Judge Dismisses One of Marilyn Manson’s Sexual Abuse Lawsuits

A federal judge has tossed out a sexual abuse lawsuit filed against Marilyn Manson by model Ashley Morgan Smithline, citing the fact that she failed to retain a new lawyer after splitting with her old legal team last fall.

Smithline’s lawsuit, one of many claims of sexual abuse filed against Manson (real name Brian Warner) over the past two years, alleged that the rocker raped and abused her multiple times between 2010 and 2013. But in an order issued Tuesday (Jan. 3), Judge Fernando L. Aenlle-Rocha dismissed the case.

The reason? After Smithline split with her attorney Jay D. Ellwanger in October, the judge gave her until Dec. 5 to find a new lawyer — or to explain how she’d handle the case on her own as a so-called pro se litigant. She never did either, leading to Tuesday’s decision.

“Plaintiff has not filed a response as of the date of this order,” the judge wrote. “The court, therefore, dismisses this action … for plaintiffs failure to prosecute the action.”

The case was dismissed “without prejudice” — meaning Smithline could still refile the same claims at some point in the future. She could not immediately be located for comment; Ellwanger did not return a request for comment.

In a statement to Billboard, Manson’s attorney Howard King praised the outcome: “We thank and commend Ashley Smithline for dismissing her claims against Brian Warner without seeking or receiving anything in return. Ms. Smithline has refused to be manipulated by others who are trying to pursue their own agendas against Mr. Warner. We wish her well and will continue to work to assure  that a significant price will be paid by those who have tried to abuse our legal system.”

Manson has faced multiple accusations of wrongdoing over the past two years.

Evan Rachel Wood, who began publicly dating Manson in 2007 when she was 19 and he was 39, accused him in a February 2021 Instagram post of “grooming me when I was a teenager” before he “horrifically abused me for years.” Those allegations were followed by separate lawsuits from Smithline, former assistant Ashley Walters, Game of Thrones actress Esme Bianco and a Jane Doe accuser.

In her lawsuit, Smithline made graphic and disturbing allegations of sexual assault against Manson. She alleged that she and Manson began a consensual relationship in 2010, but that it “quickly became apparent that consensual sex was not enough for Mr. Warner.”

“Ms. Smithline awoke from unconsciousness with her ankles and wrists tied together behind her back and Mr. Warner sexually penetrating her,” Smithline’s lawyers wrote in the lawsuit. “Ms. Smithline told Mr. Warner to stop and said no multiple times, and Mr. Warner told her to ‘shut the fuck up’ and ‘be quiet.’”

Manson has denied all of the allegations against him and even filed his own defamation lawsuit accusing Wood and another woman of orchestrating the many legal attacks against him. In the March 2022 complaint, he said Wood’s own “malicious falsehood” was part of an “organized attack” aimed at derailing his career, in which she had “secretly recruited, coordinated, and pressured prospective accusers to emerge simultaneously.” Wood denies those allegations.

YSL Rapper Lil Keed Cause of Death Revealed

Following his death in May at age 24, YSL rapper Lil Keed’s cause of death was revealed to have stemmed from eosinophilia, according to the Los Angeles County Medical Examiner-Coroner.

Eosinophilia is a rare condition in which the number of eosinophils — a type of white blood cell — is greatly increased, according to cancer.gov. TMZ reported that Lil Keed complained to friends about stomach pains in the days preceding his death. He was eventually hospitalized one evening due to the severe pain, with reports that his liver and kidney began to fail, suffering a seizure on his way to the hospital. Hours later, the budding rapper died.

“He had been sick in bed for 4 days with complaints of stomach and back pains,” the coroner’s report reads, per People. “His brother noted that the decedent’s eyes were jaundiced and drove him to the hospital in a private vehicle.”

The Atlanta-born rapper was one of seven children and brother to fellow rapper LilGotit, who took to Instagram following Keed’s death in the spring. “Can’t believe I seened u die today bro I did all my cries I know what u want me to do and that’s go hard for Mama Daddy Our Brothers Naychur and Whiteboy,” Gotit wrote in a post alongside a photo of the siblings.

Keed’s family has yet to comment publicly on the reported cause of death.

Keed signed to Young Thug’s YSL, an imprint of 300 Entertainment, in 2018. The rapper released two projects on the label, including his song “Nameless,” which peaked at No. 42 on Billboard‘s R&B/Hip-Hop Airplay chart. Keed’s critically acclaimed 2019 debut album Long Live Mexico peaked at No. 26 on the Billboard 200. He was also featured on Young Thug’s Slime Language 2 album, which topped the Billboard 200 in 2021.

