Can Taylor Swift Sue Donald Trump Over AI-Generated False Endorsement?

After Donald Trump posted AI-generated images to social media that falsely suggested Taylor Swift had endorsed him, can the superstar take legal action against the Republican presidential nominee? We asked the experts.

Posted on Sunday (Aug. 18) to Trump’s account on his own Truth Social platform, several of the photos showed women in t-shirts with the slogan “Swifties for Trump” emblazoned on the front. Some of those shots appeared to have been generated by AI, including several originally posted by a satire website.

But the most prominent image showed Swift herself, dressed up as Uncle Sam in the style of a World War II-era recruiting poster, bearing a clear message: “Taylor wants you to vote for Donald Trump.” At the top of the post, Trump himself responded to the apparent endorsement: “I accept!”

Trending on Billboard

The images quickly sparked outrage among fans of the superstar singer, who has long been an outspoken critic of the 45th president. Though she has not yet endorsed a candidate in 2024, Swift supported Joe Biden and running mate Kamala Harris in 2020 — and she blasted Trump for “stoking the fires of white supremacy and racism” and urged her legions of fans to vote him out of office.

As news of Trump’s post spread across the internet, many Swifties quickly wondered the same thing: Could Taylor take legal action against the former president?

According to Jessica Silbey, a professor at Boston University School of Law and an expert in intellectual property and constitutional law, Trump’s fake endorsement post likely violates Swift’s right of publicity — the legal power to control how your name, image and likeness are used by others.

“Everyone enjoys a right of publicity,” says Silbey, who has written extensively about the internet. “This kind of use — being made to say and seen as believing things you don’t — is at the core of the right.”

As the explosive growth of artificial intelligence tools has made it easier to convincingly mimic real people, lawmakers have scrambled to empower individuals like Swift to better protect their right of publicity. The federal NO FAKES Act, currently under debate in Congress, would make it illegal to publish a “digital replica” of someone’s likeness without their consent, including their voice or their image.

Trump’s post — featuring a photorealistic, AI-generated replica of Swift’s image without her consent — would almost certainly violate that new federal law. But even without the NO FAKES Act, states across the country already protect the right of publicity and would likely give Swift grounds to sue Trump or his campaign. Silbey says Swift might also explore suing him for defamation, claiming the false presidential endorsement harmed her reputation.

Whether the star should do so is a different question. Such litigation would be long and costly and Trump has potential defense strategies, including pinning the blame on the people who originally created the images, or arguing that his posts were free speech shielded by the First Amendment. And even if Taylor won, it’s hard to say whether it would be worth the effort to pull down one post.

“I’m skeptical the juice would be worth the squeeze,” says Woodrow Hartzog, another professor at Boston University School of Law.

Rather than responding with cease-and-desist letters or a lawsuit, Swift might decide that she’s better off fighting Trump’s fake endorsement with a legitimate endorsement of her own, broadcast across social media to her millions of die-hard fans. That’s the kind of remedy that no court can issue — and one that will likely hurt Trump far more than any judge could.

“I think Swift probably has more effective political rather than legal recourse here,” Hartzog said.

The Rise of Elliot Grainge: A Brief Career Timeline of Atlantic Music Group’s Incoming CEO

Tracing the rapid ascent of the 30-year-old record executive (and son of UMG’s Lucian Grainge), from his early entrepreneurial ventures to his industry-shaking new role.

On Aug. 1, shockwaves reverberated through the music industry when the Warner Music Group announced that Elliot Grainge would take the helm of Atlantic Music Group as CEO effective Oct. 1, succeeding longtime leader Julie Greenwald in the role and bringing his independent label 10K Projects under the Atlantic umbrella. The change marks both a generational transition at the storied label (Grainge is just 30 years old and more digital-focused than Greenwald and her longtime Atlantic co-head Craig Kallman) and a new level of influence for the 10K Projects founder, the son of Universal Music Group chairman/CEO Lucian Grainge

While that family connection is impossible to discount, Grainge has managed to pave his own path in the industry since founding 10K, through which he launched artists like Trippie Redd, XXXTentacion, iann dior, 6ix9ine and Ice Spice, whom he managed to woo amid heated competition from major labels (he ultimately signed the rapper in partnership with Capitol Music Group). Of course, Grainge was afforded an unparalleled training ground courtesy of his father, who offered his son a rare window into the business early on; in interviews, the younger Grainge has told of accompanying his father to meetings, reading the music trades and soaking up all he could about the business from a young age.

