UMG & TikTok Fail To Extend Expired Licensing Agreement, Taylor Swift, Drake & More Music Pulled Off The Platform

Your music selection for your TikTok posts took a serious hit.

Spotted on The Verge, artists like Taylor Swift, Drake, JAY-Z, BTS, Olivia Rodrigo, and more all had their music pulled off TikTok after the platform and UMG (Universal Music Group) failed to extend the expired licensing agreement when negotiations between the two entities broke down.

Per The Verge:

On Tuesday, UMG accused the video platform of attempting to bully it into accepting a “bad deal” that didn’t soothe the record labels’ concerns regarding adequate compensation for artists and songwriters, protections against AI-generated music, and online safety on the platform to protect artists from “hate speech, bigotry, bullying and harassment.” TikTok responded saying that it was “disappointing” that UMG had “chosen to walk away from the powerful support of a platform with well over a billion users,” and accused the label of putting its “own greed above the interests of their artists and songwriters.”

Rolling Stone reports takedowns on the platform began “gradually” on Wednesday night when “UMG-owned recordings such as Taylor Swift’s “Cruel Summer,” Olivia Rodrigo’s “Get Him Back,” and Lana Del Rey’s “Let the Light In” were no longer appearing in search results.”

Videos from popular TikTok accounts like Dwayne “The Rock” Johnson featuring songs from UMG artists were also pulled off the platform.

In an open letter shared by Rolling Stone, UMG wrote:

TikTok proposed paying our artists and songwriters at a rate that is a fraction of the rate that similarly situated major social platforms pay. Today, as an indication of how little TikTok compensates artists and songwriters, despite its massive and growing user base, rapidly rising advertising revenue and increasing reliance on music-based content, TikTok accounts for only about 1% of our total revenue.

Ultimately TikTok is trying to build a music-based business, without paying fair value for the music,” UMG claimed. It accused TikTok of trying to “bully” it into accepting a “bad deal” by “selectively removing the music of certain of our developing artists, while keeping on the platform our audience-driving global stars.” Universal further alleged that TikTok was allowing its platform to be “flooded” with AI-generated recordings. The company described TikTok’s response to AI as “nothing short of sponsoring artist replacement by AI.

TikTok Responded

The popular Chinese-owned platform had something to say in response to UMG’s open letter in a statement shared online writing:

It is sad and disappointing that Universal Music Group has put their own greed above the interests of their artists and songwriters.

Despite Universal’s false narrative and rhetoric, the fact is they have chosen to walk away from the powerful support of a platform with well over a billion users that serves as a free promotional and discovery vehicle for their talent.

TikTok has been able to reach ‘artist-first’ agreements with every other label and publisher. Clearly, Universal’s self-serving actions are not in the best interests of artists, songwriters and fans.

It sounds like UMG and TikTok are far apart, but we believe cooler heads will prevail, and you will be adding Taylor Swift songs to your cooking videos in the future.

There is just too much money possibly being left on the table here.

YouTube Premium and Music Crosses 100M Subscribers: ‘So Much Room For Growth’

After a string of pivots, rebrands, upgraded offerings and expanded plans, YouTube Premium and Music has passed the magical 100 million subscribers mark, counting users in trials, the company announced Thursday (Feb. 1).

That’s up from the 80 million Premium and Music subscribers around the world (including trials), reported in November 2022, and a jump from 50 million users at the end of 2021.

The milestone is cause for great celebration at the company, notes Lyor Cohen, global head of music at YouTube, in an open letter to the industry issued today (Feb. 1). “This 20-million-member growth in just over a year underscores the strength of our twin engine of advertising and subscriptions revenue,” writes Cohen.

The Alphabet-owned business unveiled its subscription offering, YouTube Music, back in October 2015, and launched its dedicated app the following month.

The streaming landscape then was littered with naysayers. “Many doubted a subscription model could thrive on YouTube,” Cohen notes. “They said the market was crowded and our platform was too different. Today – 100 million subscribers later – our distinctiveness is precisely what drives our success and why I still see so much room for growth.”