May 2022 was a tragic month for the YSL crew, with the arrests of Young Thug and rapper Gunna coming just days before Keed’s death. Keed himself was not among those named in the indictment.

Alba ‘Albita’ Egan, Beloved Grand Dame of Latin Music PR, Dies at 69

Alba Egan, the genial public and talent relations executive who was instrumental in boosting the careers of Chayanne, Ricky Martin and Juan Gabriel, among many others, has died after a long struggle with kidney disease. Egan passed away at her Miami home on Sunday evening (Jan. 1).  She was 69.

A no-nonsense but cheerful woman, Egan — widely known as Albita — was easily identifiable by her signature bright red hair (which would later turn gray) as she helped some of Latin music’s biggest stars navigate the media. As one of the first women to head press and publicity divisions at major labels, Egan worked at BMG Latin, Sony Discos and EMI Latin in Miami, coordinating campaigns for artists ranging from Ricardo Montaner to Shakira. Egan, who was born in Cuba and immigrated to the U.S. as a child, at one point managed the career of beloved Mexican icon Gabriel, with whom she remained close until his death in 2016.

Many of Latin music’s most prominent publicists credit Egan with having opened major doors for them in their profession.

“She was one of the most beloved people in the music industry,” says publicist Marlene Maseda, founder and COO of Fusion 4 Media. “She was a pioneer who, with her originality and creativity, climbed to the peak of her profession in every label she worked with […] As a professional, she was one of the few who always helped others and who was genuinely happy for others’ success.”

Egan’s Facebook page was flooded with homage posts and anecdotes from people from all walks of the industry.

“She was a mentor to me and it surprised me to see that she was a mentor to so many,” wrote Nevarez Communications founder Mayna Nevarez, whose client list includes Daddy Yankee, recalling that Egan would often call to give her pointers after seeing her clients in the media.

“You always had the perfect word of advice, and sometimes, the perfect word to calm one down. I take your advice very deeply with me,” wrote Nini Veras, who reps Nicky Jam, among others.

“Elegant,” “generous,” “respect” and “loyalty” are the words that recur again and again in the many posts on Egan’s page.

“You were an icon in the music industry loved and respected by many…You always had a way with words and were giving out constant encouragement and kind compliments to your friends,” wrote Angela Rodríguez, founder of AR Entertainment.

Egan’s last job in the industry was as a talent booker at TV network America TV, closing an extraordinary professional arc that began in the 1980s and that covered multiple generations of artists and executives.

“We met in this amazing music industry world at the end of the 1980s, and since then, we were colleagues and competition, but always friends,” wrote Alvaro Rizo, the former president of EMI Colombia. “You only ever spoke sweet words and generous comments, and always, that broad smile.”

Egan’s funeral arrangements will be announced in the coming days.

One Direction Fans Are Calling Out a Mistake in Netflix’s ‘Kaleidoscope’

Eagle-eyed One Direction fans noticed a boy band-related oversight in Netflix’s new heist series, Kaleidoscope.

In the show’s “Green” episode, criminal Judy (played by Rosaline Elbay) is attempting to smuggle SIM cards to her boyfriend Stan (Peter Mark Kendall), who is in prison. Judy is caught by a prison guard, and goes on to bribe her with One Direction concert tickets.

The tickets however, are for a show on March 6, 2016, months after the band had already gone on hiatus. “IT HURTS BEING A DIRECTIONER,” one Twitter user wrote in response.

Ellie Goulding Shoots Down Years-Old Rumor She Cheated on Ed Sheeran With Niall Horan

No love triangle here! Over the weekend, Ellie Goulding dismissed speculation that she once cheated on Ed Sheeran with Niall Horan.

Before heading out for her New Year’s Eve plans, the singer posted a casual TikTok video dancing to Harry Styles’ “As It Was,” captioning it, “Quick boob check then we’re birthday groovin.” (Goulding’s 36th birthday was actually one day prior, on Dec. 30.)

However, a follower tried to stir up trouble in the comments section of the breezy post by writing, “can’t believe u cheated on ed with niall but slay fr.” But Goulding was having none of it, and promptly responded, “False!!!! But also slay.”