Now, as Grainge prepares to assume the top role at one of the most prestigious gigs in the industry, here is a look back at his career so far — from his early entrepreneurial ventures in college to his time running his successful independent label.

Chart ranks are based on a weighted formula incorporating official-only streams on both subscription and ad-supported tiers of audio and video music services, as well as download sales, the latter of which reflect purchases from full-service digital music retailers from around the world, with sales from direct-to-consumer (D2C) sites excluded from the charts’ calculations.

“Birds of a Feather” repeats atop the Global 200 with 85.5 million streams (up 9%) and 16,000 sold (up 129%) worldwide Aug. 9-15. Sabrina Carpenter’s “Espresso” holds at No. 2 on the Global 200, following three nonconsecutive weeks at No. 1 beginning in June; Shaboozey’s “A Bar Song (Tipsy)” returns to its No. 3 high, from No. 4; Carpenter’s “Please Please Please” rises 6-4, after spending two weeks on top starting in June; and Karol G’s “Si Antes Te Hubiera Conocido” climbs 7-5, becoming the third of her six top 10s to go top five.

Hanumankind and Kalmi’s breakthrough hit “Big Dawgs” blasts 17-9 on the Global 200, as well as 13-8 on Global Excl. U.S. It drew 59.3 million streams (up 15%) and sold 5,000 (up 7%) worldwide in the tracking week, with 45.3 million streams and 2,000 sold outside the U.S. The track has also hit the top 10 on multiple tallies in Billboard’s Hits of the World charts menu, including India Songs, where it keeps at its No. 3 high.

“Birds of a Feather” concurrently flies highest on Global Excl. U.S. with 62.7 million streams (up 9%) and 7,000 sold (up 131%) outside the U.S. Aug. 9-15.

Karol G’s “Si Antes Te Hubiera Conocido” reaches a new No. 2 Global Excl. U.S. best, jumping from No. 4; Carpenter’s “Espresso” holds at No. 3, following eight nonconsecutive weeks at No. 1 beginning in May; Jimin’s “Who” slips 2-4 after logging two weeks at No. 1 earlier in August; and Carpenter’s “Please Please Please” pushes 6-5, following two weeks at the summit beginning in June.

The Billboard Global 200 and Billboard Global Excl. U.S. charts (dated Aug. 24, 2024) will update on Billboard.com tomorrow, Aug. 20. “I came here to mix and master my album Flygod Is an Awesome God 3,” he started the caption. “And was waiting for my files, so I had played some beats and caught a vibe, told him load it and made a joint, then made another joint, and then made another joint. And now 24hrs later I made a new project.”

He added, “I told y’all I was thinking about dropping a project even before the album, I been doing so much wrestling and fashion I’m ready to get back on my WSG s—t!!!!”

Trending on Billboard

In the video, he said he made the album in a day to see if he still had it, and wants to release the new tape immediately. “Listen, I’m not even waiting. I want to drop this ASAP,” he shared. “I gotta go figure out what I gotta do, how I gotta do it, whatever distribution, I want this out ASAP. This is to let people know.”

The Buffalo rapper surprised fans when he announced his plans to release the third installment to the Flygod trilogy after initially considering retiring from making studio albums. “I’m not saying I won’t come with a five-song EP with Madlib or I won’t do a seven-song EP with Alchemist or I won’t rap. I’ll do all of that, but making a studio album, I’m done with all that. It’s back to dumping until I don’t want to dump no more. I’m going to have fun now. It’s no more pressure,” he told Rolling Stone last October.

While an unreleased track could be heard in the background of the video he posted, Gunn hasn’t released anything thing from this upcoming project. However, he’s already premiered one single from Flygod 3 during TNA’s Slammiversary in “Chocolate Face” featuring DJ Khaled, and teased another track on social media in “Big Dump” featuring Stove God Cooks.

Lele Pons Responds After Nicolás Maduro Lashes Out at Her: ‘You Will Not Silence Me!’

President Nicolás Maduro lashed out at Venezuelan singer and influencer Lele Pons in a video posted on his Instagram and TikTok accounts, amid the tension generated by the recent Venezuelan presidential elections in which he declared himself the winner. The video was released after the massive opposition march on Saturday (Aug. 17), which brought together thousands of people in Caracas and other cities worldwide, including Tokyo, Mexico City and Miami.

