Marsha Ambrosius Talks New Album ‘Casablanco’: ‘An Avalanche of Music’

Ambrosius’ subsequent solo career has also been fruitful with fan faves like “Far Away,” “Run,” “Hope She Cheats on You (With a Basketball Player)” and “Late Nights & Early Mornings” plus two hit albums: 2011’s Late Nights & Early Mornings and 2014’s Friends & Lovers. Skillfully flexing her pen as a songwriter, she co-wrote Michael Jackson’s 2001 R&B/pop hit “Butterflies” and has also created songs for Alicia Keys, Solange and H.E.R., among others.

Now the nine-time Grammy nominee is back on the scene with her first new studio album since 2018’s Nyla. Released through Aftermath/Interscope, the 11-track Casablanco (available June 28; listen here) was executive produced by Dr. Dre and features creative collaborations with Focus…, Erik “Blu2th” Griggs, Dem Jointz, Phonix and DJ Khalil.

“I didn’t realize how much time has passed until it was staring me in the face,” Ambrosius with her English-lilting laugh, muses to Billboard. “My daughter Nyla is 7 years old now. In the time that’s passed, it’s just been about life and love with me now as a wife and mother.”

Together, the Las Vegas-based singer-songwriter and Dr. Dre have crafted an album that’s both retro and futuristic, drawing from various musical influencers (including her “holy trinity: Stevie Wonder, Prince and Michael Jackson) and styles. The end result — as teased by the singles “The Greatest,” “One Night Stand” and the latest “Greedy” — is a luxuriant sound bath of intriguing tempo changes and orchestral movements capped by Ambrosius’ still scintillating vocals.

“This project was so specific,” Ambrosius says. “And there are so many other gems on here that I don’t want to spoil it because you have to listen to again and again. Every single track is like an Easter egg with gems inside.”

How did the seeds get planted to record an album with Dr. Dre?

From 2005 we’ve worked on different projects together, including 2015’s Compton album. And in getting that phone call from him to work together on that project, we started interacting again in 2020. Then at the beginning of that year, he suffered a brain aneurysm. However, when he was back at home in recovery, he says to me, “I want to get you out to Los Angeles as soon as possible and get back to work. I just want to be inspired again and get creative.” Whilst, I was also going through my own healing journey having gone through my own health scare that I’m thankfully on the other side of. So music became our target and our goal.

What inspired the album title?

The title came by way of the very first song created for the album, “Tunisian Nights.” It was in that moment that we knew what the album was going to be. I’d told Dr. Dre [at one point] that I just wanted to produce and write. I figured I’d done my albums, I’d done the whole artist thing. But once we got this very specific thing that we were going to do, it felt like Casablanca the movie. It was giving vintage Hollywood. It also felt like a serene place, a destination we’d been  transported away to through this music. Then Dre suggested that instead of Casablanca, how about we call it Casablanco so it’s a bit more gangster. And it just made beautiful, mad, mayhem sense by the time we really got into the thick of things with the album.

The press materials note that the project began as a jazz album but morphed into a “genre-bending tour de force.” 

So initially because of the time frame that it was created in, there was almost a desperation in wanting to make what we would deem our masterpieces. We both collectively and individually had done some great things in the music space. But we hadn’t done this. So with the intentions to do something that — if we’re in a pandemic and it’s apocalyptic and so chaotic out in the world — what would be that last album if we had to make a musical impression on what we did while we were here? And that’s what Casablanco became: all of those things that we were going through; every emotion put into one particular space. Casablanco became the genre in itself. Yes, it’s jazz but also R&B, hip-hop, funk, soul, rock … all these things in one album. And we’re absolutely proud of it.

What’s one of your favorite memories of recording this album?

There are too many. But I remember the mood of everyone in the room when we created “Tunisian Nights.” No pun intended but it’s the butterflies you get when you know you’re onto something. Once that piano started … It’s a very haunting intro melodically and lyrically that sets you up for a Charlie Parker moment. Then it goes into a Nas-driven beat that takes you to a Mary J. Blige moment. That’s the only way I can describe it without giving away too many spoilers. I just know that through the madness, it absolutely works. It was like there was divine intervention allowing each person in the room to do what they were supposed to do to make it what it is. I’ve felt that several times over the course of my career. However, it’s rare. I love creating music. I love getting in the studio. I love writing a song or melody. But when they’re great and they’re timeless, it’s a feeling that you can barely describe. God says, “This is yours. Do with it what you will.” And you really have no choice in the matter. You’ve just got to follow your orders.

