Lizzo Harassment Lawsuit, Taylor Swift Deepfakes, Earth Wind & Fire Case & More Top Legal News

This is The Legal Beat, a weekly newsletter about music law from Billboard Pro, offering you a one-stop cheat sheet of big new cases, important rulings and all the fun stuff in between.

This week: A judge denies Lizzo’s request to dismiss a bombshell harassment lawsuit filed by her backup dancers; an ugly flood of Taylor Swift deepfakes highlights a growing problem; an update on Earth Wind & Fire’s trademark lawsuit against a tribute band; and much more.

THE BIG STORY: Lizzo Harassment Case Moves Forward

Two days before Lizzo showed up to present an award at the Grammys on Sunday night, a Los Angeles judge ruled that the singer’s legal problems would not be going away any time soon.

In a decision Friday, Judge Mark H. Epstein denied Lizzo’s motion to toss out a bombshell sexual harassment and discrimination lawsuit, filed by three of her former backup dancers last year. Though he dismissed certain accusations – including a particularly loaded charge that Lizzo fat-shamed one of her dancers – the judge ruled that the remainder of the case could go forward.

Lizzo argued in October that that case should be dismissed under California’s so-called anti-SLAPP statute — a special law that makes it easier to quickly end meritless lawsuits that threaten free speech, known as “strategic lawsuits against public participation.” Her attorneys said the dancers’ case was a “brazen attempt to silence defendants’ creative voices.”

As I said at the time, that argument was an unusual one. Anti-SLAPP motions are used quite frequently in defamation lawsuits that have been filed by powerful people against their critics; I can’t ever remember seeing one used by an employer who has been sued by their workers for violating labor laws.

In his decision last week, Judge Epstein largely agreed. Though he said that finding the balance – between free speech and illegal worlkplace conduct – was “no easy task,” he ultimately decided that many of the allegations against Lizzo did not fit under the anti-SLAPP law’s protections.

Go read why in our full story on the Lizzo ruling, including a detailed breakdown of the decision and access to the actual ruling issued by the judge.

Other top stories this week…

TAYLOR SWIFT DEEPFAKES – After X was flooded with fake, sexually-explicit images of Taylor Swift, I dove deep and tried to get an understanding of the legal lay of the land. Were these deepfake images illegal? Should new laws be passed to stop them? Are social media sites doing enough to stop them? Turns out, legal experts say the ugly incident is a sign of things to come, as artificial intelligence tools make deepfakes easier to create and tech companies scale back content moderation. Go read the whole story here.

‘GEORGE & TAMMY’ CASE – Showtime was hit with a lawsuit over the 2022 television series centered on country music legends George Jones and Tammy Wynette, filed by the estate of Wynette’s later husband George Richey. The lawsuit claims that the producers presented a “disparaging” portrayal of Richey that turned him into the “villain” of the show. But it’s not a defamation lawsuit…

RAP ON TRIAL? NOT IN BK – A federal judge overseeing Jam Master Jay’s murder trial in Brooklyn ruled that prosecutors could not cite rap lyrics written by the rapper’s alleged killer as evidence against him – in the process, wading into one of music law’s thorniest issues. After offering a sweeping historical overview of hip hop’s past, the judge warned that general themes of violence and crime have become “so prevalent within the genre that they have little, if any, probative value at trial.” As a result, she said they should only be admitted if they have a clear, direct connection to the facts of the case: “Music artists should be free to create without fear that their lyrics could be unfairly used against them.”

TRIBUTE TRADEMARKS – A tribute band that was sued last year by Earth, Wind & Fire for using the name “Earth Wind & Fire Legacy Reunion” won a small ruling in the ongoing trademark infringement case, allowing them to continue pursuing their eyebrow-raising counterargument: That the legendary R&B group somehow abandoned the intellectual property rights to its name.

SUBLIME MALPRACTICE SUIT – The 90s rock band filed a legal malpractice lawsuit against the prominent music law firm King Holmes Paterno & Soriano LLP, accusing its former attorneys of a “pattern of self-dealing.” Sublime’s surviving members say the firm’s lawyers – including legendary music attorneys Howard King and Peter Paterno – had undisclosed conflicts of interest on numerous matters, including brokering a merchandise deal with one of the firm’s other clients that the band claims cost it millions of dollars. When reached for comment on the allegations, King told Billboard simply: “Welcome to Fantasyland. Please enjoy the ride.”

