulled up in three luxury cars, including a graphite off-roader Lamborghini Urus and a white Chevrolet Corvette. Most recently, Fuerza Regida acquired a new building to house its record label, Street Mob Records — which won the Billboard Latin Music Award 2024 for publisher of the year — in San Bernardino County.

The cover artwork, co-designed by KidSuper’s Colm Dillane, features an eye, a symbol deeply tied to the album’s themes. “The eye means the same thing — ixpantia, 111, manifest — to make your dreams come true,” he explains.

“This is the first album that has so much story to it, so much connection to it. Everything means something. Nothing está allí de oquis,” JOP says, emphasizing that everything is intentional. “Once you get into it, 111XPANTIA, you’re going to start tripping, what it means to be on the next level,” he adds, stating that “everything’s back to the roots” stylistically. “This is the most important album of my career. This is the one that brings all of that together.”