Later, in June 2018, YouTube announced the launch of YouTube Premium, formerly known as YouTube Red. Since then, notes Cohen, the Premium service’s global expansion has ramped up and is “now thriving in over 100 countries and regions” with “more on the horizon in 2024.”

By crossing the 100 million mark, “we’re delighted and humbled,” comments Adam Smith, vice president of product management at YouTube, in a separate statement.

Along the way, “we learned a lot, made a few pivots (and even rebranded), expanded our offerings and plans, and made YouTube Music and Premium available in over 100 countries and regions,” adds Smith.

In a matchup of streaming heavyweights, Spotify, the market-leading music platform, holds the advantage. The Sweden-based business came to market early, in 2008, and boasted 226 million premium subscribers worldwide in Q3 2023.

Though Apple rarely shares updates on subscriber numbers, in June 2022, J.P. Morgan estimated Apple Music could hit 110 million subscribers by 2025. The last time the company reported subscriber numbers for Apple Music was in 2019, when it reported 60 million paid users.

As YouTube hangs the decorations, captains of the industry are lining up to thank their tech partner — including a former YouTuber now leading a major label.

“Having been at YouTube when we conceived of the subscription service, 100 million customers felt like a distant possibility,” says Robert Kyncl, who was chief business officer at YT before joining Warner Music Group as CEO. “Today, it’s yet another signpost on a journey of extraordinary growth. The fact that YouTube continues to go from strength to strength isn’t just good for them, it’s healthy for the entire music ecosystem.”

Lucian Grainge, chairman and CEO of Universal Music Group, says the team led by Cohen and YouTube CEO Neal Mohan deserves credit for “continuing to grow and drive innovation while making significant contributions to the global music ecosystem. Our partnership demonstrates that if you start from a foundation of respect for artists and songwriters, there are limitless opportunities to create thriving businesses that benefit artists and fans alike.”

Adds Helen Smith, executive chair of pan-European independent music companies’ trade body IMPALA: “YouTube has a unique place in the music ecosystem, is a valued member of IMPALA’s Friends scheme and a great partner of our 100 Artists to Watch program.” She continues, “We look forward to continuing to work together across the whole European market where there is so much potential for digital services who see diversity as an asset.”

According to Cohen, YT’s businesses have contributed $6 billion in the past year.

“The music industry is at a critical juncture,” he writes. “Together, we can harness technological innovation to drive unprecedented value for artists and fans, building on our momentum that contributed $6 billion to the music industry in 12 months.”

That future, one where the music industry “thrives,” he insists, would see both sides leveraging AI to enhance creative imagination, seamlessly bridging short-form and long-form content for maximum artist exposure, and more.

Justin Bieber Sends Beliebers Into a Frenzy With Studio Pics Teasing Music Return: ‘The Prince of Pop Is BACK!!!’

It has been more than 1,000 days since Justin Bieber released his last full-length studio album. But on Wednesday (Jan. 31) the singer gave his fans something to be hopeful about when he posted a series of pictures suggesting that their long musical drought might be over. In the snaps, Bieber was captured, mic in hand, in a recording studio with a live band, including shots in which he’s sitting on a glowing cube singing with enthusiasm while a nearby Teleprompter displays what look like lyrics.

In another snap, Bieber sits on a mixing console with a harmonica in his right hand and his left hand extended to his side, along with a pic of him walking through what looks like a rehearsal studio, another of him strolling outside, singing near a drum kit and crooning in close up, his eyes shut tight.

The rest of the reel — accompanied by a shushing emoji — consists of pictures of Bieber on the golf links swinging a club and enjoying a day out with a friend. Photographer Rory Kramer also posted some of the same pictures as well as other more colorful, artsy studio images on his Instagram, showing the heavily tattooed Bieber singing in the studio, both shirted and shirtless, writing, “Grateful for the freedom to do my thing. Thank you for that gift @justinbieber.”

Beliebers lost their collective minds over the images, posting comments including, “The prince of pop is BACK!!!,” “we miss u,” “THIS IS WHAT WE’VE BEEN WAITING FOR!!!,” “THE SCREAM I JUST LET OUT!!!” and “Pls drop an album.”