NIRVANA’S SMILEY FACE FIGHT – A years-long legal battle over the grunge band’s famed smiley face logo could be headed for a major showdown, sparked by a former record label art designer named Robert Fisher who says he, and not Kurt Cobain, created the famed drawing.

How to Watch Online Conversation With 2024 Oscar Nominees for Best Original Song

The event is co-hosted by SHOF inductees Nile Rodgers and Paul Williams. Rodgers currently serves as SHOF chairman. Williams has been nominated three times in this category – for “Nice to Be Around” from Cinderella Liberty (1973), “Evergreen (Love Theme From A Star Is Born)” from A Star Is Born (1976) and “The Rainbow Connection” from The Muppet Movie (1979). Williams won the Oscar for “Evergreen,” which he co-wrote with Barbra Streisand.

This year’s panel features Jon Batiste, co-writer (with Dan Wilson) of “It Never Went Away” from American Symphony; Billie Eilish and Finneas, co-writers of “What Was I Made For?” from Barbie; Scott George, writer of “Wahzhazhe (A Song for My People)” from Killers of the Flower Moon; Mark Ronson and Andrew Wyatt, co-writers of “I’m Just Ken” from Barbie; and Diane Warren, writer of “The Fire Inside” from Flamin’ Hot. The nominees discuss how they got involved with the films, their influences, writing process and more.

This is the seventh consecutive year that Warren has been nominated for best original song, the longest streak of nominations in the category since Sammy Cahn was nominated eight years in a row from 1954 to 1961. Thus, she has participated in seven of the SHOF’s eight roundtables. Warren was inducted into the SHOF in 2001.

Andre Agassi Stunts In Nike Air Tech Challenge II, To Re-Release In 2024

With the success that John McEnroe’s “Mac Attack” silhouette experienced in 2023 (mostly thanks to Travis Scott), Nike is looking to retro another 90’s tennis star’s sneaker and truth be told, we’re not mad.

According to Sneaker News, sneaker legend Andre Agassi’s Nike Air Tech Challenge II is set to release sometime in 2024 and the man himself posted a picture rocking a pair of the upcoming retro. Rocking the kicks alongside his wifey, fellow tennis legend Steffi Graf, the sneaker community was excited to see that the OG sneakers would once again see the streets in 2024.

Per Sneakernews:

The Air Tech Challenge II, designed by Tinker Hatfield, is considered to be one of the greatest Nike footwear designs in history. It also helped popularize the blazing hot red shade on Swoosh footwear, adding an element of personality in a sport that once had strict on-court rules regarding attire.

Currently, a release is expected this Fall 2024 season with an MSRP of $150. It last released in 2016, so this re-issue should be met with open arms.

We personally prefer the Nike Air Tech Challenge 4 which was a bit more stylish and less bulky than the II’s, but these are pretty dope. If Travis Scott gets his hands on these and blesses them with the reverse swoosh, watch out! Heads will go crazy for those.

Check out pics of the Andre Agassi Nike Air Tech II’s below and let us know if you’ll be copping a pair when these drop sometime later this year.

Post Malone Is Your New Best Friend in Bud Light Genie Super Bowl Ad

If only it was that easy to summon Post Malone to one of your bar bashes. In a just-revealed Super Bowl LVIII ad, Bud Light has roped Posty, as well as former NFL QB Peyton Manning and UFC CEO Dana White into a funny spot slated to run in the third quarter of Sunday’s (Feb. 11) game between the Kansas City Chiefs and San Francisco 49ers.

In the 60-second video, a Broncos fan in a Manning jersey reaches for a cold bottle of Bud Light in his fridge and accidentally summons the “Bud Light Genie,” a cheeseball in a track suit who is more than happy to offer up some of his signature wishes. The trio waste their initial wishes on 80s metal hair, a desire to be “filthy rich,” another to be invisible and to have giant biceps (which turns into just one hulking arm, strangely).