How would you describe the way that you and Dr. Dre clicked creatively on this album?

What makes it special was the admiration for each other’s work. And it’s the creative freedom that we allowed each other and the boundaries that we were willing to push because we could. He believed in my ability to meet a challenge, and I entrusted him to do the same. It was a musical insane asylum full of musicians who understood the assignment. It wasn’t about conforming to the normality of a conventional piece: this is the tempo, put a verse here then a hook, a bridge and so on. It was, what is the feeling?  How can we elevate this each and every time? There were no boundaries. Yes, it might be a ballad, but I might drop this beat in the same key, and it’s going to make it all make sense.

Beyond having fun experimenting musically, it sounds like you did the same vocally given the various intonations and higher registers you’re hitting.

Wow, thank you. I definitely became who I had to become for each moment. It was like, it wasn’t me singing. I was using my voice to sound like what the moment should sound like, not necessarily me. To sing it like you’re supposed to feel. Yeah, I did some things on this album I’ve never done before. And I’m inspired all over again because of it [laughs].

What’s one example of something you’d never done before?

The song “Wet” [which samples the Dramatics’ “In the Rain”]. When I wrote the verse, I sang the melody as a trumpet solo first. Once I had the melody in my head, then the lyrics just started to happen … happening like I could hear the melody and the lyrics at the same time as if they were the horns. As if it were the undertones of all the instrumentation in one but creating it with a vocal. I do that anyway, but not like this. This was like everything I ever wanted to do vocally.

Some of the tracks are longer than four minutes, even running into five. Was that intentional?

We wanted to get lost in the music. The album starts with “Smoke,” which sets the tone and pace. From “Smoke” on out it’s like an avalanche of music. We’re going to take you from A to Z — and it’s not going to be in a straight line at all. The entire album just takes you on a roller coaster ride. From the usage of George Benson’s “This Masquerade,” masquerade; some Patrice Rushen implemented into “One Night Stand.” It just made sense in the moment. To say it was intentional will kind of be unfair and wouldn’t speak to the actual genius that was in the room. It was like the biggest, best DJ session that you could have in a room. That was the hip-hop in us; very much an MC battle. It was a challenge, and we met the challenge each and every time.

Above all, it sounds like Casablanco was a decidedly fun project for you and Dr. Dre.

It was a party every night. And I’m better for it. This is the most challenging thing I’ve ever done in the music space in my career. And I’m sure Dre would tell you the same. This is something that he’s also never done. I’m glad that we’re able to share this particular piece of art. It was a labor of love. Now I’m just thankful that everyone now gets to hear what it is that we’ve been doing all this time.

“It’s 7 p.m. Friday/ It’s 95 degrees/ I ain’t got no n—- and no n—- ain’t got me,” RiRi, wearing a black shirt and beige leggings, raps while A$AP watches with his hands on his hips.

As Ri gets deeper into the cut, the Harlem rapper — donning a sharp gray suit with a white button-down shirt and AWGE tie — declares that he’s had enough of the hilarious spectacle and walks off.

“Where my drink at?” Flacko is heard saying as he flashes a grin and strolls off camera. “I’m too old for this s—.”

Rihanna captioned the post, “happy friday.”

It didn’t take long for GloRilla to catch wind of the video. The rapper was clearly thrilled, reposting the clip on her X (formerly Twitter) account.

“RIRIIIII AHHHHHHH??????????????I can’t breathe,” she wrote alongside the visual. In a follow-up post, she added, “Yall don’t even kno I loud I f—ing screamed !!!!!”

Earlier in the month, Rihanna gave an update on where she stands with new music after being spotted wearing a shirt with the words “I’m Retired.”

“That was just me looking into the future. I’m not retired. I just like that dress. I got it as a gift and I loved it,” the nine-time Grammy winner told Extra. “They didn’t read the second line, I’m not retired, I’m just retired from dressing up — it’s a lot of effort.”

