Kay Flock, a Bronx Drill rapper who notched several local hits en route to what looked to be a promising career, was arrested in 2021 for allegedly shooting and killing a rival. Earlier this week, Kay Flock was convicted on attempted murder and extortion-related charges but was not convicted of murdering Hwascar Hernandez.
As spotted on the Inner City Press website, Kay Flock, real name Kevin Perez, was convicted on March 20 after court proceedings that began last week on March 11 when opening statements were heard. According to the publication, Flock will not face the death penalty for the 2021 killing of Hernandez but could very well face life in prison. Flock

Flock will await sentencing on the convictions of racketeering conspiracy, use of a gun resulting in death, attempted murder and assault with a weapon in furtherance of racketeering, and use of a firearm for attempted murder and assault with a dangerous weapon. The court, however, did not go forward with the murder in aid of racketeering charge charge related to the Hernandez killing, accepting Flock’s self-defense plea.
On Instagram, Kay Flock celebrated not being found guilty on the murder charge and issued a message to his fans via the Story feed:

Kay Flock was one of eight individuals indicted with racketeering and murder charges among two Bronx, N.Y. gangs. The list of charges for Kay Flock has the potential to land him in prison for life or the death penalty.
Kay Flock, real name Kevin Perez, shot and killed a man in broad daylight in December 2021, just as the budding NY Drill rapper was finding some success as a musical artist. According to the press release released by the U.S. Attorney’s Office of the Southern District of New York, Perez was a member of the Sev Side or DOA gang in the Bronx borough and was involved in several crimes with his codefendants dating back to 2019.

Damian Williams, the United States Attorney for the Southern District of New York, and Keechant L. Sewell, Commissioner of the New York City Police Department (“NYPD”), announced the unsealing today of an Indictment charging KEVIN PEREZ, a/k/a “Kay Flock,” a/k/a “Kay,” a/k/a “KK,” DEVON MASON, a/k/a “BJ,” ERVIN BEAMON, a/k/a “EJ,” NICHOLAS JOHNSON, a/k/a “Nick,” SEAN SMITH, a/k/a “Sticky,” and JOSSI CASTRO, a/k/a “Jesse,” with racketeering conspiracy and other crimes related to their membership in “Sev Side,” or “DOA,” a street gang based in the Bronx, New York.
In a superseding indictment from January, the office named two other men, Iszayah Rowson and Michael Gant in the charges and noted their membership in the Third Slide gang, which maintained close ties to the Sev Side group.
The charges the 19-year-old Perez faces are Racketeering Conspiracy, Murder in Aid of Racketeering, Use of a Firearm Resulting in Death, Attempted Murder and Assault with a Dangerous Weapon in Aid of Racketeering, Use of a Firearm for Attempted Murder, and Assault with a Dangerous Weapon.

Bronx drill rapper Kay Flock is among eight members of Bronx gangs Sev Side and Third Side being charged with murder and racketeering, among other “violent offenses,” according to the Department of Justice. The Thursday (Feb. 23) press release also detailed charges related to, “attempted murder and assault with a dangerous weapon arising from seven shootings committed in the Bronx between June 2020 and February 2022.”

Six of the charged individuals, including Kay Flock — born Kevin Perez — are in police custody, while the remaining two are named in the release as fugitives. “Over a span of several years, the members of these gangs allegedly terrorized neighborhoods in the Bronx and Manhattan by killing and shooting other people. Through these charges, we will hold Sev Side and Third Side members responsible for plaguing our communities with gun violence,” said U.S. Attorney Damian Williams in a statement.

Kay Flock is currently awaiting arraignment in Manhattan Criminal Court on the federal charges. His alleged crimes carry a punishment of “mandatory life in prison or death,” according to the Department of Justice.

Kay Flock’s team did not respond to Billboard‘s request for comment at the time of publication.

The new charges add to 19-year-old Kay Flock’s collection of legal troubles, most notably his alleged 2021 murder of Hwascar “Oscar” Hernandez outside a Hamilton Heights barbershop in New York City, on which he is currently awaiting trial. Despite his growing rap sheet and the fact that he’s currently behind bars, he has continued to release new music, most recently The D.O.A. Tape [Care Package] in December 2022. Last year, Kay Flock’s single “Shake It” featuring Cardi B, Dougie B and Bory300 made quite the buzz, appearing on both the Billboard Hot 100, where it peaked at No. 51, and Billboard‘s US Hot R&B/Hip-Hop Songs, where it peaked at No. 14.

New York City mayor Eric Adams has publicly declared his disdain for the drill genre, linking it to violence and crime in the city. Since entering office in January 2022, the retired police captain has cracked down on artists in the genre, with the NYPD shutting down a number of drill performances. In September, drill rappers 22Gz, Sha Ek and Ron Suno were dropped from the Rolling Loud NYC lineup at the NYPD’s request. Other notable New York drill artists including Dusty Locane and Sheff G are also behind bars, while 22Gz is awaiting trial on attempted murder charges.