Additional wishes come in the form of a sweet ride, aka a stretch Delorean limo, as well as Bud Lights for everyone in the bar and the Manning’s fan wish that the “The Sheriff” would be his best friend. Cue Manning popping up at their table in the ad cued to Steppenwolf’s 1968 classic “Magic Carpet Ride.”

Halfway through, a wish for Malone to join the party results in the bearded singer and avowed Bud Light superfan materializing with beer in hand to cheers from the late night crowd. One of the pals even shows off her custom diamond grill in a selfie in which Posty flashes his glittering fronts. The spot ends with the the one-armed bandit wishing he could be at a UFC fight, where White informs him that he will definitely need another bicep to enter the octagon.

After Manning calls for a house party, Malone raises a bottle of BL to a raucous crowd while standing on a balcony cradling an electric guitar and shouting “let’s go!!” as his wish comes true: a T-Rex crashing the party.

The silly ad is the follow-up to last year’s big game spot featuring actor Miles Teller and wife Keleigh dancing. The once world-beating Anheuser-Busch brand took a major hit in 2023 after sending a promotional can to trans influencer Dylan Mulvaney, which sparked a backlash from conservative media outlets and artists including Kid Rock, Travis Tritt and John Rich.

Justin Timberlake Scores His Highest Hot 100 Debut in Six Years With ‘Selfish’

Justin Timberlake notches his highest Billboard Hot 100 debut in six years as his new single “Selfish” debuts at No. 19 on the Feb. 10-dated chart.

Released Jan. 25, the song tallied 22.4 million in all-format radio airplay audience, 11.5 million official streams and 10,000 downloads sold in the U.S. in its first full week of activity (Jan. 26-Feb. 1), according to Luminate.

“Selfish” is taking off across multiple radio formats: It jumps 20-13 on Adult Pop Airplay and 33-17 on Pop Airplay and debuts at No. 14 on Adult Contemporary and No. 33 on Rhythmic Airplay. On the all-format Radio Songs chart, it starts at No. 33.

Timberlake’s last song to debut higher on the Hot 100 was “Say Something” featuring Chris Stapleton (No. 9, February 2018). Only three other Timberlake songs have debuted higher than “Selfish”: “Can’t Stop the Feeling!,” which launched at No. 1 in 2016; “Holy Grail,” with Jay-Z (No. 8 debut, before reaching No. 4, in 2013); and “Filthy” (No. 9 debut and peak, 2018).

“Selfish” earns Timberlake his 39th career solo entry on the Hot 100, and his 29th to reach the top 40. His first solo song to reach the chart was “Like I Love You” in 2002 (No. 11 peak). He has earned five solo No. 1s: “SexyBack” (for seven weeks in 2006); “My Love,” featuring T.I. (three, 2006); “What Goes Around…Comes Around” (one week, 2007); “Give It to Me” (by Timbaland featuring Nelly Furtado and Timberlake; two, 2007); and “Can’t Stop the Feeling!” (one, 2016).

Outside of his solo work, *NSYNC has charted 13 songs with Timberlake as a member, including the group’s recent reunion single “Better Place,” which reached No. 25 in October. The group reigned with “It’s Gonna Be Me” (two, 2000).

Last week, Timberlake hinted on The Kelly Clarkson Show that the band may be working on more new music. “We’ve been in the studio,” he said. “So there may be a little something in the future.”

Which Toby Keith Song Is Your Favorite?

Toby Keith may have passed away, but the thousands of songs he penned in his lifetime will carry on his legacy forever.

In fact, a post on the country music icon’s Instagram page just days before he died Monday (Feb. 5) notes that Keith built a catalog of more than 5,000 tracks. Thirty-nine of them were Billboard Hot 100 hits, with his seminal “Red Solo Cup” peaking the highest at No. 15, and 76 of them found a home on the Hot Country Songs chart — a ranking Keith topped a whopping 20 times in his three-decade career, with classics such as “How Do You Like Me Now?!,” “Beer For My Horses” and “My List.”