“Eleonora ‘Lele’ Pons wants to impose a government in #Venezuela through a concert in Miami, but who said she is a politician? Lele Pons is not the #CNE! Do not underestimate Venezuela, you do not know the spiritual power of this #People!” reads the description of Maduro’s TikTok video.

“Who said that Lele Pons and the artists that she is calling, just like the concert in Cúcuta, should determine the life of an entire country?” the Chavismo leader said. “So they think that because some artists were going to sing, the next day they would invade Venezuela. Be careful with manipulations, be careful. And you can conspire from Miami, but in Venezuela, the Venezuelans rule. As we did with the artists at the concert in Cúcuta, so will the people of Venezuela, today even more strongly.”

Shortly after, Pons reacted in a video on her TikTok account captioned, “You will not silence me! VENEZUELA WON ??❤️.” The artist also shared some images on Instagram of her participation in the march, during which she carried the flag of her native country, accompanied by Venezuelan artists Danny Ocean, Elena Rose, Marko and Joaquina, among others.

Pons is the Venezuelan influencer and singer with the most followers on social media, with more than 53.4 million followers on Instagram alone and 32.5 million on TikTok. She has been vocal about the irregularities in Venezuela’s elections, where the opposition claims to have evidence that its candidate, Edmundo González, obtained the majority of the votes.

On Aug. 9, she did an Instagram Live with Venezuelan opposition leader María Corina Machado, during which the politician answered questions from her followers and announced Saturday’s massive event aimed at the international community.

Doja Cat Spotted Seemingly Getting Cozy With ‘Stranger Things’ Star Joseph Quinn

Doja Cat seems to have a new man in her life — and she’s been interested in him for a while.

In a video shared by celebrity gossip page DeuxMoi, the “Paint the Town Red” singer looks to be strolling around London with Stranger Things star, Joseph Quinn. In the clip, which was taken from far away, the duo are seemingly walking with their hands around each other’s waists, as well as holding hands. Quinn is seen rocking a button down white top and blue trousers, while Doja opted for a lavender maxi dress, heels and short blonde hair.

While the video does appear to be Doja and Quinn, the spotting is unconfirmed and the duo have yet to publicly confirm the status of their relationship. Billboard reached out to both stars’ teams for more information, but did not receive a response at the time of publication.

The unconfirmed spotting comes just two years after Doja got into some since-squashed online beef with another Stranger Things star, Noah Schnapp, after the actor posted a screenshot to TikTok of his private messages with Doja in which she’d asked him to set her up with Quinn.

Trending on Billboard

After Schnapp’s since-deleted TikTok went viral, Doja — who’d previously tweeted about her crush on the “fine as s–t British actor — went on Instagram Live to say that Schnapp’s behavior was “so unbelievably, like, socially unaware and wack, adding, “That’s like borderline snake s–t. That’s like weasel s–t.”

Schnapp later told Variety that the duo made amends after their online fallout. “So, as I should, I apologized,” he shared. “She was totally OK with it, and was like, ‘I’m sorry how I reacted.’”

MAGA Upset By Kamala Harris & Her Love For Doritos, Xitter Calls It Weird

Kamala Harris’ love of Doritos has right-wing supporters of Donald Trump highly upset, leaving many on social media noting how weird that is.
As Kamala Harris is out on the campaign trail as the Democratic nominee for president, the latest attack on her by Republicans is focusing on her choice of snack food – Doritos. The attacks came over the weekend, as Vice President Harris made a stop at a Sheetz gas station and convenience store in Pennsylvania. She was accompanied by Second Gentleman Douglas Emhoff and her running mate, Minnesota Governor Tim Walz. When Emhoff handed her a bag of Nacho Cheese Doritos, Harris was delighted which prompted a reporter to ask if they were her favorite. This is my go-to. The original, nacho cheese,” Harris replied.

The road trip moment didn’t seem to go over well with pundits on the right. Elisabeth Hasselbeck, the former Survivor cast member and co-host of The View, appeared on Sean Hannity’s Fox News program on Friday (August 16) to express her disdain. “You just talked about Kamala Harris supposedly eating a bag of Doritos,” she began, “That’s potentially your commander-in-chief. That’s the emotional response of the leader of the free world is to binge-eat a bag of Doritos? Can you imagine Putin chugging down a bag of Sour Patch Kids?”

