Whitney Houston Movie Lawsuit, Kanye Song Dispute, Cam’ron Photo Ruling & More Legal News

This is The Legal Beat, a weekly newsletter about music law from Billboard Pro, offering you a one-stop cheat sheet of big new cases, important rulings and all the fun stuff in between.

This week: Sony Music files a lawsuit claiming the Whitney Houston biopic didn’t pay to use her songs; one of Kanye’s new songs is pulled from streamers after accusations of copyright infringement; a federal judge orders Cam’ron to pay a photographer for using an image of himself; and much more.

THE BIG STORY: Was the Whitney Houston Movie Out of Sync?

If you’re going to make a musical biopic, it’s important to sign a sync licensing deal. But it doesn’t mean much if you don’t actually pay for it.

Trending on Billboard

In a lawsuit filed last week, Sony Music Entertainment accused the producers of the 2022 biopic Whitney Houston: I Wanna Dance With Somebody of doing exactly that. More than a year after the film was released, the label says it hasn’t been paid a dime for the use of more than 20 songs like “I Will Always Love You.”

Musical biopics are big business – 2018’s Bohemian Rhapsody earned more $900 million at the box office and Baz Luhrmann’s 2022 Elvis made $288 million. But as we noted in this space a few weeks back, they pose a unique challenge that isn’t present for a run-of-the-mill true-life movie: you essentially must secure the ability to play the music of the star in question.

In last week’s lawsuit, Sony made a point to note that dynamic: “Unlike other types of films, musical biopics by their nature require use of the subject musician’s music, as it is nearly impossible to explain the importance of a musician’s creative genius or unique style and talent without the use of the musician’s music.”

So then what happened with Wanna Dance? Go read the full story here, including access to the actual lawsuit filed by Sony Music.

Other top stories this week…

KANYE SONG PULLED – Kanye West’s track “Good (Don’t Die)” was removed from Spotify and other platforms after the estate of legendary singer Donna Summer claimed that the song featured an unlicensed interpolation of her 1977 hit “I Feel Love.” Ye’s album itself, Vultures 1, was also briefly removed from digital platforms over a dispute with the original distributor – but still debuted at No. 1 on the Billboard 200.

CAM’RON’S CAMERA WRONG – A federal judge ordered Cam’ron to pay more than $50,000 to a photographer for using her photo – a famous shot of the Dipset rapper wearing a fuzzy pink coat and hat while holding a matching flip phone – on a slew of merchandise without permission. He’s just the latest in a long list of celebrities who have faced costly legal actions for using copyrighted images of themselves without paying the photographer.

CASE DISMISSED – Roddy Ricch won a ruling from a federal judge dismissing a copyright lawsuit that claimed the rapper stole key elements of his chart-topping 2019 song “The Box” from a 1975 song track called “Come On Down.” The judge said that Ricch’s song had “significant dissimilarities” from the earlier tune – a common sample in the hip-hop world – and that “no reasonable jury” would call Ricch an infringer.

RUSSELL SIMMONS ACCUSATIONS – The embattled music mogul was hit with a new lawsuit over allegations that he raped a former Def Jam video producer in the 1990s, the latest in a long list of public abuse allegations Simmons. Days later, the Def Jam founder was named in a second civil case – this time by a previous abuse accuser (former record executive Drew Dixon) over claims that Simmons defamed her by suggesting during a December interview that she was lying about her accusations against him.

SUSPICIOUS MINDERS? – Priscilla Presley is facing a lawsuit that claims she illegally turned her back on a former business partner named Brigitte Kruse, who claims she helped Elvis Presley’s ex-wife “dig herself out of impending financial ruin” and played a key role in getting the recent Priscilla movie made. Presley’s lawyer tell a different story, saying Priscilla rightly split with Kruse after discovering serious financial wrongdoing.

DANCE DANCE RESOLUTION – Fortnite owner Epic Games reached an agreement to end a lawsuit filed by celebrity choreographer Kyle Hanagami that claimed the gamemaker turned his dance moves into a lucrative “emote” that Fortnite players could buy. The deal with Hanagami, who has worked with BTS, Jennifer Lopez, Justin Bieber and Britney Spears, came months after a federal appeals court issued a first-of-its-kind ruling that allowed the case to move forward toward a scheduled trial this spring.

GLORIA TREVI CASE EXPLAINED – Mexican pop star Gloria Trevi is facing a complex legal battle over renewed allegations of serious sexual wrongdoing involving her former manager Sergio Andrade – claims she strongly denies by arguing that she, too, was a victim of his abuse. To get you up to speed, Billboard senior editor Griselda Flores put together a deep-dive timeline of Trevi’s legal woes – go read it here.