News of the seven-time Grammy nominee’s passing was shared to his official website via a statement informing fans that Keith had died “surrounded by his family.” “He fought his fight with grace and courage,” the message continued.

His death follows a two-year battle with stomach cancer. He was 62 years old.

Many of Keith’s country music peers have spent the hours after news of his death paying respects to the Oklahoma native, with Morgan Wallen writing “RIP … A Country Music and American Legend,” and Jelly Roll noting, “Toby inspired millions and I was one of them” on Instagram Stories.

“Saddle up the horses, Jesus, ‘cause a true blue COWBOY just made his ride up to heaven!!!” chimed in Carrie Underwood in an Instagram post. “Introduce him to all the Okies and sign that boy up for the choir! We’re gonna miss you, Toby, but my heart has no doubt that you are standing in the presence of our King right now!!! See you again someday, friend.”

And while there’s no way to properly honor every single one of the chart-topper’s game-changing songs, you can celebrate your favorite here. From “Should’ve Been a Cowboy” to “Red Solo Cup,” cast your vote for your favorite Toby Keith song below.

Drake Trends After The Boy Shows Off The “Boy” In Leaked Video

HipHopWired Featured Video

CLOSE

Drake has often bragged about his prowess with the ladies and even once alluded to his, ahem, situation on a popular song a few years back. Now, The Boy is trending online after an alleged leaked video featuring Drake and his other “boy” went viral online.

To be completely honest with the readers, we have no idea where the alleged video came from, if it’s truly a leak, or why the footage is out there for the world to see. In a brief drive-by of the video, viewed for editorial purposes, a person thought to be Drake is sitting on a couch while holding on to the “joystick” with a shot of the person holding a smartphone to capture the image.

Drizzy once pointed to the size of his appendage on A$AP Rocky’s hit posse cut “F*ckin’ Problems” with 2 Chainz, and Kendrick Lamar, immortalizing himself by saying, “I don’t really say this often/But this long d*ck n*gga ain’t for the long talkin’.”

If the clip that’s going around X and other online spaces truly is the OVO Honcho, it appears that some agree that Drake wasn’t lying during that particular bar. As expected, some fans are saying that the leak was done on purpose to keep some of the rumored Megan Thee Stallion smoke off him, while others are showing off some incredible thirst.

We’ve got reactions from all sides below.

Chartbreaker: BigXthaPlug Is a ‘Groovy-Ass Person’ With a Texas-Size Breakthrough Hit

It’s 30 minutes before the NBA’s Lakers and Clippers tip-off for a late January showdown at their shared home of Crypto.com Arena in Los Angeles, and rapper BigXthaPlug is sitting in a purchased box suite with his entire crew. Had he wanted, he could’ve showcased his 6’3”, 400-pound frame in personal courtside seats, but for the Dallas native, it’s a small token of appreciation for those who were with him before he could afford such luxuries. “I’m not finna see nothing for the first time without people that was there when I had nothing,” he says.

Lately, BigXthaPlug has had a lot to showcase: the rapper turned in a banner year in 2023, first with the RIAA-certified gold hit “Texas” that reps his home state, and more recently, with the braggadocious “Mmhmm.” The bass-bumping, sonically nostalgic track, which showcases his bellowing voice adlibbing the song’s title throughout the chorus, broke through on a mainstream level and debuted on the Billboard Hot 100 in December. “You gotta say it with a little more ‘Mmmhmmm,’” BigXthaPlug instructs with a deep southern drawl that sounds naturally chopped-and-screwed.

Born Xavier Landum, the 25-year-old was raised by his mother — also a Texas native — who put him onto southern rap dignitaries ranging from UGK to Lil Wayne, while his father leaned more into the R&B acts like the Isley Brothers. BigXthaPlug grew up with NFL dreams and only began rapping a few years ago, with his self-released Bacc From the Dead project in 2020. The EP drew the attention of UnitedMasters’ A&R Aaron Hunter, who then peppered the rapper with DMs before ultimately flying to Texas for an in-person introduction at a Chuck E. Cheese birthday party for the latter’s cousin.

