With No Harry Styles, MSG Entertainment Revenue Drops 3% Year-Over-Year to $142M

Madison Square Garden Entertainment (MSG Entertainment) had revenue of $142.2 million in the quarter ended Sept. 30, down 3% year over year, as it started its first full fiscal year as a standalone live entertainment company.

MSG Entertainment, which spun off from MSG’s Sphere and MSG Networks businesses in April, had lower event-related revenue and faced a tough comparison to the prior-year quarter. Not only did the prior-year quarter benefit from some concerts that were rescheduled due to the COVID-19 pandemic, but Madison Square Garden enjoyed a 15-show run from Harry Styles from Aug. 20 to Sept. 21, 2022, that grossed $63.1 million from 277,000 ticket sales, according to Billboard Boxscore

The company saw “significant” merchandise spending from Styles’ fans at those shows, said Dave Byrnes, MSG Entertainment executive vp/CFO, during Tuesday’s earnings call, and per-capita merchandise spending was down last quarter as a result. Fan spending on food and beverage “was up meaningfully” in the latest quarter, however, and MSG Entertainment is seeing “strong in-venue spending from our guests,” he said.

Strong demand for concerts, also seen in Live Nation’s latest earnings results, will help MSG Entertainment achieve a low double-digit percentage increase in event bookings this fiscal year. The company is getting help from a new generation of musicians who have graduated from smaller buildings in its portfolio to its flagship venue, Madison Square Garden. “This fiscal year, there are a number of acts, including Olivia Rodrigo, Tyler Childers and Niall Horan, who previously performed at either The Beacon [Theatre] or Radio City [Music Hall] that will soon headline the Garden for the first time in their careers,” said Byrnes. What’s more, he added, “a number of these first-time acts” are playing multiple nights and experiencing “strong ticket demand for their entire run.”

Beyond the concert business, MSG Entertainment has high expectations for its family shows. The company has 187 planned shows of its Christmas Spectacular at Radio City Music Hall, up from 181 shows in the prior fiscal year. MSG Entertainment expects paid attendance of about 1 million, bringing the holiday run back to pre-pandemic levels. In addition, Cirque du Soleil’s holiday show is returning after it took the year off in 2022, with 66 shows scheduled across The Theater at Madison Square Garden and the Chicago Theatre.

“We’re currently on sale with more concerts at our venues than we were at this time last year for the second half of fiscal ’23,” said Byrnes, “and of those on-sales, a majority of those tickets are already sold, and sell-through on those shows is currently up [a] high single-digit percentage as compared to the second half of fiscal ’23.”

MSG Entertainment repurchased about 3.5 million shares during the quarter, including repayment of a delayed draw term loan facility from Sphere Entertainment with 1.9 million shares. About 1.6 million shares were repurchased at $31.20 per share as part of the secondary underwritten offering by Sphere Entertainment in September.

Looking forward to the full year, MSG Entertainment reaffirmed its previous guidance of revenue from $900 million to $930 million and adjusted operating income of $160 million to $170 million. It lowered guidance for operating income to $85 million to $95 million, down from $100 million to $110 million.

Shares of MSG Entertainment fell as much as 9.8% to $27.55 on Tuesday morning before recovering to $29.09 by midday, a 4.7% decline from Monday’s closing price.

Fiscal first quarter financial metrics:

  • Revenue of $142.2 million, down 3% year over year.
  • Operating loss of $33.4 million, up 196% year over year.
  • Adjusted operating loss of $700,000, down from a $11.5 million operating profit.
  • Net loss of $50.7 million, up 183% year over year.

Mariah’s Christmas Lawsuit — Plus Dance Copyrights, Taylor Swift at SCOTUS & More Music Law News

This is The Legal Beat, a weekly newsletter about music law from Billboard Pro, offering you a one-stop cheat sheet of big new cases, important rulings and all the fun stuff in between.

This week: Mariah Carey is hit with a copyright lawsuit over “All I Want for Christmas Is You”; a federal appeals court issues a first-of-its-kind ruling on copyright protections for dance routines; Taylor Swift gets named-dropped at the Supreme Court; and much more.