While a spokesperson for Bieber had not returned Billboard‘s request for comment at press time about whether the photos marked a return to music for the singer, the snaps were significant because they suggest that Bieber could be working on his first new music since his 2021 Justice album.

After launching a world tour in support of that collection and his 2020 Changes album in Feb. 2022 — following a nearly two-year delay due to the COVID-19 pandemic — Bieber revealed in June 2022 that he’d been diagnosed with Ramsay Hunt syndrome, which had resulted in “full paralysis” on one side of his face, leading to the postponement of some dates.

Though he hit the road again after a break, Bieber was forced to come off the road again after a Sept. 6, 2022 gig at the Rock in Rio festival due to ongoing health issues. At the time, Bieber said that he needed to “make my health the priority now,” announcing that he would take a break from touring for an indeterminate amount of time to rest and recuperate. A week later, Bieber postponed the next month of dates, then shortly after he cancelled all the remaining shows originally scheduled through March 25, 2023.

Bieber kept a low profile for much of the following year, returning in Sept. 2023 for a surprise cameo on the acoustic version of SZA’s “Snooze.” He began his recent slow emergence two weeks ago when the NHL and Adidas announced a collab with Bieber’s Drew House fashion line for a 2024 all-star jersey collection; a few days later Bieber was announced as one of the celeb captains of Saturday’s (Feb. 3) 2024 NHL all-star game in Toronto.

Just before posting his studio pics, Bieber posted a trio of cute snaps with wife Hailey Bieber.

Who Really Created Nirvana’s Smiley Face Logo? An Appeals Court Might Weigh In Soon

A years-long legal fight over Nirvana‘s iconic smiley face logo could be headed for a major showdown, sparked by a former record label art designer who says he, not Kurt Cobain, created the famed drawing.

Lawyers for the 1990s legends are locked in a sprawling, three-way dispute over the image, which has appeared on countless t-shirts and other merch in the years since Cobain’s death. Nirvana is suing fashion designer Marc Jacobs for using it without permission on grunge-themed apparel, while Robert Fisher — a former designer at Geffen Records — is fighting the band over who created it in the first place.

In a filing last month in Los Angeles federal court, Fisher asked for the right to take the case to a federal appeals court. He wants to challenge a decision in favor of the band, issued in December by the judge overseeing the case, that he claims would “unfairly tip the balance of equities in favor of Nirvana” in an upcoming trial.

“For justice to occur, the jury should be presented with all disputed issues of fact, not only those convenient to Nirvana,” Fisher’s lawyers wrote.

Nirvana has been in court for years over the famous drawing – a yellow smiley face with X’d-out eyes that first appeared during promotion for 1991’s Nevermind. The design eventually became something of an unofficial logo for the band, and has become particularly prominent again in recent years amid a wave of 90s nostalgia among younger music fans.

Lawyers for Nirvana’s corporate entity first sued Marc Jacobs in 2018, accusing the design house of using a look-alike image on a line of its own t-shirts and other apparel called “Bootleg Redux Grunge.” They said Jacobs had just replaced “Nirvana” with the word “Heaven” and replaced the two eyes with an “M” and a “J,” but had changed little else.

“Defendants’ use of Nirvana’s copyrighted image on and to promote its products is intentional, and is part and parcel of a wider campaign to associate the entire ‘Bootleg Redux Grunge’ collection with Nirvana, one of the founders of the ‘grunge’ musical genre,” the band’s lawyers wrote at the time.

In their initial complaint, Nirvana’s lawyers said the smiley face had been created by Cobain – the conventional wisdom for decades about the logo’s origins. But after reading media coverage of the lawsuit, Fisher jumped into the case in 2020, claiming the band’s allegations against Jacobs suffered from just one teeny-tiny flaw: “It is, in fact, Mr. Fisher, who authored the Happy Face, not Mr. Kurt Cobain.”

In legal filings, Fisher told a detailed story of how he allegedly created the design. While working as an art director at Geffen, he said he had quickly become “Nirvana’s go-to person for most of its graphic design needs.” In the summer of 1991, he says he was asked to design something more “consumer-friendly” than an existing t-shirt logo, which featured a circular illustration depicting one of the circles of hell from Dantes Inferno.