The beauty mogul also revealed that she’s starting over with her elusive R9 album, and she’s “prepared” to get back in the studio with her newfound perspective.

“Yeah, I’m starting over,” RiRi told Entertainment Tonight. “But I don’t want to neglect the songs that I have, so I actually want to go back and listen to stuff with new ears, with my new perspective and then see what applies and what I’m still in love with.”

She continued, “I think that music, for me, is a new discovery. I’m rediscovering things. I have been working on the album for so long that I kinda put all that stuff aside and now I’m prepared to go back in the studio. I’m gonna start — give me a second!”

Rihanna’s last album, Anti, turned 8 years old in January after arriving in 2016. The project reached No. 1 on the Billboard 200 in its second week on the chart, with 166,000 units earned in the U.S. in the week ending Feb. 4, 2016, according to Nielsen Music.

Taylor Swift Sports Irish Flag Colors, Performs New Surprise Song Mashups at First Night in Dublin

Taylor Swift is showing her Irish pride in Dublin.

On Friday (June 28), the 34-year-old pop superstar rocked a sparkly outfit with the country’s flag colors during the opening concert of her Eras Tour stop at the city’s Aviva Stadium.

While delivering the 1989 segment of her set, Swift rocked a shimmery jewel-encrusted orange crop top with a matching green skirt. The section featured popular songs from the 2014 album, including Billboard Hot 100 hits “Blank Space,” “Shake It Off” and “Bad Blood.”

Friday’s concert also found the “Anti-Hero” singer performing two fresh mashups during the surprise songs portion of the set.

For her first surprise track of the evening, Swift performed a mashup of “State of Grace,” from her 2012 Red album, and “You’re On Your Own, Kid,” from Midnights in 2022. This marked the first time the songstress has played “You’re On Your Own, Kid” on the acoustic guitar.

For her second surprise song, Swift delivered a medley of Midnights‘ “Sweet Nothing” and “Hoax” off Folklore. The latter was her first performance of the 2020 track on the Eras Tour.

Elsewhere during the show, Swift also paid tribute to her boyfriend Travis Kelce by reenacting the Kansas City Chiefs tight end’s signature archer pose while performing “Midnight Rain,” from her 2022 Midnights album.

Ahead of her three-night stint in Ireland, Swift got some love from the country’s most famous rockers. On Friday, she shared on her Instagram Stories a photo of the flowers and a sweet note that she received from iconic rock band U2.

Alongside a bouquet of white, pink and purple roses and lilies was a card that read, “Dear Taylor, welcome back to our hometown…leave some of it standing?!!!!” The note was signed, “Your Irish fan club, Bono, Edge, Adam and Larry.”

On her Instagram Stories, Swift responded by captioning her post with “Already feeling that Irish hospitality!! @u2, thanks for always being the classiest & coolest.” Swift also included an Irish flag emoji.

The superstar singer’s Eras Tour is set for three shows at Aviva Stadium from June 28-30. Paramore is the special guest for all three concerts.

Teyana Taylor Accepts Innovator of the Year at 8th Annual Culture Creators Awards Brunch in L.A.

Teyana Taylor, BET’s Connie Orlando and more were honored at the eighth annual Culture Creators Innovators & Leaders Awards Brunch on Friday (June 28) at the Beverly Hilton Hotel in Beverly Hills, Calif.

Hosted by journalist Gia Peppers, the exclusive fête brought industry icons, influencers and thought leaders together to pay tribute to extraordinary individuals who have left an indelible mark on Black culture across various sectors, including technology, business, sports, fashion, music and more.

It also benefitted The Culture Creators Foundation, a non-profit that is dedicated to bridging the gap between high school and college as well as college to graduation for underrepresented students in industries lacking diversity. The foundation empowers these students to thrive academically and professionally by providing resources, curriculum supplementation and membership. Funds raised during the brunch will support the 2024 Academic School Year Scholarship Program for the Campus Changemakers, the foundation’s inaugural cohort of students across 35 colleges and universities.