THE BIG STORY: Mariah Sued Over Iconic Christmas Track (Again)

Just in time for the holidays, Mariah Carey is facing rebooted allegations that she ripped off her perennially-chart-topping “All I Want for Christmas Is You” from an earlier song of the same name.

Vince Vance (real name Andy Stone) first sued Carey last summer, claiming her 1994 holiday blockbuster infringed the copyrights to a 1989 song of the exact same name recorded by his Vince Vance and the Valiants. But the bare-bones complaint included few details about the alleged infringement, and the case was quickly dropped a few months later.

Now, Stone is back — both with new lawyers and with a more fleshed-out lawsuit.

Those new attorneys hail from Gerard Fox Law, the same firm that represented two songwriters in their lawsuit accusing Taylor Swift of stealing the lyrics to “Shake It Off” from 3LW’s “Playas Gon’ Play,” which also featured lyrics about “playas” and “haters.” After five years of litigation against the biggest pop star in the world, including a successful trip to the Ninth Circuit, Stone has certainly found himself battle-tested plaintiff lawyers to go after Carey.

And where the original complaint was short on specifics, the new one is chock full of them, including that she made up the story of how she wrote the song and that her own co-writer, Walter Afanasieff, has disputed that story.

“Carey has without licensing, palmed off these works with her incredulous origin story, as if those works were her own,” Vance’s new lawyers wrote in the re-filed complaint. “Her hubris knowing no bounds, even her co-credited songwriter doesn’t believe the story she has spun. This is simply a case of actionable infringement.”

Go read our entire story here, including the full complaint filed against Carey.

Other top stories this week…

CHOREOGRAPHY COPYRIGHTS – The Ninth Circuit issued a first-of-its-kind ruling on copyright protections for dance routines, reviving a case that accuses Fortnite creator Epic Games of stealing copyrighted moves from choreographer Kyle Hanagami, who’s worked with BTS, Jennifer Lopez, Justin Bieber and Britney Spears. The decision came after years of efforts by other dancers to secure better ownership of their routines, including Beyoncé and Megan Thee Stallion choreographer JaQuel Knight, as detailed by Rebecca Milzoff in her excellent 2020 Billboard cover story.

SCOTUS SWIFTIES? – Capping a year in which Taylor Swift’s name has dropped on Capitol Hill, at the Department of Justice and on NFL broadcasts, it came up last week during Supreme Court arguments in a major case over social media and the First Amendment, as part of legal hypothetical raised by Justice Ketanji Brown Jackson.

YSL CASE SET FOR TRIAL – After months of delays, a jury was finally seated in the massive criminal case against Young Thug and other alleged members of an Atlanta street gang, clearing the way for a trial to begin later this month. But will it feature rap lyrics as evidence? Stay tuned this week…

STEVEN TYLER ACCUSED AGAIN – The Aerosmith frontman was hit with a second lawsuit accusing him of sexually assaulting a minor decades ago, this time by a woman who says he forcibly kissed and groped her in New York City in 1975 when she was just 17.

AI FAIR USE ARGUMENT – Artificial intelligence firm Anthropic PBC told the U.S. Copyright Office this week that the massive scraping of copyrighted materials to train AI models ought to be considered “quintessentially lawful” – perhaps offering a preview of arguments the company will make in its upcoming legal battle with Universal Music Group (UMG) over those very same issues.

TICKET BOT CRACKDOWN – As reported by Billboard’s Dave Brooks, Sen. Marsha Blackburn (R-Tenn.) announced that she would roll out new legislation to beef up the BOTS ACT — a rarely-enforced 2016 law that outlawed the use of bots to attack ticket sales and jump the line to buy tickets ahead of consumers. If passed, the amendment will create a new forum for online ticket sellers to report successful bot attacks to the Federal Trade Commission, which is tasked with enforcing the statute.

CONTRACT RESTRICTIONS (TAYLOR’S VERSION) – Will trying to prevent the next ‘Taylor’s Version’ backfire on record labels? Following up on Steve Knopper’s reporting on new contractual restrictions pushed by labels in the wake of Taylor Swift‘s massively-successful re-recording campaign, music attorney Chris Castle argues that record companies might want to think twice.