“Wanting to stick with a circular design, he started playing around with variations of the smiley faces that he used to draw in his final year at [college], when acid culture was at its peak,” Fisher’s lawyers wrote. “Ultimately, Mr. Fisher settled on an x-eyed design and added a tongue pointing sideways.”

After the lawsuit against Marc Jacobs was filed, Fisher says he originally took his story to the band, assuming it would “help” their lawyers to understand his involvement in the creation of the smiley logo. But he says he was quickly rebuffed because the “the facts” were “a serious inconvenience” to the band.

“For 30 years now, Nirvana has reaped enormous profits from Mr. Fisher’s works through the sale of a wide range of products,” his lawyers wrote in their legal filings. “Assisted by a team of lawyers and managers, Nirvana was able to do so without any compensation to Mr. Fisher by falsely claiming authorship and ownership.”

Unsurprisingly, Nirvana see things differently. The band’s lawyers have staunchly maintained that it was Cobain who had designed the image. But as an alternative, they’ve also argued something else: That even if it was Fisher who created the logo, he did done so as a “work-for-hire” for Geffen. Under the rules of copyright law, would mean that the company — and not Fisher — was the legal “author” of the work.

In December, Judge John A. Kronstadt largely agreed with Nirvana’s assessment. Fisher had argued that he’d done the logo on his own, as a side project separate from his job at Geffen. But the judge ruled that Fisher had clearly been an employee of Geffen at the time, and the task in question – designing a graphic for a Geffen-signed band – was clearly done as part of that job. “Assuming Fisher drew the Smiley,” the judge wrote, “it was a work for hire for Geffen.”

It’s that ruling that Fisher now wants to appeal. In last month’s filing, he asked Judge Kronstadt to hit pause on the case, and instead allow him to immediately challenge the decision at the U.S. Court of Appeals for the Ninth Circuit. In doing so, he warned the judge that his decision on the work-for-hire issue was not only “highly erroneous” – he says he created the design “as a fan of the band, outside of any of his tasks for Geffen” — but also procedurally unfair.

“It will likely be years until this lawsuit is finally resolved and Fisher is able to appeal,” his lawyers wrote. “This case would proceed to a trial where the jury would be extremely limited in the findings it could make and where it would be required to completely ignore Fisher’s position in this matter.”

Attorneys for Nirvana did not return a request for comment, but they believe no such delay is necessary. In legal filings, they’ve asked the judge to move toward settling a trial date; in private correspondence that Fisher disclosed in his filings, they were more blunt: “We are opposed. The Court’s ruling is clear, carefully considered and correct. No more delay. Let’s get the case to trial ASAP.”

Lawyers for Marc Jacobs – which obviously stands to benefit if Fisher is the true owner of the smiley face logo – declined to comment for this story. But they’ve also weighed in and, unsurprisingly, they want any talk of a trial postponed until Judge Kronstadt decides on whether Fisher can get his chance to make his case before an appeals court: “The case will only be ready for trial after Mr. Fisher’s role in that trial is determined.”

Kanye West Performs Classic Hits as Surprise Guest at Travis Scott Concert

Kanye West made a surprise appearance at Travis Scott’s Circus Maximus Tour stop in Orlando on Wednesday (Jan. 31).

La Flame promised a special night and he delivered as word spread about West — who now goes by Ye — performing when he was spotted in the Orlando airport rocking a Jason Voorhees hockey mask and black leather jacket, which he took the stage with.

Ye entered the fray to the icy piano keys of 2010’s “Runaway,” which sent the crowd into a frenzy. He ran threw a few classics such as “Can’t Tell Me Nothing,” “All of the Lights,” “Father Stretch My Hands Pt. 1” and more.

Ty Dolla $ign joined him on stage to perform The Life of Pablo‘s “Fade” as well as their eponymous Vultures lead single alongside Bump J.

West also confirmed that volume one of Vultures is still slated to arrive next Friday (Feb. 9), barring another last-minute change of heart.