Taylor was honored as Innovator of the Year with a celebratory video montage that highlighted her incredible career in entertainment, from choreographing Beyoncé‘s “Ring the Alarm” music video and signing to Pharrell Williams‘ Star Trak Entertainment when she was only 16 years old (when the world also watched her epic birthday bash on MTV’s My Super Sweet 16) to later signing to Ye‘s GOOD Music when she was 21. We’ve Googled her, we’ve celebrated her Sweet 16, we’ve watched her be our favorite baby mama next door, we’ve watched her slay rap battles (some of y’all remember that?), we’re watched her conquer choreography that would even make Janet Jackson blush,” said Emmy-winning screenwriter, producer and actress Lena Waithe while she was presenting the award to Taylor.

“She’s given us timeless music videos, unforgettable performances like the one she beautifully delivers in A Thousand And One. I’ve gotten a front row seat to her journey in becoming a serious actress. I’ve watched her break down both in front of and behind the camera. She let us watch her tears fall so others wouldn’t be afraid to cry.”

Taylor held back tears as she began her acceptance speech, which took the form of a prayer.

“Heavenly Father God, I thank you for who you are. All-seeing, all-knowing and all-powerful. Let me tell you something about your favor. Father God, your favor cannot be stopped, you hear me? I know you’re hear me, so let your daughter cook. Let me cook. Lord, you told me in John 8:12 that you are the light of the world and if I followed you, I wouldn’t have to walk in darkness because you would have the light that leads to life,” she said.

“Thank you for wiping away every tear away when I thought the weight was punishment, ’cause you’ve made it very clear now that it was just preparation. Thank you for never letting my crown fall because you keep my head high. Thank you for teaching me the power of grace as I walk in it.”

She thanked her 8-year-old daughter Junie, who stood on stage beside her, for her “protection” and “being so pure. Thank you for loving me the way that you do. Thank you for teaching me how to be fearless,” Taylor said. And to her 3-year-old daughter Rue, “she knocked out in the green room,” Taylor revealed, which was met with roaring laughter. “I love you too, girl! …. One thing Rue gon’ do is never make it to the table, you hear me. My girl be knocked out like she work five jobs.”

After thanking her parents, her longtime friend and The Aunties production company co-founder Coco Gilbert, “Auntie” Natina Nimene, executive vp of promotion and artist relations at Def Jam and the rest of her team, Taylor returned to her prayer.

“I want to thank you for having me in this room full of amazing, talented innovators and leaders. Thank you for using me as an affirmation to everybody and every hardworking person in this room today that we are here because we belong here in this moment, it was already written in the palm of your hand…. And thank you for telling us ‘yes’ when naysayers told us ‘no.’ In Jesus’ name, Amen.” But right before she left the stage, Junie took the microphone for a precious scene-stealing moment. “And I love my mom! I love my mom!” she exclaimed.

Former BET Networks CEO/chairman Debra Lee presented presented an award to her former colleague Orlando, BET’s EVP specials, music programming & music strategy.

“I don’t think anyone in this room would disagree with the statement that everybody loves Connie,” said Lee, who collected proof in the form of a four-page document filled with responses from Orlando’s friends and business contacts about why everyone loves her. “Jesse Collins, her producing partner on many BET specials, says, ‘Words that describe Connie: integrity, her word is her bond; patience, in a world of folks seeking instant gratification with very little effort, she stands out as someone who puts in the work in order to make sure whatever she is working on is perfect; style, just look at her; love, Connie is love. Her heart is always open for anyone that needs it. And that is probably her greatest talent because, please know, she is not to be taken lightly or toyed with and will gladly let you see the girl from Queens if she has to. But after she pops out and shows you, she will always send you on your way with a hug and a smile. And you gotta give her credit for the BET Awards and all the moments she creates.’”

After Lee continued singing her praises, Orlando took the stage and choked back tears while crediting Lee as the reason why she was there in the first place.