The accusation dates back nearly a decade, when the Halcyon Days singer was spotted holding hands with Sheeran in the audience of the 2013 MTV Video Music Awards just one week after a U.K. tabloid claimed she was packing on the PDA with Horan during an outing to England’s V Festival.

At the time, Goulding insisted she and Sheeran were just friends by tweeting, “I love that holding hands with my friends means we’re an item. In that case I am in many relationships. Lover not a hater. #whatthef—.” But the “Shape of You” crooner said otherwise in a radio interview one month after the VMAs. “I mean, normal people don’t hold hands if they’re just friends,” he said. “It was going on. And now it’s not.”

The fire of gossip was further stoked the next year when Sheeran released “Don’t” as the second single from his 2014 album X. On the track, he details an on-and-off relationship with a fellow singer that ends in infidelity, and another British outlet printed that the song was about Goulding. (Sheeran later told Entertainment Weekly he “never actually confirmed” who “Don’t” was written about and forced the paper to take the story down.)

In a 2015 profile for Elle UK, Goulding maintained she and Sheeran were never an item, saying, “I did go on a few dates with Niall, but I was never in a relationship with Ed. I have absolutely no idea where that came from and why it was turned into such a big thing.”

Nowadays, Sheeran is raking in millions on his global Mathematics Tour while Goulding recently took the stage at the 2022 Earthshot Prize Ceremony during Prince William and Kate Middleton’s December trip to Boston. For his part, Horan is about to take his freshman spin in the giant red chairs of The Voice when the competition series’ 23rd season premieres in March.

Kelly Clarkson Sounds Sweet as ‘Honey’ on Blake Shelton Cover

Kelly Clarkson wants to spread some sweetness in the new year.

To kick off the Wednesday (Jan. 4) episode of her namesake talk show, the singer serenaded the audience with a soulful rendition of Blake Shelton‘s 2011 hit “Honey Bee.”

Accompanied by her band Y’all, the “Since U Been Gone” singer was surrounded by honey-colored stage lights and injected the song by her fellow Voice coach with an appropriate country twang. “You’ll be my soft and sweet/ I’ll be your strong and steady/ You’ll be my glass of wine/ I’ll be your shot of whiskey/ You’ll be my sunny day/ I’ll be your shade tree/ You’ll be my honeysuckle/ I’ll be your honey bee,” she passionately sang.

“Honey Bee” was released as the lead single from Shelton’s sixth studio album, Red River Blue. The country track peaked at No. 13 on the all-genre Billboard Hot 100 and topped the Hot Country Songs and Country Airplay charts.

Later on in the show, Clarkson invited fellow American Idol alum Justin Guarini to share special memories from his time on the show.

“It’s wild because we got shot out of the cannon, but I just loved being around and the fact that we were at the beginning of things, nobody knew what was up,” he reflected. “The stakes weren’t super high for us. We got to hang out so much.”

“If you ever have the chance to see Kelly and she says, ‘Hey, do you want to play a card game?’ Don’t,” he later advised actress Alexandra Daddario, also a guest on the show. “We would hang out and we would play speed because there were huge swaths of time, and I think I may have won twice in the hundreds of time that we played together.”

“I feel like I have natural caffeine in me, so it was really my game,” Clarkson added, to which Guarini said, “It was ridiculous! I just kept coming back for more.”

Elon Musk continues to make Twitter unbearable and annoying to use.

Twitter will begin relaxing its ban on political ads, a policy it has upheld for a long time, the company announced Tuesday, Jan. 3.

“We believe that cause-based advertising can facilitate public conversation around important topics,” the company tweeted. “Moving forward, we will align our advertising policy with that of TV and other media outlets.”

What that now means is that lobby groups and elected officials will once again be able to flood your feeds with political ads. Twitter banned the practice in 2019, before Musk, unfortunately, took over the country.

The 2019 policy insists candidates earn political influence and do not buy it, gaining support by going on the campaign trail and genuinely gaining interest in what they had to say instead of dumping money into the platform to push their messaging.

Upon taking over Twitter, Elon Musk said his mission was to loosen the rules on what could be shared on Twitter.

So far, he has successfully unbanned problematic accounts belonging to white supremacists and sexist trolls.

At the same time, Musk has also been successful in scaring away companies using advertising dollars on the platform in fears their ads will be alongside controversial tweets.

Because of that, the company’s revenue has significantly fallen.

Twitter hopes the return of what it calls “cause-based advertising” will bring in more revenue and attract advertising.

Republicans and Democrats did not care for the policy and felt the policy affects political campaigns while blocking advocacy organizations from getting out important messaging.