Scott made sure to properly pay homage to one of his rap superheroes, and revealed if it weren’t for Ye breaking down barriers in the early stages of his career, he wouldn’t be where he is today.

“I wouldn’t be here on this stage without my brother, man. He opened up these doors for me,” Scott told the Kia Center crowd. “Make some noise for the greatest of all time.”

Wednesday marked the first time Scott and Ye reunited on stage since La Flame brought him out in Rome, Italy, when he was gearing up to deliver his UTOPIA blockbuster in August.

If all goes according to plan, West will unleash volume one of Vultures on Feb. 9, as previously confirmed, with the other volumes following suit on March 8 and April 5.

The TikTok Billboard Top 50 is a weekly ranking of the most popular songs on TikTok in the United States based on creations, video views and user engagement. The latest chart reflects activity Jan 15-21. Activity on TikTok is not included in Billboard charts except for the TikTok Billboard Top 50.

“Never Lose Me” continues its run at No. 1 as it also jumps into the top 20 of the Billboard Hot 100, rising 37-19 with 15.5 million U.S. streams (up 28%) and 2.5 million radio airplay audience impressions (up 105%) in the latest Jan. 19-25 tracking week, according to Luminate.

“Never Lose Me’s” run at No. 1 on the TikTok Billboard Top 50 is largely driven by a variety of trends, with a more recent theme being uploads highlighting the “never had a b—h like me” lyric.

The song is now the second-longest-leading No. 1 hit on the TikTok Billboard Top 50, after Mitski’s six-week leader “My Love Mine All Mine.”

Just below Flo Milli, Muni Long’s “Made for Me” jumps 12-2, becoming her first top 10 hit on the chart. The song has also begun scaling the Hot 100, gaining 93-44 in its second week.

Its trend highlights the song’s “Twin/ where have you been? / nobody knows me like you do” lyric, with users making videos with friends, family or significant others. Long herself has also posted TikToks lip synching to the song, as have Chlöe, That Girl Lay Lay and more.

Good Neighbours’ breakout debut single “Home” debuts at No. 4. The song also debuts at No. 18 on Billboard’s Hot Alternative Songs chart and No. 28 on Hot Rock & Alternative Songs, marking the London duo’s first-ever chart appearance. The duo comprises Oli Fox and Scott Verrill, who had both released solo music prior to forming Good Neighbours — Verrill recorded under the name Good Scott (and before that, Kwassa).

The trend for “Home” shows users singing its “darling won’t you take me home” lyric.

Rounding out the top five of the Billboard TikTok Top 50, He Is We’s “I Wouldn’t Mind” drops 2-3 and Sophie Ellis-Bextor’s “Murder on the Dancefloor” falls 3-5.

Billboard Explains: Harry Styles’ Solo Chart History

Narrator:
Harry Styles knows his way around the Billboard charts. While he first charted as a member of One Direction, he’s proven he can stand on his own as a solo artist.

This is Billboard Explains: Harry Styles’ Solo Chart History.

Harry is no stranger to the Billboard charts. He has three No. 1 albums on the Billboard 200: 2017’s Harry Styles, 2019’s Fine Line and 2022’s Harry’s House.

Harry has a total of seven top 10 hits on the Hot 100, including two No. 1s: 2020’s “Watermelon Sugar” and 2022’s “As It Was.”

“As It Was” was a massive hit for Harry. It’s one of only five songs with at least 15 weeks at No. 1 on the Hot 100. It ranked No. 2 on the Year-End Hot 100 for 2022, and it was so big that it went on to be No. 15 on the 2023 year-end list. The song spent 63 weeks on the Pop Airplay Chart, the second most ever behind Rema and Selena Gomez’s “Calm Down,” and it was the most heard song on U.S. radio in 2022, with 3 billion audience impressions, according to Luminate.

It’s clear that Harry knows how to leave a lasting mark on the charts.

Luke Combs & Tracy Chapman to Perform ‘Fast Car’ at 2024 Grammy Awards Ceremony

Luke Combs and Tracy Chapman will team up to perform “Fast Car” during Sunday’s (Feb. 4) Grammy Awards ceremony in Los Angeles, Billboard confirms. Variety was first to report the news.