Watch Adele Explain Why She Looked So Annoyed in Viral NBA Game Meme: ‘I Was Sulking’

It’s been exactly two years since Adele‘s viral NBA meme was born, and at her residency show in Las Vegas over the weekend, the 35-year-old vocalist finally shared the story behind it.

In a video taken Saturday night (Feb. 17) at The Colosseum at Caesars Palace, Adele asks her audience, “Do you remember that viral meme of me looking like I don’t give a flying f–k?”

She then recreated the famous video onstage, looking left and right as if to avoid eye contact with her audience — just like she did when faced with a camera Feb. 20, 2022 at that year’s NBA All-Star game, which she attended with her boyfriend, sports agent Rich Paul.

“I know it sounds crazy, but I really don’t like being famous,” the “Easy On Me” singer explained, telling the crowd she felt the need to provide “context” for the video. “Obviously I’m sitting courtside at a basketball game, you’re asking for it, whatever. Rich is working the room, talking to players. And I was fine. I was just there on my own looking for Michael Jordan, if I’m honest.”

Trending on Billboard

According to Adele, the camera crew at Cleveland’s Rocket Mortgage Fieldhouse had approached her twice while she was sitting by herself to ask whether she was comfortable being filmed, which she politely declined both times. Even so, her image was blasted on the jumbotron at the game — and on national television.

“I was sulking,” she said, adding that she felt extra shy at the time due to the cancellation of her original Vegas residency. “I was like, ‘These motherf–kers have come back and are filming me against my will.”

“Also, my face is just very memeable,” she added. “I can’t help it.”

The Grammy winner has been performing for fans in Vegas on and off since the end of 2022 for her Weekends With Adele” residency, with dates scheduled through June this year. To her point, her shows often spawn funny viral moments — one of the most recent being when the “Rolling in the Deep” musician hilariously slammed critics of Taylor Swift and Travis Kelce’s romance.

“I think I want the Chiefs to win,” she said at the time, the night before the Kansas City team triumphed at the 2024 Super Bowl. “And all of you that are complaining about Taylor being at the game, get a f—ing life. It’s her f—ing boyfriend!”

Since its inception in 2018 by founders Aaron Ampudia and Chris Den Uijl, Baja Beach Fest 2024 continues to build on its legacy as a must-attend event, especially for Southern California residents, with Rosarito being a 45-minute drive south of San Diego, Calif.

Brooks gave the world an early look at the bar and honky tonk back in November, when he performed at the venue for Garth Brooks’ Amazon Music Live Concert on Black Friday. Some portions of the venue, including two floors of the four-story building, have had a limited opening for several weeks.

However, the March 7 grand opening will reveal all four floors of the 54,715-square-foot space; the opening will also include a police substation, developed in partnership with the Metropolitan Nashville Police Department.

Trending on Billboard

The first two floors will honor classic honky-tonks and will offer a custom-built, retractable live music stage, featuring the “Circle G” emblem, repurposed from the Central Park stage where Brooks performed for a record-breaking audience of more than 1 million people. The setup was installed by the same team that has toured around the world with Brooks and will feature the largest LED screens on Nashville’s Lower Broadway. The first floor will feature two bars, a dance floor and ample seating. The second floor will offer two additional bars, and a mezzanine offering views of the stage below.

The third floor will house intimate private event spaces, complete with a double-sided fireplace and an intimate patio, for gatherings of up to 250 guests. The rooftop fourth floor, dubbed The Oasis, will feature two full bars.

So far, the Friends in Low Places Bar and Honky Tonk has featured a limited menu, but the upcoming grand opening will highlight menus featuring recipes from musician/author/television star and Brooks’ wife Trisha Yearwood, drawing from Yearwood’s bestselling cookbooks and her television show Trisha’s Southern Kitchen and including fare such as meatloaf, friend chicken with white gravy, and an abundance of side dishes. The honky-tonk’s food menu will be available 11 a.m.-9 p.m., seven days a week.

“If you are one of the lucky ones who come to this town and receive its many blessings, don’t you owe something to Nashville?” Brooks said in a statement. “Garth Brooks owes a lot to Music City.”

“I can’t imagine there being a Garth honky-tonk without Trisha Food!” Yearwood added. “I’m honored to get to be a part of something so exciting and so big, and to work alongside the love of my life doing it. The whole team at Friends In Low Places is incredible!”

