Kanye West Files Breach of Contract Lawsuit Over Leaked Songs

Kanye West filed a lawsuit in California on Wednesday (Sept. 6) against the individual or entities responsible for taking and distributing copies of his music that have ended up on social media.

In the complaint, the artist, who now goes by Ye, alleges trade secret misappropriation and breach of contract due to the unauthorized leaks of copyrighted works on both Instagram and X (formerly Twitter), arguing they have caused “substantial harm” to his reputation.

Ye’s lawyers claim that starting on Mar. 3, 2023, the owner of the @daunreleasedgod_ handle on Instagram went on a leaking spree of unreleased tracks, including “We Did it Kid,” “Shy Can’t Look,” “NASDAQ” and “Mr. Miyagi,” as well as collaborations with artists including DJ Khaled and unauthorized video footage of a Donda listening party.

The rapper’s complaint goes on to cite the @daunreleasedgod_ account on X for similarly posting unauthorized leaks on dates ranging from mid-June to late August. “Ye has suffered significant financial losses and damages as a direct result of the Defendants’ actions,” the suit alleges.

The lawsuit does not name @daunreleasedgod_ or any of its other variations as a defendant in the case, only that it was the main distribution vehicle for the leaks.

Ye’s lawsuit indicates that he “does not know the true names or capacities” of the defendants who leaked the tracks to the Instagram or X user(s), but believes that those individuals were required to sign confidentiality agreements with him before they were given access to the compositions. By leaking and distributing the tracks, the defendants breached their contract with the artist and owe him damages and any profits generated, the complaint adds.

The filing continues that the “distinctive arrangement and unique elements” found in Ye’s music amount to a trade secret “due to its economic value, secrecy, and the efforts taken to safeguard it” and that the defendants violated their contract with Ye when they “knowingly and unlawfully acquired, disclosed, and distributed” those unique works.

The case, filed by Gregory K. Nelson of Weeks Nelson, seeks to restrain the defendants and “those acting in concert with them or at their direction” from further exploitation of Ye’s compositions and demands damages, fees and other costs. While the identities of the defendants are not yet public, “Ye will amend its Complaint to set forth the true names and capacities of these defendants when they have been ascertained.”

Zach Bryan Earns First Streaming Songs No. 1 With ‘I Remember Everything’

Zach Bryan earns his first No. 1 on Billboard’s Streaming Songs chart with the Kacey Musgraves-featuring “I Remember Everything,” which debuts atop the Sept. 9-dated survey.

In the Aug. 25-31 tracking week, “I Remember Everything” earned 33.7 million official U.S. streams, according to Luminate.

Bryan’s first Streaming Songs ruler eclipses the No. 3 peak of “Something in the Orange,” which reached the top three in October 2022.

It’s also Musgraves’ first Streaming Songs leader, coming in her first appearance on the list.

Bryan boasts 17 appearances in all on the latest Streaming Songs tally. Of those, 16 are from new album Zach Bryan, with “I Remember Everything” followed by “Hey Driver,” featuring The War and Treaty, at No. 5 (18.4 million streams). The aforementioned “Something in the Orange” joins the Zach Bryan songs at No. 18 in its 71st week on the survey (15.1 million streams).

Concurrently, “I Remember Everything” also tops the Country Streaming Songs and Rock Streaming Songs rankings. It’s his second No. 1 on both, following “Something in the Orange.”

As for Musgraves, it’s her first time on Rock Streaming Songs and sixth on Country Streaming Songs, with her previous best having been a pair of No. 14 peaks in “Rockin’ Around the Christmas Tree,” featuring Camila Cabello (January 2020) and “Justified” (September 2021).

As previously reported, “I Remember Everything” tops the all-genre, multi-metric Billboard Hot 100 and the genre-specific Hot Country Songs and Hot Rock & Alternative Songs lists. Zach Bryan, meanwhile, rules the Billboard 200 as well as Top Country Albums and Top Rock & Alternative Albums.

Kim Kardashian Quotes ‘All Star’ Lyric in Golden Bikini Post & Smash Mouth Approves: See the Photo

Kim Kardashian paid tribute to Smash Mouth in her own way on Wednesday (Sept. 6). In a pair of photos showing off her figure in a gold bikini, the reality star quoted one of the band’s most famous lyrics.

“All that glitters is gold,” she wrote in her caption on Twitter and Instagram, borrowing a line from “All Star” as a nod to the metallic shade of her swimwear.

The California rock band approved of the reference, retweeting Kim K’s post and adding: “only shooting stars.”

However, not everyone was happy about the Skims founder’s use of the song, which bowed at No. 4 on the Billboard Hot 100 in 1999. That’s because her post comes just two days after Smash Mouth’s frontman Steve Harwell passed away at 56 following some time spent in hospice; the singer was diagnosed with cardiomyopathy, a disease of the heart muscle that strains the heart’s ability to deliver blood to the body, several years ago.

“Someone dies and you use their lyrics to post a thirst trap,” wrote one Instagram commenter on Kardashian’s post. “Low key tone deaf,” wrote another.