Hot 100 First-Timers: The Citizens of Halloween Debut With ‘Nightmare Before Christmas’ Classic ‘This Is Halloween’

The Citizens of Halloween are, at last, first-time residents on the Billboard Hot 100 (chart dated Nov. 11), thanks to “This Is Halloween,” from Tim Burton’s classic 1993 stop-motion animated film, The Nightmare Before Christmas.

The song, on Walt Disney Records, debuts at No. 41 with 12.4 million streams (up 152%), 511,000 radio impressions (up 815%) and 3,000 downloads (up 58%) Oct. 27-Nov. 2, according to Luminate.

The song’s parent album The Nightmare Before Christmas jumps from No. 54 to No. 25 on the Billboard 200 with 25,000 equivalent album units (up 61%). The collection reached No. 22 last year, a new high. On the Soundtracks chart, the set rebounds for a fourth total week at No. 1.

Although he doesn’t earn an official artist billing on the song, “This Is Halloween” was written, composed and produced by Danny Elfman, also the main composer for The Nightmare Before Christmas.

In 2018, for the film’s 25th anniversary, Elfman began performing a live concert experience of its music, complete with a live orchestra and Elfman embodying the character Jack Skellington; he still performs such shows today. Catherine O’Hara and Ken Page also reprised their roles as Sally and Oogie Boogie, respectively.

In an interview with Billboard that year, Elfman said that despite The Nightmare Before Christmas becoming the first animated movie to earn an Academy Award nomination for best visual effects, he was initially disappointed by the film’s reception. “It came and went pretty quickly and didn’t do very well,” he said. “Nobody understood what it was or how to market it. I put so much into this project, including so much of my own personality, that it really hurt. At the time, I was really depressed after it came out. I put so much into it and it was gone.”

The film’s lasting impact, however, has brightened his outlook. “Of all the things I’ve worked on that I would have wished to find a second life,” he mused, “and I’ve worked on a million movies that died early deaths, it would have been Nightmare.”

Elfman has appeared on the Hot 100 in one additional iteration: as a member of new wave group Oingo Boingo. The band charted two songs on the list in the 1980s: “Weird Science,” the theme from the 1985 fantasy sci-fi film, and John Hughes TV series of the same name, reached No. 45 in 1985, and “Just Another Day” peaked at No. 85 in 1986. He’s credited as the sole songwriter on both tracks, and as a co-producer, alongside Steve Bartek.

Outside of the debut of “This Is Halloween,” three other Halloween hits re-enter the Hot 100: Michael Jackson’s “Thriller,” Bobby “Boris” Pick and the Crypt-Kickers’ “Monster Mash” and Ray Parker Jr.’s “Ghostbusters.”

Bebe Rexha & David Guetta Set to Perform at the 2023 Billboard Music Awards

Bebe Rexha & David Guetta are set to perform at the 2023 Billboard Music Awards, which are just 12 days away. They are the second BBMAs performers to be announced, following Peso Pluma. Performances and awards will roll out across BBMAs and Billboard social channels, as well as via BBMAs.watch, on Sunday, Nov. 19, beginning at 8 p.m. ET/5 p.m. PT.

Rexha and Guetta will perform their global hit “I’m Good (Blue)” and their follow-up “One in a Million.” “I’m Good (Blue)” is a finalist for three BBMAs – top collaboration, top Billboard global (excl. U.S.) song, and top dance/electronic song.

In addition, Guetta is a finalist for two awards on his own: dance/electronic artist and a second entry for top dance/electronic song – “Baby Don’t Hurt Me,” a collab with Anne-Marie and Coi Leray.

“I’m Good (Blue)” spent 55 weeks at No. 1 on the Hot Dance/Electronic Songs chart. Only one song in the chart’s nearly 11-year history has had a longer run at No. 1; “Happier” by Marshmello and Bastille topped the chart for 69 weeks.

Rexha is no stranger to chart-busting collaborations. “Meant to Be,” her collab with Florida Georgia Line, topped Hot Country Songs for a record 50 weeks.

Rexha and Guetta are both past BBMA winners. “Meant to Be” won four years ago for top country song. Guetta was named top EDM artist in 2013.