It has been nothing but bad news about the social media platform since Elon Musk has taken over.

The Sam Wrench-directed show, which was filmed in November 2022 at the Kia Forum in Inglewood, Calif., features special guests like Cardi B, Missy Elliot and SZA. To celebrate the moment when SZA appeared onstage to perform a remix of “Special,” Lizzo took to Instagram to honor their friendship.

Coachella 2023 Headliner Predictions: Who Will Top the Lineup?

Although the 2023 edition of the Coachella Valley Music & Arts Festival is still a few months away, kicking off on Apr. 14 in Indio, Calif., we should know which artists will be headed to the desert this year imminently. The Coachella lineup is typically unveiled in early-to-mid January, which means it’s just about time to submit final guesses for the artists who’ll headline this year’s edition of the three-day festival.

Which superstars will top the 2023 lineup? After Coachella boasted Harry Styles, Billie Eilish and a combo of Swedish House Mafia and The Weeknd as headliners last year — their first year holding the fest this decade, after having to cancel both the 2020 and 2021 incarnations due to pandemic-related concerns — speculation for who’ll follow in their footsteps has reached a fever pitch on social media.

Some artists who have the star power of a Coachella headliner are out of the running for this year, due simply to logistics: Taylor Swift and Paramore, for instance, both have tour dates on their respective 2023 itineraries that conflict with the Coachella dates, and are thus not viewed as potential performers. And a couple of these predictions may be a little far-fetched, since some have not announced themselves as active in 2023. That’s why we’ve separated these guesses into categories, from strong possibilities to pie-in-the-sky wishes. Once the full lineup drops, we’ll see how close we came to calling our shot.

Here are our best educated guesses as to who will lead the Coachella 2023 bill:

Every Regional Mexican Song to Enter Billboard’s All-Genre Hot 100 Chart

In May 2021, Gera MX and Christian Nodal made Billboard history with their collaboration “Botella Tras Botella,” becoming the first-ever regional Mexican title to enter the Billboard Hot 100 chart in its 64-year history. The country-tinged hip-hop fusion debuted and peaked at No. 60.

“This song did not have a marketing strategy or a plan. It has soul,” Gera MX, a former Billboard Latin Artist on the Rise, previously told Billboard. “I wrote it thinking about someone very important to me and people can tell that it hurt me a lot. I can’t find any other explanation and it’s beautiful. You’re not only showing off your artistic side, but also your human side.”

That same year, two other Regional Mexican titles entered the Hot 100 chart, which blends all-genre U.S. streaming (official audio and official video), radio airplay, and sales data: Ivan Cornejo’s “Esta Dañada” and Grupo Firme’s “Ya Superame.” 

But it was sibling trio Yahritza y Su Esencia, who as of now, has earned the highest ranking for a regional Mexican song on the chart with “Soy El Unico,” debuting at No. 20 in 2022. The then 15-year-old lead singer’s feat was historic, becoming the youngest Latin performer to enter the all-genre tally.

“I know that the words are very strong, but honestly, when it comes down to me writing my songs, it’s more like a research process,” Yahritza, who penned the song at 13, explained to Billboard at the time. “I see other people’s stories on TikTok — that’s how I found ‘Soy El Unico,’ because I saw a clip that said, ‘It’s crazy how someone can leave you when you’re the only one who’s best for them.’ No one’s going to believe me when I say that I get my inspiration from TikTok.”

Like “Soy El Unico,” most of these tracks have been fueled by their massive success on TikTok and social media, such as Grupo Frontera’s “No Se Va” last year. The song, which the group released independently and is a Norteño cover of Colombian group Morat’s 2018 single, debuted at No. 99 with 4.8 million U.S. streams (up 43%) and 1,000 downloads sold (up 278%) in the Sept. 23-29, 2022, tracking week, according to Luminate.

Their latest collaborations, “Que Vuelvas” and “Bebe Dame,” have earned Carin León and Fuerza Regida, each respectively, their first No. 1s on the Hot 100 dated Jan. 7, 2023.

As of now, only seven Regional Mexican tracks have entered the Hot 100. Prior, only three other regional Mexican acts have visited the chart since its inception in 1958, all through pop songs: Kumbia Kings and A.B. Quintanilla with their collaborative tune “U Don’t Love Me” (2000), and Marco Antonio Solis with his featured role on Enrique Iglesias’ “El Perdedor” (2014).