But according to comments on Smash Mouth’s tweet, Harwell actually would’ve been fine with Kim’s post. One fan wrote, “people saying ‘too soon’ really didn’t knew steve and it shows lol,” to which Smash Mouth’s account agreed with a 100% emoji.

Harwell’s death was announced Monday (Sept. 4) in a statement from Smash Mouth’s manager, Robert Hayes. “Steve Harwell passed away this morning September 4, 2023 at his home in Boise Idaho,” it read. “He was surrounded by family and friends and passed peacefully and comfortably.”

“Steve should be remembered for his unwavering focus and impassioned determination to reach the heights of pop stardom,” the statement continued. “And the fact that he achieved this near-impossible goal with very limited musical experience makes his accomplishments all the more remarkable.”

Kygo’s Palm Tree Crew Management Partners With Live Nation

The management division of Kygo‘s Palm Tree Crew has partnered with Live Nation.

The new partnership is intended to expand opportunities for Palm Tree Crew Management’s dance/electronic-focused roster, which currently includes Kygo, Dean Lewis, Gryffin, Sam Feldt, Frank Walker, Forester, Thomas Jack and Petey Martin. 

Palm Tree Crew Management was founded in 2018 by Kygo (born Kyrre Gørvell-Dahll) and his manager Myles Shear. The Palm Tree umbrella also includes Palm Tree Records (a global joint venture with Sony Music Entertainment) and an international festival series. Live Nation co-promoted recent Palm Tree Crew Festivals in Dana Point, Calif. and Aspen, Colo.

“We are working with some incredible artists at the top of their games, and we’re so excited to have Live Nation as a partner as we continue to discover new talent and grow Palm Tree Crew Management,” says Palm Tree Crew Management CEO/co-founder Shear in a statement.

Shear has managed Kygo since discovering the artist on Soundcloud in 2013. Their partnership ultimately led to Kygo and Palm Tree Crews’s global success in myriad music and business ventures.

“Myles and Kygo are entrepreneurs at their core,” adds Live Nation Entertainment president/CEO Michael Rapino. “We’ve already worked on some great events together and we look forward to expanding our support as they help even more artists grow their careers.”

Palm Tree Crew also includes Palm Tree Crew Hold Co., an investment fund Shear and Kygo launched in 2020 with $7.5 million in private funding. Palm Tree Crew Hold Co. now includes PTC Crypto, a cryptocurrency fund that raised $20 million upon its 2021 launch, says Shear.

“I would never sit in my room and think, ‘I’m going to have hotels one day,’ but Myles is always thinking one step ahead,” Kygo told Billboard in a 2022 cover story. “He’s talking about Palm Tree restaurants, Palm Tree hotels. He has the biggest plans in the world and he’s working at a thousand miles an hour every day, and I’m just trying to keep up.”

Five Takeaways From BET’s Hip-Hop Awards 2023 Nomination List

On Thursday afternoon (Sept. 7), BET announced their nominations for this year’s BET Hip-Hop Awards. Slated to take place live in Atlanta on Oct. 3, the 18th annual awards show will showcase the genre’s brightest talents. The ceremony will premiere on  Oct. 10 at 9 PM ET/PT on BET. 

21 Savage and Cardi B lead the way with 12 nominations, while Drake is right behind with nine. DJ Khaled and Burna Boy each have seven nods, while J. Cole has six. Jay-Z, Coi Leray, and GloRilla follow with five apiece. This year’s nominations include a diverse crowd of proven veterans, rising rookies, thriving producers, and overseas leaders. 

“This year’s ‘BET Hip Hop Awards will mark the culmination of our year-long celebration of hip-hop’s storied creation and the art form’s sonic and cultural expansion,” said Connie Orlando, evp specials, music programming & music strategy for BET. “We are honored by this year’s roster of nominees as they continue to carry the creativity and diversity of hip-hop into the future. Last year, Kendrick Lamar ruled the awards, notching six wins on the night, including artist of the year and album of the year for Mr. Morale & The Big Steppers, which entered the Billboard 200 at No. 1. Lamar also shared two of his awards, best hip hop video for “Family Ties” with Baby Keem and video director of the year with PGLang co-founder Dave Free.

“In 1988, after a short-lived format boom in the early MTV era, alternative radio was again attracting the attention of major-market group broadcasters,” Ross on Radio editor, and Billboard alum, Sean Ross wrote in 2013.

“In the late ’80s and early ’90s,” Ross noted, “the core acts of alternative were still very much The Smiths, Depeche Mode and The Cure, but 10,000 Maniacs also [had] a place, and there [was] a significant female singer-songwriter presence, with Edie Brickell, Tracy Chapman, Patti Smith and Joan Armatrading.”

Reflecting the format’s ascent, in the Sept. 10, 1988, Billboard issue, the Alternative Airplay chart, then titled Top Modern Rock Tracks, began. Siouxsie & the Banshees’ “Peek-a-Boo” led the first list — becoming the first of 434 No. 1s and counting, through Bad Omens’ “Just Pretend” on the latest, Sept. 9-dated chart.