Rexha has had a total of four top 10 hits on the Hot 100. Guetta has amassed seven. Guetta has had two top five albums on the Billboard 200: Nothing But the Beat (No. 5 in 2011) and Listen (No. 4 in 2015). Rexha’s highest charting album on the Billboard 200 was Expectations, which debuted and peaked at No. 13 in 2018.

Taylor Swift is the top finalist at the 2023 BBMAs with nods in 20 categories. Morgan Wallen and SZA are runners-up, with 17 entries each. They are followed by The Weeknd (16); Drake and Zach Bryan (14); Luke Combs (10); 21 Savage, Metro Boomin and Miley Cyrus (nine each); Beyoncé and Rema (seven each); Bad Bunny and Peso Pluma (six each); and Ariana Grande, Guetta, Eslabon Armado, Karol G, NewJeans and Selena Gomez (five each).

The 2023 Billboard Music Awards Presented by Marriott Bonvoy will honor the year’s hottest names in music determined by year-end performance metrics on the Billboard charts. The program, produced by Dick Clark Productions, will deliver a reimagined award show concept that will entertain fans with music and exclusive content. Performances and award celebrations will take place in global locations, in the midst of sold-out tours, and in custom venues.

These fans will receive a “golden ticket” granting them access to attend a performance curated by their favorite artists, expressly for the 2023 BBMAs.

The 2023 BBMAs are presented by Marriott Bonvoy, Marriott’s travel program and marketplace. One special BBMAs performance and two exclusive acceptance speeches will be hosted at hotel brands within the Marriott Bonvoy portfolio. Jordan Poole Shoots Down Ice Spice $500K Date Rumor

HipHopWired Featured Video

Washington Wizards v Miami Heat

Jordan Poole is currently a member of the Washington Wizards and attempting to add his offensive firepower to the young NBA squad. Earlier this year while still a Golden State Warriors member, Poole was dogged by rumors he spent half a million on a date with Ice Spice but told a fan in Washington that the rumors were not true.

Last May, MediaTakeOut published an article alleging that Jordan Poole, 24, took Ice Spice on a whirlwind shopping spree that included him copping a Maybach truck for the popular rapper. The outlet claimed that sources close to Spice say that Poole dropped $500,000 on their first date which included stops at the Gucci and Louis Vuitton stores among other high-end establishments.

This past weekend, Poole was at a fan meet-and-greet event in Washington, D.C. when a fan inquired about the rumored date with the “Munch” star. According to Poole, he says that the rumor was “definitely not true” as he laughed at the young fan’s question while signing autographs next to the Wizards 2022 NBA Draft pick, Johnny Davis.

Mariah Carey Says New Music Is ‘On the Horizon’

This is the time of year when Mariah Carey is all about bringing joy and happiness to the masses. The Queen of Christmas is about to hit the road for her Merry Christmas One and All tour, and gear up for the endless loop of her modern holiday classic, “All I Want For Christmas Is You.”

But in a chat with Good Morning America on Monday (Nov. 6), the singer revealed that she’s cooking up some new modern classics as well. Carey said that fresh tracks are “on the horizon.” She revealed that she’s been in the studio working and “just writing new songs.” In fact, the day before she said she and her team were, “in the studio working on something with a choir, working on a new song. So it’s exciting.”

At press time there was no information on the album and a spokesperson for Carey could not be reached for additional comment on her next project. Carey’s released her 15th studio album, Caution, in 2018.

Carey’s most extensive holiday tour to date is slated to kick off on Nov. 15 at the Yaamava’ Resort and Casino in Highland, CA and keep her on the road through a Dec. 17 gig at Madison Square Garden in New York after hitting just Toronto and New York on last year’s tour.

She will be joined on the road by her 12-year-old twins, Moroccan and Monroe, with Carey noting that daughter Monroe — who did a duet with her mom on last year’s outing — is “rehearsing more than me, so I think she might have it together a little bit more than I do.” In fact, Carey joked that the tween “kind of” has a handle on her mother’s legendary whistle note, but “just has to play with it” to get it dialed-in.