In 1988, Chapman’s version of “Fast Car” reached the top 10 on the Billboard Hot 100, but also became an enduring pop classic over the ensuing decades. Last year, Combs reached No. 2 on the same chart with his version of “Fast Car,” which also spent four weeks atop the Hot Country Songs chart.

In July, Chapman offered to Billboard a reaction to Combs’ success with a version of “Fast Car,” saying, “I never expected to find myself on the country charts, but I’m honored to be there. I’m happy for Luke and his success and grateful that new fans have found and embraced ‘Fast Car.’”

Chapman performed “Fast Car” as the closing performance during the Grammys telecast more than three decades ago, on Feb. 22, 1989. That evening, Chapman garnered three Grammy wins: best new artist, best female pop vocal performance for “Fast Car” and best contemporary recording for her eponymous debut project.

This year, Combs is nominated for best country solo performance for his version of Chapman’s “Fast Car.” He was previously announced as a performer on this year’s Grammys telecast, as part of the second group of performances revealed for this year’s show, though at the time, the Recording Academy had not mentioned the possibility of a collaboration performance. However, a live collaboration of the song has seemed like an inevitability, since Combs’ version of the song soared in popularity over the summer.

During the CMA Awards in November, “Fast Car” earned both single and song of the year, with the song of the year win making Chapman the first Black songwriter to take home that CMA accolade.

“I’m sorry I couldn’t join you all tonight,” Chapman said via a statement that was read from the stage during the CMA Awards. “It’s truly an honor for my song to be newly recognized after 35 years of its debut. Thank you to the CMAs and a special thanks to Luke and all of the fans of ‘Fast Car.’”

Travis Kelce Reveals When He Actually Started Dating Taylor Swift Before Her First Chiefs Game

An important piece of the Tayvis timeline has finally been clarified, thanks to Travis Kelce. In a recent interview, the Kansas City Chiefs tight end revealed exactly how long he and Taylor Swift knew each other before she first broke the internet by attending one of his games at Arrowhead Stadium in Missouri late September.

“We had known each other for close to a month up to that point,” Kelce said on The Pat McAfee Show Wednesday (Jan. 31), smiling.

Leading up to that fateful Sept. 24 Chiefs vs. Chicago Bears game, the player had actually teased that Swift might attend on McAfee’s show. “I threw the ball in her court,” he said at the time. “I told her, ‘I’ve seen you rock the stage in Arrowhead, you might have to come see me rock the stage in Arrowhead.’”

Even so, Swifties and NFL fans alike were shocked when the “Anti-Hero” singer did show up to cheer Kelce on in a box suite alongside his mom, Donna. But, as No. 87 said in the new interview, “It wasn’t just an out of the blue, ‘Hey, come to the game.’”

“It’s exciting for me, but it was all brand new, man,” he added of the beginnings of his relationship with the musician. “From having the paparazzi follow me every single day into work to everybody having my name on their talk show every single day … It’s been a crazy, crazy ride that I could have never anticipated. But I’m having fun with it. The majority of the world is having fun with it, outside all the cranky NFL fans that just don’t want to see the Chiefs win.”

Swift herself previously cleared up that she and Kelce were already a couple by the time she went to her first game, telling TIME in her Person of the Year cover story, “We actually had a significant amount of time that no one knew, which I’m grateful for, because we got to get to know each other.”

“I think some people think that they saw our first date at that game?” she continued in the December interview. “We would never be psychotic enough to hard launch a first date.”

Since then, the 12-time Grammy winner has attended about a dozen of Kelce’s games, and fans are hopeful she’ll make it to the Super Bowl in Las Vegas Feb. 11. At the AFC Championship game Sunday (Jan. 28), Swift joined the Ohio native down on the field at M&T Bank Stadium in Maryland following the Chiefs’ 17-10 victory against the Baltimore Ravens, kissing him in front of NFL cameras.

“I love it when Taylor comes and supports me and enjoys the game with the fam and friends,” Kelce gushed to McAFee. “It’s been nothing but a wonderful year, man.”

Watch Kelce on the Pat McAfee Show below.