Over the chart’s first 35 years, alternative has welcomed acts ranging from one-time entrants to those that have been core to the genre over the survey’s entire existence. Along the way, British bands and singer-songwriters, as Ross chronicled, served as key hitmakers, followed by the format’s segues to grunge, nu-metal, Lilith Fair-era female folk-rock and a return to synth sounds in recent years.

Summarized Ross in 2013, “The alternative radio format is built upon the promise of what’s coming next.”

(Similarly, when the chart began, 29 stations comprised the reporting panel; today, over 50 do. Shout-out to the two both at the start and now: KROQ Los Angeles and XTRA San Diego. Tracy Chapman’s chart presence is likewise as welcome in 2023 as it was in 1988.)

As Billboard celebrates the Alternative Airplay chart’s 35th anniversary, below are 35 of the most notable feats achieved on the ranking. Included are the acts with the most No. 1s and top 10s, the elite songs that hit No. 1 on both Alternative Airplay and the all-genre Billboard Hot 100, and more.

Given the winding road that the format has traversed, it’s difficult to predict what artists and songs will rewrite records by the time of the Alternative Airplay chart’s 40th anniversary. As Chris Payne, former Billboard writer (and author of the newly-released book, Where Are Your Boys Tonight), wrote for the survey’s 30-year mark, echoing Ross, “A period of considerable destabilization in alternative very well may prove to be healthy long-term — a sort of refresh on the genre, in which artists and programmers will no longer be beholden to the bedrocks of alternative radio past, and can try anything and everything to see what works.”

Goyo Performs New Song ‘Tumbao’ at the ‘Victoria’s Secret World Tour’ Premiere Event 

Colombian singer and rapper Gloria “Goyo” Martínez was among the artists who attended the Victoria’s Secret World Tour premiere event, which took place on Wednesday (Sept. 6) in New York. After walking the pink carpet, Goyo performed her new song “Tumbao” from her forthcoming album, her first as a solo artist (following a successful run with hip-hop fusion collective ChocQuibTown).

Other attendees included Doechii and Doja Cat, who will be headlining the Victoria’s Secret World Tour, which marks the company’s return to TV since its last televised runway show in 2018. The fashion show/documentary is set to air on Prime Video on Sept. 26.

The Victoria’s Secret World Tour will feature global creatives from multiple cities, including Bogotá, Lagos, London, and Tokyo. Goyo — who will also perform during the actual documentary — is part of The House of Bogotá alongside fashion designer Melissa Valdes, filmmaker Cristina Sánchez Salamanca, painter Lorena Torres and dancer/choreographer Piscis. According to the film’s official website, the “dynamic artistic forces from the fashion, film, design, music, and visual fields will converge to showcase their work that centers on the appreciation and beauty of womanhood.”

A teaser of what viewers can expect from the show was released on Aug. 30, in which a slew of models who are set to appear in the show pose in a series of lit-up pink tunnels. Among the stars set to walk in the show are Hailey Bieber, Gigi Hadid, Honey Dijon, Imaan Hammam, Iris Law and Lila Moss. Additionally, beloved VS Angels Candice Swanepoel, Lily Aldridge and Adriana Lima will also return to the catwalk.

Jimmy Buffett’s Daughter Delaney Pens Touching Tribute to Late Singer: ‘I Will Love You Forever’

As the music industry continues to mourn Jimmy Buffett — who died at 76 on Sept. 1 — his daughter Sarah “Delaney” Buffett shared some thoughts about her late father, how he handle the cancer he ultimately succumbed to and the legacy he left behind.

“I knew my dad my whole life but in his final days, I saw who he was: a man whose spirit could not be broken,” her message, posted Wednesday (Sept. 6), began. “Despite the pain, he smiled everyday. He was kind when he had every excuse not to be. He told us not to be sad or scared, but to keep the party going. And as much as I’d like to use that as an excuse to drink myself into oblivion worthy of his literary heroes, I know it’s not what he meant. Yes, he loved his weed and his wine, but the truth is, most of the time, he was just high on life, and that is what he wanted for everyone: to enjoy the fantastic trip that life can be.”

The 31-year-old then shed light on Buffett’s relationships with his medical team. “My dad repeatedly told us how much he appreciated the doctors, nurses, and every person who was there for him during his battle with cancer,” she continued. So to those who took care of my dad at home and in the hospital, I want to thank you for giving us more time together. I am eternally grateful.”

After thanking friends, fans and family for their well wished amid her father’s death, Delaney extended a final thank you to her father for giving her a life that wouldn’t have been possible without his career to support them. “Finally, to my dad, thank you. You turned nothing into something and gave me everything. I will never be able to repay you or my mom for my beautiful life. I will love you forever, and I will always keep the party going (responsibly, of course).”

The “Margaritaville” singer’s death was revealed via his official website and social media accounts. “Jimmy passed away on the night of September 1st surrounded by his family, friends, music and dogs,” read the statement. “He lived his life like a song till the very last breath and will be missed beyond measure by so many.”

Buffet’s cause of death was revealed to be skin cancer.