“I’m honored to accept this year’s Culture Creator Award and to receive your generous recognition of my contributions to the world of television and film. I stand before you filled with so much gratitude. It is a blessing to do the work that I love,” she said while addressing Culture Creators founder Joi Brown and the Culture Creators Advisory Council. “Working in the mediums of television and film, I am keenly aware of how much time the average person spends watching the screen of some kind, at any given moment. With billions of people consuming content everyday, there lies a unique opportunity to foster meaningful discussions, to create pathways of understanding, to uplift and to educate countless numbers of viewers. Though entertainment is at the core of what we do, we can use the power of media to speak life into our audiences, to tell authentic stories and ignite a light in the darkness that exists in our world today.”

After burgeoning singer Jordan Ward brought the R&B vibes to open up the nearly six-hour long marathon, Sexxy Red cranked the intensity with a category-five caliber performance. Though he spoon-fed songs like “whatsapp” and “prada dem,” he shifted into the deep cuts, tapping Leon Bridges to join him for a performance of “clear my rain.” Gunna didn’t stop there, as he tagged in IDK for their new collaboration, “TiFFANY,” before delving back into his vintage hits. He satiated the hunger pangs of his day-one supporters, revisiting songs like “Dollaz on My Head” and “Top Off.” He also peppered his set with songs for the ladies, rapping “Banking on Me” and “P Power,” to much of their delight.

As he commanded the crowd, Gunna leaned on his cheat code to seal the deal. “Drip Too Hard,” “Pushin P,” and the YSL heater “Hot” sans Young Thug perked everyone’s ears and revved up Gunna as he pressed the right buttons during those prime moments. To punctuate his performance, Gunna wrapped things up with his newly-minted classic, “fukumean,” before setting the stage for the night’s final performer, Cardi B.

Appearing at nearly midnight, Cardi brought a laundry bag of hits and humor to the L.A. crowd. Donning a custom-made football jersey emblazoned with the No. 11, the Bronx bombshell used Friday night’s performance to show us what a potential Cardi Tour would like. The “Cardi Party” was fun. Her signature wit and grit shined through as she sprinted with avidity through her 2018 opus, Invasion of Privacy. Though the project remains her lone gold star on the album front, it still holds, as proven by the roars on songs like “Get Up 10” and “Bartier Cardi.”

Though Cardi’s headlining set was under 40 minutes, she applied pressure once she wrangled in her features. Arguably one of the best feature artists of all time, Cardi went inside a time chamber and revisited verses from G-Eazy’s “No Limit,” Blueface’s “Thotiana,” GloRilla’s “Tomorrow 2” and more. And when Cardi wasn’t enjoying her hellacious features run, she ran up the scoreboard with her solo hits with “I Like It,” “Up,” and the steamy “WAP,” which found her spilling water on herself. Though she joked about being winded and needing a quick breather, she pushed through and stamped her New York swagger on the West Coast by closing out her set with “Bodak Yellow.”

Yandel Returns to the Roots

Yandel has returned to his beginnings by going full barber mode in the streets of Spain. Currently touring the European country with his Yandel 2024 Tour, the Puerto Rican artist surprised fans in the Gran Via (a street in central Madrid) by offering free haircuts. The sweet gesture took Yandel back to his roots, when he was first a barber in Puerto Rico before kicking off his singing career as part of the reggaetón duo Wisin y Yandel. Watch the clip here.

Master Chris Introduces La Nueva Cepa

Last year, the Premios Heat brand unveiled its new franchise called “La Nueva Cepa,” an initiative in partnership with Warner Music Latina and hitmaker Master Chris to help promote newcomers making a name for themselves in their countries. This week, all of those talented and aspiring acts can be heard in La Nueva Cepa debut album produced by Master Chris. The 12-track set includes songs such as “Te Lo Mereces” by Dayanara, “Caducaste” by Andreina Bravo,” and “Dije Que No” by Scarlet Evang—all Premios Heat darlings. 