BigXthaPlug signed a deal with the distributor in 2021, and shortly after, he added a manager in Public Figures Management Group founder Kyle Wilson, who first discovered BigXthaPlug on Instagram through his raw track “Safehouse.” (Co-manager Brandon Farmer, a partner at Solid Foundation Management, joined the team in 2023 after watching the rapper’s SXSW set.) “His stage presence, you just don’t really see that,” Farmer says. “You can tell when somebody is a star. X is a star.”

But just as the pieces of his team were coming into place, BigXthaPlug was arrested on unlawful carrying of weapons and marijuana possession charges and served a 2022 jail stint in solitary confinement. The experience was a wake-up call: instead of spending the hours in monotony, he wrote rhymes on medically issued med-line paper and read the dictionary. “I tried to read the Bible but I couldn’t do it,” he says.

He was released later that year, and by 2023, BigXthaPlug translated inspiration into action: he launched his own independent record label, 600 Entertainment, and subsequently added artists Ro$ama and Yung Hood to the roster. He joined rapper Key Glock on tour that April, where he met hip-hop producer Bandplay and immediately established a rapport. In June, the two went on a creative retreat in Arizona, and one of the first songs that came about during the two-week Airbnb stay was “Mmhmm.” Bandplay first cooked up the funky beat in 2020 after hearing The Whispers’ “And The Beat Goes On” while watching a movie. But upon initially hearing the beat in Arizona — which samples the 1979 track also prominently used in Will Smith’s 1998 single “Miami” — it didn’t register with BigXthaPlug.

“I’m a groovy-ass person,” BigXthaPlug recalls. “Bandplay was playing it and me and [songwriter Ro$ama] got to dancing. Bandplay stopped it and was like, ‘Y’all know what sample this is?’ We was like, ‘Hell nah.’” Still, within 30 minutes, the hit took form.

BigXthaPlug saw the track as an opportunity to put his friend in a position to win: in a genre where many are shy about their collaborative writing process, he asked Ro$ama to pen the song’s heavy-flexing opening verse. “I had already wrote a verse — the second is my verse,” BigXthaPlug says. “I [told him], ‘Write a verse, and if it’s good, you could get points and get paid.’ A lot of these rappers are using writers. Even if you don’t end up the biggest artist in the world, you might be the biggest writer. It made me bring the energy.”

After finishing the track, BigXthaPlug headed to nightclubs across the country to crystallize his instincts that he had a mainstream hit on his hands. “I’ll go to the club every day of the week to make sure my songs are getting played,” he says. As an unreleased version of “Mmhmm” began to dominate club venues, UnitedMasters had him pump the brakes for the rest of the summer to make sure the licensing rights were in order. But as BigXthaPlug says, he “doesn’t mind paying that bag to get sh-t cleared,” and upon getting the green light, he officially released “Mmhmm” to streaming services through UnitedMasters last October.

Two months later, he released EP The Biggest, which included a remix of the song featuring fellow Texan Finesse2Tymes. By mid-December, amid the influx of holiday songs on the all-genre chart, “Mmhmm” debuted on the Hot 100 where it has since reached a No. 65 high and compiled 75.5 million total on-demand official U.S. streams through Jan. 25, according to Luminate — and importantly, served as a means of validation for the rapper. “I always like to have reassurance,” BigXthaPlug admits. “Sometimes I catch myself like, ‘Why are you still rapping? You know you not a rapper.’ Then you get a Billboard [Hot 100 entry].”

The song’s success propelled “Texas” and featured turn on NLE Choppa’s “Pistol Paccin” onto Hot R&B/Hip-Hop Songs, and as the rapper turns the page to 2024, he isn’t resting on his laurels. He will release a collaborative EP with 600 Entertainment artists and follow it with a solo album. He also says he has a collaboration with Rod Wave, and that Megan Thee Stallion recently reached out, too.

It’s all humbling for BigXthaPlug, who’s still getting accustomed to the buzz — but teases everything will get bigger, and better, this year. He’s a Texan, after all. “I didn’t even want to make [‘Texas’],” he reflects. “If I can do this when I didn’t wanna do it, what the f–k could I do when I want to do it?”

A version of this story will appear in the Feb. 10, 2024, issue of Billboard.