Friends in Low Places will be open seven days per week, from 11 a.m. through 2 a.m. on Monday through Friday, and from 10 a.m. through 2 a.m. on Saturday and Sunday.

On Tuesday evening (Feb. 20), beginning at 7 p.m. ET/6 p.m. CT, Brooks will discuss the grand opening of the bar and honky-tonk and more, with exclusive merch being sold during through TalkShopLive, including shirts, hats, tote bags, pint glasses and shot glasses.

Satire Site Fools MAGA Nuts By Saying Kid Rock & Jason Aldean Dropped New York Stop From Tour

UFC 296: Edwards v Covington

Kid Rock, the former struggle rapper turned struggle rocker, has shown and proven to have deep ties to MAGA and all things Donald Trump, and now Jason Aldean is roped into the nonsense. The pair, in a show of faux solidarity with Trump, were thought to be skipping New York during a make-believe joint tour because of a satire news site but some MAGA nutballs took the bait.

Kid Rock, 53, fresh off sneaking in Bud Lights when he thinks the cameras aren’t looking, and Jason Aldean both saw their names trending due in part to an article from political news satire site, The Dunning-Kruger Times, which has fooled some of the MAGA faithful before by mocking their blind allegiance to Donald Trump.

From The Dunning-Kruger Times:

“We support 45,” the tour’s website announced, “Therefore, we won’t be bringing the tour to the state that has treated him so poorly.”

The tour was set to play more than a dozen dates in New York, adding untold millions to local economies and giving patriotic Americans living in a liberal nightmare the chance to have a night to themselves.

MAGA goofball Brigitte Gabriel wrote of the fake news on X (formerly Twitter), “Kid Rock and Jason Aldean have responded to New York’s extreme attack on President Trump by REMOVING the state from their “You Can’t Cancel America Tour. This is a BIG DEAL and a sign of the silent majority rising again!”

Gabriel wasn’t the only one who took the news as facts, with folks reacting to the news on both sides not realizing the true nature of The Dunning-Kruger Times and their satirical bent that would remind some of The Onion and other related publications.

Check out the reactions from all sides below.

R&B/Hip-Hop Fresh Picks of the Week: Bryson Tiller, Lola Brooke & 41, Tierra Whack & More

Against all odds — and a brief disappearance from digital streaming platforms — Vultures I is finally here. The new joint LP from Kanye West and Ty Dolla $ign launched atop the Billboard 200 on Sunday (Feb. 18), while its breakout single, “Carnival,” starts at No. 3 on the Billboard Hot 100 (chart dated Feb. 24).

Although that new set, which features appearances from North West and Playboi Carti, dominated much of the conversation in the hip-hop and R&B worlds, it was far from the only thing of note to occur over the past week. On Valentine’s Day (Feb. 14) — or “Worst Day” if you’re a part of the Future Hive — Maze frontman Frankie Beverly announced his farewell tour. Beverly, of course, lent his voice to the seminal “Before I Let Go,” covered by Beyoncé for her 2019 Homecoming live album. Her version peaked at No. 65 on the Hot 100.

Trending on Billboard

In other R&B performance news, Usher added yet another new slate of dates to his ever-growing Past Present Future tour (Feb. 20) and the Roots Picnic announced their 2024 headliners, which include Jill Scott, Nas, Lil Wayne & The Roots and André 3000. On the hip-hop side of things, there’s no getting around the eye-popping new music video for Drake, SZA and Sexyy Red‘s “Rich Baby Daddy.” The clip — which has already amassed over 7.5 million YouTube views — finds Drizzy and Solána partying in a hospital while the “Pound Town” rap princess (who recently gave birth to her second child in real life) goes into labor.

With Fresh PicksBillboard aims to highlight some of the best and most interesting new sounds across R&B and hip-hop — from Bryson Tiller‘s new heater to Rae Khalil’s tender meditation on existentialism. Be sure to check out this week’s Fresh Picks in our Spotify playlist below.

Freshest Find: Pratt & Moody & Cold Diamond & Mink, “Creeping Around

Finnish soul duo Pratt & Moody are dishing up heavy old school vibes on their new Cold Diamond & Mink-produced single “Creeping Around.” Their take on contemporary soul is infused with an especially haunting approach to melody. The grandiosity of the song’s production — built almost exclusively around Moody’s sultry guitar — evokes the most stirring of James Bond themes, while the duo’s expansive combine vocal ranges trade off fluttery falsettos with robust full-voice crooning. “We gotta stop creeping around” is a simple, but incredibly effective hook; the song’s lyrical sparseness allows the meticulous arrangement ample room to breathe, making it a flawless backdrop for the slight twang that contours each repetition of “creeping around.”