“It’s an idea we’ve been around for a long time and basically celebrates Master Chris’ 25 years as a music producer,” Heat founder Diana Montes previously said to Billboard. “Instead of making a record with artists he has produced like Alexis y Fido, Greeicy, and J Balvin, he wanted to follow the Heat Awards philosophy and discover the talent that exists in Latin America. We are not a record label but on our platform, we have developed many talents. Latinos at the MLB All-Star Game

This week, the MLB unveiled the first lineup for its 2024 All-Star Celebrity Softball Game. Confirmed for the single-day event taking place July 13 are a wave of music stars such as Eladio Carrion, Myke Towers, Grupo Frontera’s Payo Solis and Julian Peña Jr., and Kane Brown. They will be joining the confirmed actors Gina Rodriguez and Marcello Hernández, among other celebrities. Presented by Corona, this year’s All-Star Celebrity Softball Game will be held July 13 at the Globe Life Field in Texas. Tickets and more information is available at allstargame.com

Natalia Jiménez Makes a Dream Come True

During her concert in Venezuela, Natalia Jiménez shared a sweet moment on stage with a fan named Maria Gabriela Silva, who’s also an aspiring artist known locally as “The Venezuelan Ranchera Queen.” In a video posted on social media, Jiménez is seen calling Silva on stage to sing together. The two ladies then crooned audience members with a powerful and improvised rendition of Luis Miguel’s “Si Nos Dejan.” 

“I dreamt of this moment for 15 years, to sing with the artist that has inspired me for many years…my idol,” Silva expressed on her Instagram account. “The wait was worth it. It was worth the effort and dreaming with faith in my God. Natalia is just as I imagined her, in addition to being a unique artist, she is a wonderful person, with a human quality, simplicity and humility that surpasses . Celine Dion Announces Montreal Canadiens’ First-Round Pick at 2024 NHL Draft: ‘Like a Movie’

Being selected in the first round of the NHL Draft is a once-in-a-lifetime moment. Being announced by one of the most talented singers of all time is one in a million.

At the 2024 NHL Draft on Friday night (June 28), the Canadiens welcomed Celine Dion to the stage — described by Montreal general manager Kent Hughes as “our No. 1 fan” — to announce the night’s fifth overall draft pick.

Dion was accompanied to the stage inside Las Vegas’ Sphere by her 23-year-old son René-Charles Dion Angélil, who is also a singer and goes by RC Angélil. After a bilingual greeting toggling between French and English, Dion got down to business. “With the fifth overall selection in the 2024 NHL Draft, the Montreal Canadiens are proud to select Ivan Demidov.”

Thanks to Dion’s tense pause ahead of saying the 18-year-old Russian hockey player’s name, the NHL announcers called it “the most dramatic draft announcement of all time.” (The announcers also suggested that “Montreal is saying ‘merci’ to the Anaheim Ducks for not picking him,” after the California club had shown interest in choosing Demidov third overall.)

In his post-draft press conference. reporters asked Demidov what it was like to have Dion announce his name. “It’s unbelievable. It’s like a book. Like a movie. It’s… me,” he laughed.

The reporters suggested he might be too young to know Dion’s music, but the Russian teen assured them, “No, I know. I watched the Titanic.” Dion, of course, performed “My Heart Will Go On,” the theme song from the 1997 James Cameron epic Titanic, which spent two weeks atop the Billboard Hot 100.

Dion was born about 15 miles outside Montreal in Charlemagne, Quebec, and has been a vocal fan of the Canadiens for years. She has also called Las Vegas home for the past two decades, mounting a pair of residencies at Caesars Palace spanning 16 years.

The NHL Draft appearance comes just a few days after Prime Video released the new documentary I Am: Celine Dion, which chronicles Dion’s health battle with Stiff Person Syndrome, a rare autoimmune neurological disorder.

To wrap up Black History Month, we’re highlighting prominent Black artists in Country who have made history and broken barriers. The artists include: Beyoncé, Shaboozey, The War and Treaty and more!

Country music continues to soar on the Billboard charts, and to celebrate Black Music Month, Billboard is highlighting five Black country artists that broke barriers and made history. Shaboozey made history when he replaced Beyoncé atop the Billboard Hot Country Songs chart with his hit, “A Bar Song (Tipsy).” It helped him earn his third Hot 100 entry alongside his two collaborations, “SPAGHETTII” and “SWEET ★ HONEY ★ BUCKIIN’” from Bey’s album ‘Cowboy Carter.’ Shaboozey’s star is rising fast. He released his third album, ‘Where I’ve Been, Isn’t Where I’m Going,’ and “Tipsy” has been going strong on the Hot 100 for 10 weeks. We can’t wait to hear more Shaboozey.