Others online chimed in, saying the moments felt “forced” as an attack on Harris’ appeal to the public. But many others called out how nonsensical those attacks were, and wondered why right-wingers were still supporting Donald Trump with his abundance of flaws as a candidate. “But Donald munching down KFC and mainlining Ketchup is ok?”, wrote Eddie Pierce in a post on X, formerly Twitter. Another X user wrote, “What are they even complaining about anymore? These aren’t normal or serious people.” Walz’s campaign team also responded with a sly jab in a post, showing Walz handing Harris a bag of Doritos during a visit to another Sheetz in Moon Township, Pennsylvania on Sunday (August 18).

Taylor Swift Meets Families of Southport Stabbing Victims Before Eras Tour Show

At one of her recent Eras Tour shows in London, Taylor Swift met with the families of victims harmed by the deadly mass stabbing at a children’s dance class in Southport in July.

In photos posted to TikTok by one mom who met the pop star with her daughters at Wembley Stadium over the weekend, Swift poses with the two girls and gives both of them hugs backstage. The older girl appears to wear a bandage covering her left forearm, while both young Swifties sport Red-themed T-shirts. In other photos, the little girls smile next to Swift’s mom, Andrea.

“You drew stars around my scars ?? ….,” the mom wrote in her caption. “The biggest thankyou to @Taylor Swift and her mum for making the most magical night possible for us all ?? thankyou for bringing Hope & Autumn pure happiness last night & always ???.”

Swift hosted multiple families impacted by the tragedy before stepping on stage at Wembley, where she’s slated to play five final shows before closing out the European leg of her Eras trek.

On July 29, a 17-year-old knifeman targeted a Swift-themed dance and yoga event for children ages 6 to 11 in Southport, killing three young girls and injuring eight more children as well as two adults — including 35-year-old instructor Leanne Lucas, who was recently readmitted to the hospital, according to the BBC. U.K. police has since charged the teenager with murder and attempted murder.

The 14-time Grammy winner has not addressed the attack on stage, but she did release a statement shortly after it occurred. “The horror of yesterday’s attack in Southport is washing over me continuously, and I’m just completely in shock…” Swift wrote at the time. “The loss of life and innocence, and the horrendous trauma inflicted on everyone who was there, the families and first responders. These were just little kids at a dance class. I am at a complete loss for how to ever convey my sympathies to these families.”

Kesha’s Name Back in Credits For Pitbull’s ‘Timber’ Video After Mr. Worldwide Said He Was ‘Looking Into’ Reports of Removal

Kesha fans were sent for a loop on Sunday (Aug. 18) after claims that the “Eat the Acid” singer’s name was removed from the video credits of Pitbull‘s 2013 hit “Timber.” According to screenshots posted on Reddit of what appeared to be the altered credentials for the visual for the single from Mr. Worldwide’s Meltdown EP, whose hook is sung by Kesha, her name looked like it was scrubbed.

But a check of the credits for the song on Monday morning (Aug. 19) showed that the song is credited to both the artists, with Kesha’s former stage name (Ke$ha) also listed as a feature in the official video title. According to reports, for an unknown period of time on Sunday, the video, which has more than 1.5 billion views to date, was amended to read “Pitbull – Timber (Official Video).”

Trending on Billboard

In a statement posted on Sunday afternoon to X, Pitbull sent a direct message to Kesha assuring her that he was looking into the reports. “@KeshaRose and I have an incredible song together. Nothing will change this. Team Pitbull is looking into this matter. Always nothing but love for Kesha, Dale!”

At press time spokespeople for Kesha and YouTube had not returned Billboard‘s request for additional comment and a spokesperson for Pitbull had also not responded to a request for clarification. The statement from Pitbull appeared to come after Kesha fans flooded social feeds on Sunday with anger over the apparent erasure of her significant contribution to the song which peaked at No. 1 on the Billboard Hot 100 for three consecutive weeks.

Many fans speculated that the removal could have been tied to Kesha’s yearslong feud with the song’s main producer, Dr. Luke (born Lukasz Gottwald), whom she sued in 2014 alleging that he sexually, mentally and emotionally abused her; Dr. Luke denied all the allegations and filed a defamation suit in response, with the two settling of court in 2023 just before a trail was set.

Watch the “Timber” video and Pitbull’s message to Kesha below.