Bryson Tiller, “Whatever She Wants”

After initially appearing on his Slum Tiller, Volume 2 mixtape last November, Bryson Tiller has finally unleashed fan-favorite track “Whatever She Wants” on all digital streaming platforms. Crafted with the intent to appear on a stripper’s pre-show playlist, “Whatever She Wants” finds Bryson far-removed from his heart-bearing hip-hop-inflected R&B. Instead, the Grammy nominee skates across TylianMTB-produced Detroit-inspired beat with all of the effortless swagger and braggadocio of a guy who could quite literally buy the whole club. “CC, Gucci, hit Bottega, whatever she want/ She piss me off, somehow she still get whatever she want,” he spits, somehow striking a fine balance of gruffness and seduction in his delivery.

Tierra Whack, “27 Club”

Mental health has long been a lyrical touchstone in hip-hop, just as the “27 Club” — an infamous collection of celebrities who passed at age 27 — has been a figment of pop culture’s obsession for decades. Thus, the convergence of these two concepts is fairly natural, and Tierra Whack expertly tackles them both on her new track, “27 Club.” Produced by J Melodic and ProdbyBRIANNA, “27 Club” finds Tierra contemplating suicide. “When your life gets hard but it’s simple/ When everybody ’round you suspenseful/ It ain’t really hard to convince you/ Lookin’ for somethin’ to commit to?” she spits. The dark beauty of this song is that Tierra wholly rejects the notion of a happy ending or a narrative of triumph; she simply sits in the aching self-loathing, guilt and depression that comes with suicidal ideation.

Lola Brooke & 41, “Becky”

Last year, both Lola Brooke and 41 dropped off full-length projects — Dennis Daughter and 41 World: Not the Album, respectively — and now the two fast-rising New York rap breakout stars are kicking off 2024 with a new collaboration. Predicated on a definition of “Becky” that refers to fellatio, the fiery drill joint marks the union of some of the most exciting voices in the contemporary hip-hop scene. Lola’s characteristically menacing delivery is a smart complement to TaTa’s boisterous ad-libs and Kyle Ricch’s high-octane flow. Of course, the “Don’t Play With It” rapper also pairs well with 41’s Jenn Carter, whose slick wordplay makes her closing verse the strongest.

Chantae Cann & Kenyon Dixon, “B-Side”

Kenyon Dixon has been on something of a hot streak lately between his 2024 Grammy nomination and a recent string of gorgeous duets. On “B-Side,” his new joint alongside Billboard-charting jazz and soul signer Chantae Cann, he keeps that streak alive. Produced and co-written by Masego, there’s a throughline of sultry, “come-hither” energy that encapsulates the innate, tasteful allure of the slinkiest jazz-inflected R&B melodies. Cann delivers the hook in a breathy tone that pairs well with Dixon’s whimsical descending riffs. Who said grown and sexy R&B was dead?!

Rae Khalil, “Is It Worth It”

In celebration of the announcement of her signing with Billboard chart-topping rapper-singer Anderson .Paak‘s APESHIT label, Rae Khalil has unleashed a new .Paak-produced single titled “Is It Worth It.” Built around an understated drum-laden and bass-anchored soundscape, Khalil asks “Is it worth it?/ If I show up when I want/ In the sea of the same face/ Is it worth my time, time?” The lyrical battle between her own pride and her desire for connection and yearning to be wanted and desired come to a head in the lush instrumental break that simultaneously serves as the song’s bridge and outro — talk about a stunner.

ScHoolboy Q, “Yeern 101”

Q’s new LP, Blue Lips, arrives in just under two weeks, and the Grammy-winning rapper is amping up his rollout. Built around a skittering, bass-blaring beat crafted by Cardo, J.LBS, Johnny Juliano & Yung Exclusive, “Yeern 101” finds the TDE star effortlessly skating over the track with a borderline breathless flows. There are no easy hooks or choruses here, these are two heady voices chock-full of smart wordplay, high-speed flow switches and sly changes in inflection and intonation — both of which are elevated by the ever-intensifying instrumental. “I’m a n—a out here, everything come free/ I ain’t never met God, but I bet he know me/ Put the money in a set, a n—a die in them streets/ Threw the boy alley oop, now he ridin’ on fleek,” he spits.