The War and Treaty have made a name for themselves in the country music world. They became the first Black duo to be nominated for the ACM Award for duo of the year last year. And they were nominated for best new artist at this year’s Grammys. Billboard honored them at this year’s Country Power Players event as Groundbreakers, and the couple just released their latest single, “Called You By Your Name,” two weeks ago. Mickey Guyton became the first Black woman to be nominated for best country solo performance in 2020 at the Grammys for her song “Black Like Me.” Guyton also became the first Black female artist to perform at the Academy of Country Music Awards, and the first Black woman to co-host the Academy of Country Music Awards in 2021.

Judge in Live Nation Antitrust Case Indicates Possible Start Date for Blockbuster Trial

The federal judge presiding over the Department of Justice’s sweeping antitrust case against Live Nation thinks the trial can begin as early as March 2026, according to recent federal court filings.

Judge Arun Subramanian explained Thursday (June 27) in the case’s first pre-trial hearing that he hoped jury selection could begin that month, although he stopped short of setting a firm date.

One of the first items of business for Subramanian, who was appointed to the federal bench by President Joe Biden in 2023, is to rule on a planned motion by Live Nation to move the case from the Southern District of New York to the federal circuit court in Washington, D.C., where Live Nation’s 2010 merger with Ticketmaster was first approved. Subramanian said he believed his court could properly preside over the case but that he would fully consider the advisement.

Prior to being appointed to the federal bench, Subramanian was a partner at litigation firm Susman Godfrey LLP, which currently represents Live Nation in the 2021 Astroworld festival class action lawsuit. Subramanian did not work on that case.

Government attorneys said in a Tuesday (July 25) filing that they plan to bring additional claims against Live Nation, noting the new claims could include information that attorneys from Live Nation have designated as highly confidential and might ask the courts to seal.

Attorneys for the government “do not believe any of the information at issue merits sealing or overcomes the presumption of public access to judicial documents,” the filings explain, noting that if Live Nation doesn’t budge, the government will ask the judge to rule on the matter.

Department of Justice (DOJ) lawyers also complained that Live Nation attorneys have delayed discovery requests and failed to “fully comply with any of the United States’s three pre-complaint civil investigative demands” dating back to October 2022.

“It took Defendants nearly a year to start producing custodial documents,” the filing reads, noting that “their responses to many specifications remain incomplete today.”

Lawyers for Live Nation called the government’s discovery allegation false, noting that “since October 2022, Defendants have spent over 200,000 attorney hours reviewing documents, produced over 600,000 documents from nearly 70 custodians, produced over 33 million observations of data, submitted dozens of written responses, and provided investigative deposition testimony from three high-level executives in response to Plaintiffs’ investigations. In addition, DOJ has access to nearly two million documents that Defendants produced during prior investigations.”

Attorneys for Live Nation added that they want “any documents, data or testimony Plaintiffs received from third parties during their investigation” no later than July 22, 2024.

Live Nation is also challenging the government’s unusual request for a jury trial instead of having the verdict determined by a judge. “If it occurred, it would be the first jury trial ever in a government-brought monopolization case,” the company’s attorneys wrote.

Outside of Live Nation, the government also says it plans to issue more than 100 third-party subpoenas to “ticketers, promoters, ticket brokers, venues, venue management companies, artists, and artists’ agents and managers.”

Live Nation declined to comment for this story.

Live Nation is being represented by longtime attorney and litigator Timothy L. O’Mara and Alfred C. Pfeiffer, both partners at Latham and Watkins. Pfeiffer is the former co-chair of the firm’s Antitrust & Competition Practice. Ticketmaster is represented by David R. Marriott with Cravath, who successfully represented Illumina against the Federal Trade Commission and secured a 2022 victory for the Louis Dreyfus Company against DOJ efforts to block the sale of Imperial Sugar to U.S. Sugar.

The government is represented by Bonny Sweeney, who joined the DOJ in 2022. Sweeney formerly served as a partner at San Francisco firm Hausfeld where she was co-chair of its U.S. antitrust practice group. In 2023, she was named antitrust lawyer of the year by the California Lawyers Association.