Major Labels’ $1B Piracy Verdict Against Cox Communications Overturned by Appeals Court

A federal appeals court has overturned a massive $1 billion copyright verdict won by the major record labels against internet service provider Cox Communications, sending the case back for a new award to be calculated.

In a decision Tuesday (Feb . 20), the U.S. Court of Appeals for the Fourth Circuit vacated the huge award against Cox over illegal downloading by its subscribers — one of the largest ever in an intellectual property lawsuit — on the grounds that part of the verdict was not supported by the law.

The ruling sets the stage for a new trial, but Cox could still be on the hook for heavy damages. That’s because, while the appeals court overturned the jury’s decision that Cox committed so-called vicarious copyright infringement, it affirmed that the internet service provider (ISP) had still committed a different type of infringement.

Trending on Billboard

Universal Music Group, Sony Music Entertainment and Warner Music Group all sued Cox in 2018, seeking to hold the internet giant itself liable for alleged wrongdoing committed by its users. The labels said Cox had ignored hundreds of thousands of infringement notices and had never permanently terminated a single subscriber accused of stealing music.

The case was part of a string of such lawsuits filed against ISPs around the country. Charter Communications, RCN Corp., Grande Communications and others were hit with the same claims around the same time.

ISPs like Cox are often shielded from lawsuits over illegal downloading by the Digital Millennium Copyright Act, or DMCA. But the judge overseeing the case said that Cox had forfeited that protection by failing to terminate people who repeatedly violated copyright law.

Stripped of that immunity, jurors held Cox liable in December 2019 for the infringement of 10,017 separate songs. They awarded the labels more than $99,000 for each song, adding up to $1 billion. Cox eventually appealed that verdict to the Fourth Circuit, a federal appeals court that could overturn it.

In Tuesday’s ruling, the appeals court said that the jury had been correct to find that Cox had willfully committed so-called contributory copyright infringement — meaning the company had induced or authorized its customers to pirate the music. But the court said that the labels had failed to show that Cox committed vicarious infringement, which would have required proving that the ISP profited from the illegal downloading.

“The continued payment of monthly fees for internet service, even by repeat infringers, was not a financial benefit flowing directly from the copyright infringement itself,” the appeals court wrote. “Sony has not identified any evidence that customers were attracted to Cox’s internet service or paid higher monthly fees because of the opportunity to infringe Plaintiffs’ copyrights.”

Because part of the verdict was tossed out, the court ruled that a new trial would be needed to recalculate the damages award — this time, based only on the finding of contributory infringement.

Travis Scott Teases More Music Coming: ‘We Will Be Back’

Travis Scott is feeling inspired after the arrival of last year’s Utopia and the Grammy-nominated album’s subsequent tour.

La Flame took to his Instagram Stories on Tuesday (Feb. 20), letting fans know he’ll be back with new tunes and how much he’s still in love with the grind that comes with creating music.

“I love music so f–king much,” he wrote. And for the record. We will be backkkkkk. I gotta kick a new gear since they think it’s play time.” Previous posts to his Story include him bumping Rodeo tracks such as “Wasted” and “Nightcrawler” with Swae Lee.

It’s unclear who Scott is referencing as “they,” but one of his fan pages believes it to be a shot at the Recording Academy for snubbing him at the Grammy Awards. La Flame’s Utopia lost in the best rap album category to Killer Mike’s Michael project at the Feb. 4 ceremony.

When it was revealed during the Grammys pre-show that Mike had won, Scott headed to X and tweeted out a raised-eyebrow emoji.

Trending on Billboard

In 2018, Scott was visibly upset after his cinematic Astroworld lost in the same category to Cardi B’s Invasion of Privacy. In his Netflix documentary, Look Mom I Can Fly, the “SICKO MODE” rapper walked off upon learning the news and was cursing to himself.

As far as what’s ahead, Scott could have another Cactus Jack compilation on his mind as he saluted his Cactus Jack signee Don Toliver: “Bring that s–t down, DT. What we doing?” he added in another IG Story. “Whole cactus gang are snapppers.”

Following Astroworld, the Houston rager turned to his JACKBOYS label compilation project in 2019, which featured standouts such as the Pop Smoke-assisted “GATTI” among the seven tracks.

A turbulent five-year journey — which included Scott’s tragic 2021 Astroworld Festival, during which 10 people died — then led Trav to his Utopia project in August 2023.

The highly anticipated LP earned him another No. 1 atop the Billboard 200 with 496,000 total units sold in the first week, the most of any hip-hop album released last year. All 19 tracks debuted on the Billboard Hot 100 as well.
